Due to the COVID-19 public emergency, DOEE has provided a one-year delay for all performance and reporting requirements for most buildings subject to BEPS. This means that under the final rules, buildings that do not meet the BEPS will have the first reporting requirement due on April 1, 2023, and meeting the energy performance requirements of a compliance pathway is not due until 2026. The delay is detailed in section 3520.7(g) of the final BEPS Compliance rules.
In order to receive this delay building owners will have had to demonstrate that their building consumed energy during the COVID-19 public emergency declared on March 11, 2020, by Mayor’s Order 2020-045. Most buildings have already done this by submitting a 2020 benchmarking report. For buildings that did not submit a 2020 benchmarking report the first reporting deadline remains April 1, 2022. A building owner seeking this delay may provide DOEE a copy of a utility bill from during the time of the public emergency. Please note the public emergency was extended through April 16, 2022.
