Misuse of the ENEC marks
The ENEC marks are used to indicate products that are ENEC and ENEC+ certified, in line with the applicable European Standard. The certification verifies several positive qualities, such as safety, performance, and protection for consumers and the environment. Holders of the certificate are permitted to display the ENEC certification marks on their products only after they have undergone the necessary testing, inspection and certification procedure.
The process inevitably involves costs for the certificate holder. Unfortunately, there are instances where the ENEC marks are misused, such as applying the ENEC mark to products without authorization, thereby taking advantage of the reputation and importance of the ENEC certification in global markets. The unauthorized use of the ENEC marks can occur in various ways:
Instances of misuse:
- A manufacturer or retailer uses the protected ENEC marks without holding a valid certificate.
- A certificate has expired or has been withdrawn by the issuing certification body, leading to the automatic expiration of the right to use the ENEC marks.
- Modifications were made to the product without prior written notification to the issuing certification body. These changes may require additional testing, type testing, or updates to the certificate.
- The ENEC marks are displayed alongside non-certified products or are used without the appropriate identification number.
To safeguard both customers and the reputation of the ENEC marks, we cannot tolerate the improper use of the ENEC marks in the market.
We thoroughly investigate all cases of ENEC marks misuse and reserve the right to take legal action, including pursuing claims for damages. The right to use the ENEC marks is granted to the certificate holder by the authorised certification bodies along with the certificate.
