His work includes applying secure-systems expertise to evaluate patent claims, system architectures, and potential infringement pathways, providing defensible, evidence-based technical interpretations in complex, high-stakes IP matters. He also offers in-depth system deconstruction of wireless, sensing, and communication technologies backed by national-security-level engineering rigor. Building on a strong foundation from U.S. Air Force service and extensive hands-on RF engineering experience in the military, defense, aerospace, and telecommunications industries, Dan offers deep expertise in RF systems, spectrum management, acquisition frameworks, and regulatory compliance. Her work includes analyzing generic drug life cycles, designing opioid pricing models to inform federal policy, and evaluating the economic and public health effects of substance bans—expertise directly applicable to antitrust, intellectual property disputes, and damages quantification in healthcare, pharmaceuticals, and biotechnology. Nikki’s experience leading FDA investigations supports engagements beyond traditional IP matters—including regulatory disputes, commercial litigation, and market behavior analysis in biotech, life sciences, and health services. Her work evaluating the economic effects of substance bans and other regulation‑driven outcomes offers clients unique insight into how policy shifts affect markets, pricing, damages, and competitive dynamics. In a recent engagement, Ocean Tomo, a part of J.S. Held, was retained by ArcelorMittal to provide opinions regarding the economic prong of the Domestic Industry (“DI”) requirement under Section 337 of the Tariff Act of 1930. Ocean Tomo provided a comprehensive approach to the economic DI inquiry, beginning with assistance related to gathering key discovery and documents, interviewing ArcelorMittal personnel, and touring multiple ArcelorMittal facilities. We quantified ArcelorMittal’s investments in plant, equipment, labor, and capital for the manufacture of the DI Precursor Products and the manufacture of the DI Direct Products, which involved understanding a complex and multifaceted supply chain for the accused products. Ocean Tomo also presented detailed calculations and qualitative economic evidence establishing that such investments were related to and added significant value to the DI Products.
