Questions were propounded by SPO3 Jose Vencer and these questions are numbered
consecutively and each question is followed by the answer of Mr. Christian Oberio-Deita.
1. Do you swear to tell the truth and nothing but the truth?
I do.
2. Are you aware that you may face criminal liability for false testimony or perjury if you
will not tell the truth?
I am.
3. Please state your name, age address and occupation?
I am Mr. Christian Oberio Deita, 50, resident of Brgy. Malipayon Street, Masaya Village, Iloilo
City. Im a lawyer by profession.

Yes I am.
5. Is your complaint a complaint of grave threats against John Leo Tomulto?
Yes.
6. What is your relation with Mr. John Leo Tomulto, the accused in this complaint?
He is my debtor.
7. How much money did this Mr. John Leo Tomulto owe you and when should it be paid?
I loaned him the amount of P10,000.00 on December 1, 2014 payable on or before December 23,
2014.
8. Did he pay the certain amount on or before December 23, 2014?
No, he didnt.

9. Did you demand the said amount from him?


Yes. I texted him on December 23, 2014 at 10AM asking him to pay the P10,000.00 within the
day or on December 24, 2014, the following day. He replied Yes I will but he was not able to
pay the said amount.
10. Was this the only time that you texted the accused to demand the amount?
No. I texted him again on December 26, 27, and 28.
11. What was his reply?
He did not reply on the text messages I sent on December 26 and 27. On my December 28 text,
he replied: Hulat ka bala na agi ka. Piliton mo ang wala kwarta? [Just wait you gay. Will you
demand from somebody who has no money?]. I did not reply anymore.
12. Is it true that on December 31, 2014, you went to Mr. Leo John Tomultos house in Brgy.
Kalipayan, Villa, Iloilo City?
Yes I did.
13. What was your purpose of going there?
To collect his debt.
14. Did you see him there?
Yes I did.
15. Did he pay his debt?
No he didnt . He only threatened me while I was outside the gate of his house.
16. What did he say to you?
He shouted: Testingi lang sulod di sa balay ko kay utdon ko ulo mo sa babaw kag sa dalom
while holding a bolo.
17. What did you do after those lines were uttered by Mr. Tomulto?
I ran away from his house because I feared for my life.
18. Was the incident subjected to barangay conciliation proceedings?

Yes. However , no settlement was reached because John Leo Tomutlo did not adhere to the
summons given to him by the barangay.
19. Is the purpose of the execution of this affidavit then, to support the filing of criminal case
of grave threats against the accused, John Leo Tomulto?
Yes it is.
The questions asked by SPO3 Jose Vencer were answered by me, MR. CHRISTIAN
OBERIO DEITA on January 6, 2015 in Iloilo City Police Office willingly and without any
irresistible force or threats.
In view of the foregoing, I am executing this affidavit to support the filing of a criminal
case of grave threats against JOHN LEO TOMULTO.
IN WITNESS WHEREOF, I have hereunto set my hand this 6th of January 2015, in the
city of Iloilo, Philippines.
