HANLEY CASTLE PARISH COUNCIL

Minutes of the Meeting of the Parish Council held on Thursday, 21st July 2016 at
Hanley Swan Village Hall, starting at 7pm.

Welcome: The Chairman welcomed all present and accepted the apologies
submitted to the Clerk.
99/16 Declarations of Interest & Dispensation Requests from Councillors
a) Register of Interests: Councillors were reminded that they should have updated
their register of interests and sent them to John Williams at MHDC.
b) To declare any Disclosable Pecuniary Interests in items on the agenda and their
nature: None Declared
c) To declare any Other Disclosable Interests in items on the agenda and their nature:
None received
d) To consider and agree all requests from Councillors for the Council to Grant a
Dispensation (S33 of the Localism Act 2011) None Received
Closure of the meeting to allow parishioners present to speak on any matters
relating to the Parish. No questions were raised from the floor.
100/16 Minutes: The Minutes of the Meeting held on 16th June 2016 had been
previously circulated and the minutes were approved and signed.
101/16 Matters Arising & Progress Reports not Listed elsewhere on the
Agenda:
Min 69c/13: Anne Ballinger gift The noticeboards had been made and the one by the
pond had been erected. The second one would be collected and installed by the
contractor, M Waggett.
ACTION: Cllr Roberts to issue a cheque for the invoice received and arrange
for installation.
Min 98c/15: Speed Check on Welland Road No update available
Min 176b/15: Road safety improvements at Cross Hands No progress but Cllr Lamb
would take it up with Cllr Wells when he had recovered.
Min 45a/16: Caf Markets proposal to jointly purchase a VAS The two quotations
were discussed and it was agreed that Cllr Taverner would speak to the lengthsman to
determine what additional equipment was required to enable a like for like comparison.
It was agreed that he would have delegated authority over the matter.
ACTION: Cllr Taverner to speak with the lengthsman and determine
requirements and select quotation.
Min 58/16a Pathway works - Community Orchard pathway. The Community Orchard
Committee had responded to say that they were happy to assist with the laying of the
path if the Parish Council would provide the materials. Peter Goodyear to arrange with
Jackie Bass and Andrew Darwent. Some Parish Councillors also offered to help with the
working party.
ACTION: The Clerk to let Peter Goodyear know that the committee were willing
to organise assistance.

Min 88b/16: Site visit to the Pond, Coverfield & the Green A site visit had taken place
with councillors and Gerry Brienza from Highways. The various issues surrounding the
area were discussed in depth.
Pub Parking: Mr Brienza suggested erecting a knee rail along sections of the Green to
prevent parking on it which would be provided by the County Council. All Councillors
were in favour of this and he would be asked to proceed with it. The use of yellow lines
was also discussed but the Council was advised it would be a very long process and
would take over 18 months. It was agreed that it would be worthwhile starting the
process so that the option to have them might be taken up in the future. Closing off the
road was also discussed but was thought not to be viable by Highways as there would
be no turning space which would be a requirement.
Cllr Bolton raised the issue of patrons of the pub parking by the pond and in Coverfield
and the danger this posed as there were no white markings to define the end of the
road and where it joined Worcester Road. It was agreed to ask Highways if white road
markings could be put down.
ACTION: The Clerk to liaise with Highways over knee rail, yellow & white lines.
Cllr Adeney to speak to the publican regarding the knee rail.
Coverfield Potholes: Cllr Roberts had undertaken some investigation and found
documentation that led her to believe that Coverfield was the responsibility of Nexus
Kemble and that they leased the area of trees to the Parish Council but were
responsible for maintaining the road leading to the houses. She had emailed Mr
Williams at Nexus Kemble and was awaiting his response. It was also agreed to look up
Land Registry for the British Legion and the area that was under their responsibility.
Cllr Adeney said that she had asked whether Highways would be prepared to adopt the
road but was told they would only adopt a road if it was in perfect condition so if the
Parish Council wished that to happen the potholes would need to be repaired first. The
matter was discussed in depth with a proposal to line the area with rustic logs/tree
trunks and soil and seed behind and tarmac up to the top edge of Coverfield. It was
agreed to obtain a quotation for this work to be undertaken. It was also agreed to
contact Home Farm and ask them to repair the pothole on their section of ownership.
ACTION: The Clerk to obtain additional quotations for the work discussed and
contact Open Spaces and Land registry to gain clarity regarding the ownership
of the pond and surrounding area. Letter to be sent to Home Farm owners.
Ducks: The replacement duck sign had been installed at Roberts End & the vegetation
cleared round the one on Malvern Rd. Various suggestions had been put forward and
discussed with Highways. Signs on the road would not be permitted but moveable duck
signs around the area would be approved as long as they were not on Highways land.
Cllr Adeney suggested speaking to Howard Hutchings to ask if he would be able to
make a couple of amusing and catchy signs to be used.
ACTION: Cllr Adeney to ask Mr Hutchings about producing signs.
102/16 Finance:
a) Payment of Accounts: Members approved the payments of accounts as in the
presented schedule in Appendix 1.

Tansy Cottage, Worcester Road, Hanley Swan, WR8 0EA
Outline application for the erection of a single dwelling with all
matter reserved except access.
The Parish Council had no objection to this application and it was noted that refusal was
due to the new property being built outside the settlement boundary, The settlement
boundary splits the site so the request would be made to move the boundary to the
edge of the property site.
ACTION: The Clerk to send request to Planning Inspectorate.
d) Details of enforcement action: Mortimer Lodge - DClr A Morgan updated the Parish
Council. She confirmed that everything was in order as per the plans and so nothing
further could be done.
104/16 Highway Matters
a) Report & Works for the Lengthsman Cllr Taverner said all lengthsman work was in
order and the footpaths/cycleway had been cleared towards the school.
105/16 District & County Councillors Reports
a)
District Cllrs Morgan & Morgan: The DCllrs said there was nothing to report from
MHDC at the time. Cllr Lamb asked if anything could be done to prevent parking along
the Hanley Road when the Upton festivals were on especially the section from
Countrywide to the bridge. DCllr M Morgan said they would review the signs for
parking. He commented that it had been better this year as the camping sites had
opened up on the Thursday rather than the Friday.

DCllr A Morgan asked if the Council knew of any projects within the parish to do with
children that might need funds. It was agreed to ask the playgroup if they needed
anything.
ACTION: The Clerk to email the Playgroup and ask if they have any ideas.
Cllr Adeney raised the issue of the bus service and said that she had been attending
monthly bus meetings. The circular route would finish in the future and people were
trying to decide on what would replace it. Concerns were raised that they would be
forced into a dial a ride service which would not be flexible enough for those that
worked. DCllr M Morgan said that the service had been put out to tender but there was
no real interest in it. He said that the situation was being monitored at Development
Control meetings as housing was being approved on the grounds of homes being on a
sustainable bus route which was no longer true. Cllr Bolton asked if they could find out
what the shortfall was so that it could be looked at filling via subsidies.
It was agreed that the whole situation was disappointing but Cllr Adeney would keep
the Parish Council up to date.
b) County Cllr Tom Wells: Cllr Wells was not present.
106/16 Report of the:
a)
Parish Paths & Tree Warden (Peter Goodyear)- Peters report was read out and
Marjorie Nelson updated the Council on the Horse field issues. The stile had been
deemed illegal as it was homemade and the alignment of the path was incorrect. The
Enforcement Officer had visited the site and was undertaking a land registry search to
find out where the owner was residing.
The County Officer had identified 5 stiles which would be replaced and discovered
rotten planks. Finger posts would also be replaced by Highways due to health and
safety issues.
Marjorie confirmed that they had now finished all of the pathways. Cllr Roberts thank
her for all her and Peters hard work and perseverance with the parish pathways.
ACTION: Mr Goodyear to set up a meeting with Community Orchard Committee
in September.
b) Pond Wardens (Neil & Gigi Verlander)
c) Playing Field Warden (Graham Holmes) Feed-back on the type of bin to be situated
by the shelter was also required to be sought from the Warden. It was noted that a
swing was broken. Cllr Reborts was sourcing replacement parts from Lappset.
ACTION: The Clerk to ask Mr Holmes, Cllr Roberts to order the required parts.
d) Local Police - The Community Officer had notified the Clerk that they would be
unable to attend a meeting in 2016. It was requested that they be asked to email
reports instead.
ACTION: The Clerk to email the Officers and request reports were sent.
107/16 Environmental Matters
Report of the Environmental Working Group Cllr Adeney suggested that if New Farm
Ground Maintenance (NFM) were no longer cutting the Green that they were asked to
cut the section of verge down from Chapmans Orchard, the diamond by the bus stop
could be strimmed and the other side of Jubilee Cottage. However, there was
uncertainty about the cutting of the Green and the Clerk was asked to email NFM and
clarify how often they were cutting it.
Cllr Roberts said that she could ask the school contractor to cut the verge by Chapmans
Orchard when they cut the section between Chapmans Orchard and the school.
Cllr Adeney asked if the wildflower verge could be cut and baled again. All were in
favour.
ACTION: The Clerk to email NFM & Cllr Roberts to arrange for the verge to be
cut. Cllr Adeney to arrange for the baling.
108/16 Neighbourhood Development Plan Cllr Lamb asked that Councillors
review all the documents that had been produced as feedback was required by the end
of August. The reports were available to download from the Hanley website and forms

that could be completed would be emailed out. Cllr Roberts suggested an informal
meeting on the 18th August at the Three Kings to go through the documents.
ACTION: Cllr Roberts to organise a meeting to review documents.
109/16 Correspondence
Royal British Legion Subsidence Claim Cllr Roberts had been contacted by Aviva Loss
Adjustors who were acting on behalf of the British Legion Club. They had a subsidence
claim and were requesting that several trees surrounding the pond be cut down. The
trees were under a TPO and it was agreed to contact Chris Lewis-Farley to seek his
advice.
ACTION: The Clerk to seek advice from Chris Lewis-Farley.

a) Village Day 23rd July Cllr Roberts notified the Council of the up and coming
event that was being organised.
