In a democracy where sovereignty rest on people, where ideas of constitutionalism


is rule, people must be armed with certain basic rights, one such right is freedom of
speech & expression. The framers of Indian Constitution was well aware about the
Dictatorship & about the importance of Freedom of speech & expression. Article
19(1)(a) which specifically recognizes Freedom of speech & expression is of
seminal importance. Justice Patanjali Shastri , has described it as a soul of
individual existence. The idea of constitutionalism recognizes that each & every
institution or an individual should remain within its bounds. Freedom of speech &
expression is not absolute right; it is subject to certain exception one such
exception is Sovereignty & Integrity of Nation. It is in this perspective that the
author(s) will focus on various cases of Sedition from the year 2007 to 2017. In
the concluding part of the paper some suggestions will also be provided.
