As requested, we are pleased to submit for your confirmation our proposal to
represent you as counsel in the criminal case for B.P. 22 [Bouncing Checks Law] you
intend to file against __________. This is in connection with the latter’s issuance of
bounced check as payment for the installation charges and services you have rendered.
Please find hereunder our terms and conditions for the service to be rendered:
OBJECTIVES
This engagement aims to enable your Company, through our Firm, to prosecute before
the Prosecutor’s Office of Makati City a criminal case for B.P. 22 otherwise known as
the Bouncing Checks law against _________ and to secure from the said Office a
resolution for the further prosecution of the said case in the appropriate court.
Our Firm will exert its best effort to attain the said objective within the permissible
bounds of the law. We do not however guarantee that the Prosecutor taking
cognizance of this case will issue a resolution in favor of the company, as many
factors are considered before the Prosecutor arrives at a resolution. Please find
hereunder our terms and conditions for the service to be rendered:
SCOPE OF WORK
Particularly our services will cover the following viz:
1. Meet with you and/or the authorized representatives of the
company in order to discuss thoroughly the facts of the case
and the pertinent issues involved;

2. Preparation and filing of complaint-affidavit, rejoinder, and
other pleadings and reviewing of documents, pertinent annexes
relevant to the case;
3. Appearing as counsel before the Office of the City Prosecutor
during the preliminary investigation;
4. Pursue closely and steadily the status of the case.
PROFESSIONAL FEE
For this engagement, we shall charge you as follows:
1. The amount of ___________________________, as our acceptance fee in
handling the case; this includes, among others, the study, determination
and thorough evaluation of the appropriate legal action to be undertaken.
Payment of our acceptance fee shall commence our lawyer-client
relationship;
2. The amount of appearance fee in court shall be charged as follows:
2.1. _____________________[Php_________] if
the counsel appearing is a Legal Associate of the
Firm;
2.2. ______________________[Php __________]
if the counsel appearing is a Legal Manager or
Supervisor of the Firm; and,
2.3. _______________________[Php ______] if
the counsel appearing is a Partner or a Consultant of
the Firm.
3. The amount of ____________________ [Php _________], for the
preparation of the complaint-affidavit, reply, petition for review or other
pleadings which will require at least twelve [12] hours of work;
4. An amount of ______________________ [Php _________] for obtaining
a resolution by the Prosecutor in your favor, or in case an amicable
settlement is reached;
5. The above fees are understood to be exclusive of out-of-pocket expenses
such as notarial fees, transportation expenses, expenses for materials and

supplies used, facilitation costs and other related expenses, which shall be
for your account.
In the event the information is filed with the appropriate court, our professional fees
shall be as follows:
1. We will require an additional acceptance fee of ______________[Php ];
2. The amount of appearance fee in court shall be charged as follows:
2.1. _____________________ [Php ] if the counsel
appearing is a Legal Associate of the Firm;
2.2. ______________________ [Php ] if the
counsel appearing is a Legal Manager or Supervisor

3. The amount of _______________ [Php ] for the preparation of every pleadings to
be required by the Court which will require at least _________ hours of work;

or in case an amicable settlement is reached;
5. We shall likewise bill you a success fee equivalent to _________________ of the
total amount collected, including interest, penalties, counter-claims, attorney’s
fees and other forms of liquidated damages awarded by the court in your favor,
but in no case shall it be less than _______________;
The above fees are likewise understood to be exclusive of out-of-pocket expenses,
such as but not limited to notarial fees, expenses for materials and supplies used,
transportation expenses, facilitation cost and other related expenses.
Payment of the above-mentioned acceptance fees shall commence our engagement.
