“The undersigned alan, bong duly swern, deposes and says:
1. That the undersigned affiant, Desetve Jared Barbero #434 a sworn member of the Department of
Emergency Services and Public Protection, Division of State Police, presently assigned tothe Western District,
Major Crime Squad, under the command of eutenant Michael ‘Donnell #060, and has lw enforcement
‘experience of approximately sevenyears. The afiant has conducted numerous investigations of eiminal
acthity including, but not limited te; murder, robberies, sexual assaults, burlares, narcotics violations, and has
received specialzed taining inthe processing of crime scenes andthe investigations of complex criminal cases
‘Atal times mentioned herein, the undersigned was acting in an official capacity as a member of the
aforementioned agency. The following facts and circumstances ae related from personal knowledge and/or
‘observations and include information related to the afiant by fellow police officers and persons with
knowledge of the faets and/or circumstances contained herein.
2, That the deceased juvenile male vctim (008 07/29/2039) was identified as a victim of domestic violence, and
hereinafter wll be referred to as the vietim, refer to confidentiality statutes CG S. S4-86d and 54-86e,
4 That on July 6, 2020 at approximately 1358 hours, tate Police Dispatch received w 911 cal, where a female
called from 7 Bue Ridge Terrace, Oxford, and reported a baby was not breathing. Upon police arrival, a woman
(later identified as Rebecca Dixon, and hereinafter to be referred to as Becky) was holding a baby who appeared
limp (the victim) EMIS arived shor after pole, and the victim was transported by ambulance to Griffin
Hospital in Derby.
4. That responded to Griffin hospital in order to speak with the family ofthe victim. After arriving to Griffin
hospital, | met with Emergency Department staff, and was informed that the vietim was pronounced upon his
arrival to the hospital by Or. Navid Behrooz, who stated the victim had no signs of fe for approximately 70
minutes.
5, That due to Becky's emotional dbstres, I spoke with her mother, Barbara Dixon, inthe Emergency
Department. Barbara stated verbally that her daughter Becky had called out of work asa veterinary technician

‘mother that the victim was ating fussy and cranky when he woke up. Barbara stated that Becky, her husband,
aié the victim live with her Barbara added that Becky and her husband Eric have one bedroom, and the victim
sleeps in a separate bedroom. However, when the victim woke up in the morning, Becky took him into her
room with her, where they remained for the entire morning an afternoon as far as Barbara could recal
Barbara stated because Becky was 35, she didnot lke to barge in or hover. Barbara stated she thought Becky
and the victim were napping and watching TV in Becky's room, and also added that between 1230 pm and 330
'pm the victim usually naps. Barbarastated that around 1 pm, she heard Becky cll out from her upstairs
‘bedroom, Barbara ran upstairs and observed the victim laying face upon the bed with no signs of life. Barbara
‘and Becky both began CPR and called 912. Barbara Informed me that she was not aware of any alcohol or drug
abuse, however Becky did have a prescription for Xanax for anxiety,
6. That | then spoke with Becky inher treatment room. Becky stated she called out from work the morning of
(07/06/2020 because the victim was being fussy. Becky stated she let the victim stay with her in her bedroom
‘that mocning, but was not sleeping, and continued to be fussy, Becky stated at around 1230pm, the victim
finaly fell asleep, face down in the crook of her elbow. Becky tated she fel asleep as well. Becky then stated
when she woke up, the victim was not moving and felt imp. Becky stated she called out to het mather and
‘began CPR. | asked Becky i she hadtaken Xanax that day, and she replied she took one 5 mg pil at 830 am.
then obtained written consent from Becky for her DNA, and had hospital staff draw her blood for analysis by
the Division of Scientific Services.
7. That during scene processing, the Van unt discovered evidence of recent narcotics usage. Inthe bedroom
hich Becky stated was hers and Eres, the Van unit found paraphernalia and empty packaging in variour
locations. Specially, on the night stand along the South wall next tothe bed, a zippered black eather pouch
\was discovered inthe partially opened top drawer. Located inside the pouch was a homemade glass smoking
pipe with burnt residue and small pieces of apparently used plastic baggies, consistent with cocaine base (crack)
sage. In the partially opened bottem drawer of the same nightstand, another zippered leather pouch was
found, located inside was a black pasic bag containing empty plastic baggies or pieces of plastic bageles
consistent with narcotics packaging A clear plastic baggie that contained, amongst other Items, torn pleces of
approximately six empty glassine envelopes stamped "Skittles" was found in the northeast bedroom trash can.
‘The envelopes were consistent with lt opiate use, anda hollow tube from disposable ink pen was found on
the nightstand. One ofthe ends of this tube was roughly cut on a bevel and was consistent with similarly seen
Instruments used to insulate narcotics.
8, That on 06/25/2020, North Haven Police Department released a bulletin to law enforcement entities
concerning an overdose where a victim was administered Narcan. Seized from the indent were four bags of
confirmed heroin stamped with "kts." North Haven PD stated inthe bulletin thatthe bags may have been
‘cut with fentanyl and or other harmful products.
9. That on 08/07/2020, an interview was conducted with both Becky and Eric at Troop Ain Southbury. Becky

recalled the night before his death, the victim was not feeling wel, and subsequentiy she remained home from
‘Work the next morning to care for him, Becky again stated that she and the vitim retaxed on her bed for most
‘of the morning, and that prior to his death, the victim crawled over to lay on her right arm, however Becky
altered her previous statement to me by tating the victim had his face up and visible. Becky stated that she
would occasionally give the victim generic medieation for teething and restlessness such as calming tabs,
Tylenol, ibuprofen, and Benadryl (uhich is contraindicated in children under the age of 2).
Becky was asked what prescriptions she and Eric were currently taking, and she replied both of them were
prescribed Xanax and Valium, for pain and anxiety due to injuries they had both sustained separately
\When asked about the paraphernalia found in the bedroom, consistent with heroin usage, Becky stated both
‘she and Eric use heroin. When asked how she ingests the heroin, Gecky stated they both snort. Becky stated
she did not use any heroin the merning of the victim's death, however, she stated she did snort it the night
before. Becky was asked if there was @ chance the victim had come into contact with any herain, she replied
that she did not think so, as they were both careful about their use.
10, That on 08/09/2020, the Office of the Chief Medical Examiner, Dr. Gill, contacted Det. Rely to relay that he
‘would be labeling the manner of death as a homicide, the cause being acute intoxication due to the combined
effects of fentanyl and morphine, with recent cocaine exposure
41, That on the 09/10/2020, | spoke with Mark Anderson, the supervisory analyst for toxicology at the Division
‘of Scientific Services, who informed me that the blood obtained from Becky via consent contained over 6
slfferent controlled substances, induding fentanyl, morphine, cocaine, benzodiazepines, and others. Anderson
stated the oficial report withthe complete list would take time to produce.
412, That on 08/21/2020, | examined 75 pages ofthe victim's medical records provided by Children's Medical
‘Associates via Search warrant. | nated in the records, that upon birth, the victim was born with neonatal
abstinence syndrome (which occurs ina newborn who was exposed to opioid drugs fora length of time while in
the mother’s womb), with withdrawal symptoms. Records aso indicated that maternal substance abuse was
affecting the newborn. | also noted that admission history stated mother endorsed Valium use eary in the
pregnancy, however she stated to medical staf she discontinued use. Further examination revealed that Becky
‘again changed her statement to medical staf, by admitting to taking multiple asychiatric medications during
pregnancy.

the party and returned home to Bue Ridge Terrace in Oxford inthe early evening, Becky stated she put the
iti to bed, then drove Eric to East Haven for work. Upon her return home, Becky stated she checked on the
Victim, used heroin (she could not recall where she used), checked on the vitim again, and then went to sleep
asked Becky where she used heroin mostly, and she stated she was very careful, and snorted it off of her phone
inthe bathroom, which she would then lck to clean. She also stated she would sometimes use in the bedroom,
specifically on the nightstand. | then asked Becky on the morning of the victim's death if she had used heroin,
{and she again denied she had, but she dd state she took Valium. Valium is @ benzodlazapine that has sedative
properties. | asked Becky if there was a chance she could have dozed or fallen asleep while the victim was on
‘her bed with her, and she replied she could have. | then asked how ambulatory and mobile the victim was, and
she stated he was able to shimmy off of the bed and use objects, like the nightstand to lower himself and hold
‘on to. | asked if this could have happened, and she replied It was posible. | asked Becky if she used cocaine. At
first she denied it, but then stated the last time she used cocaine was some time ago. | also aked Becky i she
‘was breastfeeding the victim, she stated she was not, and had not been since attempting to after his birth.
14, Detective Flynn and Detective Vayan interviewed Depalma who disclosed the following: Becky had brought
him to East Haven the night before the victim's death, and had last used heroin together that morning when
they woke up around 8 or 8am. He did not know when Becky had used that night, because she had brought him
to East haven, Vayan asked Depala i he used cocaine as well as heroin, and he replied both he and Becky use
cocaine, but rarely, and the last time was the week before the victim's death. Depalma stated he always used
narcotics in the bathroom. He stated he was careful about it, and used on the window sil. He stated he would
then use Clorox wipes to clean up after. Depalma stated Becky used mostly in the bedroom on the nightstand,
‘and would store the heroin In her bra. Depalma stated that Becky would Use her cell hone, and use the “end
table next to the bed,” which Depalma stated he had witnessed on several occasions. Detective Vayan asked
Depalma i Becky was breastfeeding the victim, and he stated she had not breastfed since her doctors had told
her to switch to formula eatly an.
415, That based upon the aforementioned facts and circumstances, | believe probable cause exists and
‘respectfully request that an arrest warrant be issued charging Rebecca Dixon, DOB 05/24/1985 of 7 Blue Ridge
Terrace, Oxford, Connecticut with one count of Manslaughter Inthe second degree in violation of CGS 532-56,
forthe death ofthe victim inthe Town of Oxford on July 6, 2020,
