ORDER

Whereas, resurgence of SARS CoV-2 has been noticed in many pafts of India and
some areas of the State;
And whereas, COVID appropriate behavior and protocols are required to be
observed scrupulously in order to prevent the transmission of the infection;
And whereas, Ministry of Home Affairs, Government of India (GoI) has issued
guidelines vide Order No.40-3/2020-DM-I(A) dated 23'd March ,}OZL for effective control
of COVID-l9 to be effective from April 1't, 202L;
And whereas, the State Government has issued detailed guidelines vide Revenue
and Disaster Management (Disaster Management) Department Order
No.1663/R&DM(DM) dated, 31.03.2021 for containment of spread of COVID-19;
And whereas, it is observed that the number of COVID-19 positive cases are in
increasing trend in some districts;
Now therefore, for the interest of general public and to prevent transmission of
infection, in exercise of the powers conferred under Section 24(l) of the Disaster
Management Act, 2005 read with Rule B(1) of the Odisha Disaster Management Rules,
2010, the undersigned hereby directs that Night Curfew in the districts of Sundargarh,
Jharsuguda, Sambalpur, Bargarh, Bolangir, Nuapada, Kalahandi, Nawrangpur, Koraput
and Malkangiri shall be in force from 5.O4.2O21 till fufther orders with the following
guidelines;
All shops, commercial establishments, offices, institutions and movement of
individuals shall remain closed/ prohibited between 10.00 pm to 5.OO am, except for
essential activities. District Collectors/ Municipal Commissioners shall issue orders for
their respective jurisdictions, under appropriate provisions of law, such as under Section
t44 of CrPC, and ensure strict compliance. District Collector may impose any fufther
restrictions or allow such activities as felt appropriate considering the loc-al situation.This
restriction shall not apply to:
. District and Municipal Administration/ Police/ Government Officials on duty
. Doctors, Medical/ Paramedical Staff (Govt. & Private), ambulances and emergency
health staff
. Emergency workers of utilities such as Electricity, Fire Services, Telecom, Water
, Railways and Airpoft, Tra services
. Staff of IT & ITeS Companies on production of their ID cards
. Any person, in case of medical or other emergency
. Ownerl staff of Chemist shops
. All industrial units
. All construction activities
. Movement of Public Transport, private vehicles and taxis (including cabs by
aggregators like Ola, Uber, etc.) to and from airports, railway station and bus
terminals/ stands/ stops, for facilitating movement of passengers by air, rail and
road.
. Operation of hotels and hospitality units, including their associated offices,
movement of staff and associated personnel
. Dhabas along National and State Highways/ Major roads for takeaway only
. Petrol pumps and CNG Stations
. Print and Electronic Media identifled by Commissionerate/ District Police (with
identity cards of respective media houses)
. LPG distribution, home delivery of cooking gas and associated facilities, personnel
and vehicular movement
. Home Delivery of food, groceries, vegetables, egg, fish, meat and other essential
items by restaurants and aggregators such as Zomato, Swiggy, OPOLFED, OMFED,
Chilika Fresh etc.

No pass would be required for movement of above category of persons. Valid


Travel documents/ authorisations such as airline/ railway/ bus tickets/ boarding passes,
with any identity proof shall be adequate for the purpose. Identity cards issued by
appropriate authorities of the establishments shall serve as pass for effecting movement
of employees of establishments under permitted activities. Patients and their attendants/
persons requiring emergency need for movement shall be allowed to move with minimal
proof of their emergencies. Officers/ staff on duty shall be sensitized to appreciate the
situation of persons on the road and take suitable action to facilitate movement on
emergency needs.

Any person violating these measures will be liable to be proceeded against in


accordance with the provisions of Section 51 to 60 of the Disaster Management Act, 2005,
the Epidemic Diseases Act, 1897 and Regulations issued thereunder besides legal action
under Section 1BB of the IPC and other legal provisions as applicable.
