Position Paper: Legalizing Abortion in The Philippines

This document discusses the issue of legalizing abortion in the Philippines. It provides background on the current laws prohibiting abortion and arguments on both sides of the issue. Three claims in favor of legalizing abortion are presented: 1) It could improve women's health by allowing safe procedures, 2) It upholds women's right to choose, and 3) It addresses situations of rape, young pregnancy, or inability to care for a child. However, the response argues that abortion is morally wrong as it constitutes murder and denies the unborn child's right to life. The document concludes that abortion should remain illegal in all circumstances in the Philippines.

Position Paper:

Legalizing Abortion in The

Philippines
[Link]

A. Today abortion is a big issue concerning women because for years it had been said that
abortion should not be legal. Many people feel aborting an unwanted child or killing an
unwanted child should be against the law. Many people don’t know what abortion is, who
can receive abortions, and why people would even choose.
B. In article 11 of the 1987 Philippines constitution says, in part “Section 12. The state
recognizes the Sanity of the family life and shall protect and strengthen the family as a basic
autonomous social institution. It shall equally protect the life of the mother and the life of
the unborn from conception.
Nowadays, the world seems to get even more and more liberal. Everyone is fighting for
their rights without even trying to see a wider view of it, or how will it affect their lives
aftermath.
C. Our popularity today is extremely high and it continues to rise. Many unwanted or
unplanned pregnancy has been solved by abortion. Abortion by definition means removing
the fetus or embryo from the woman’s womb before it can live outside the uterus. The issue
has been controversial over the world for many years. Many people against it while people
are saying it is the right of the woman to choose whether to keep the baby or eradicate
them. We believe that abortion is the murder of innocent lives, therefore, means that it is
against the law.

COUNTERCLAIM:
Abortion is the worst thing a woman can do against human dignity. It is a crime against
life. No woman has the right to kill a new living being. Many countries ban abortion and
many institutions fight against it. Abortion is immoral and it should not be legalized.
According to Aileen Grace Delima January 18, 2008, BIO 199 Abortion in the Philippines:
reasons and Responsibilities Abortion is a controversial issue but it should be discussed
because it is happening, and is more widespread than we care to admit. If we truly care
about life, then we must understand what is going on (Tan 2008). Ideally, pregnancy is a
wanted and happy event for women, their partners, and their families. Unfortunately, this is
not always so.
“If we took a moment of silence for each person lost to abortion, we would be silent for
over one-hundred years”-Frank Pavone. So many people have been murdered before they
get a chance to live and I think that it's well past time for the numbers to stop going up.
In contrast to the liberalizing trend in contraceptive policy, in the Philippines abortion law
is among the strictest in the world. Abortion remains illegal in the Philippines under all
circumstances and is highly stigmatized.

ARGUMENT
Assertion of Claim NO.1

If ever Abortion will be legalized, it could provide safety because women can receive the proper
health care required to make sure they are safe and don’t sustain any life-threatening from
unprofessional.

Response

If we can see the side effect of this I disagree with all of these points. It might be a mother's
individual right to decide if she wants an abortion but what about the individual of the rights of the
unborn child? People can’t use their right to take away the rights of others. When people say that
it's not a person that they're killing, just a clump of cells, they are being extremely naive. It might not
be a formed human yet, but it will be. From the moment that the baby is conceived, it is a prison.

Assertion of Claim NO.2

If abortion will be legalized our natural right will be ignored which is the right to live and promote
and protect life, However, choosing abortion is the right thing to do for those who are a force in
childbirth.

Response:

Yet why do some women or even young ladies abort such a beautiful thing? Lust is a word that can
be interconnected with this matter. Some say, the baby is “just a mistake” but the baby is not the
mistake, rather, they are the ones. If they hadn’t gone overboard and do things that they are still not
ready yet, then why go with the flow with it?

Anywhere you go there will rile against murder. It is a general belief that murder is wrong and
cruel. Yet some people say abortion should be legal. To kill a person before they have a chance to
live or before they get a chance to see all the amazing things in life.

Assertion of Claim NO.3

Abortion should be legal in the Philippines especially for those victims of rape, incest, sex outside
of marriage, and other causes of unwanted pregnancies. Those women who aren’t prepared to
become a mother or their partner let them and them nothing else to supply the baby's needs.

Response:

Especially, now that there’s a Pandemic all over the world couples at a young age sleep with their
partner in the same bed and it caused pregnancy and they can’t take or expect the baby that’s why
they do abortion.

As Josephine Imbong a CBCP Legal Council said, Abortion should not be allowed under any
circumference, including rape or incest. There are also no explicit exceptions to allow ab abortion in
cases of rape, incest, or fetal impairment. The Penal Code considers abortion to be a criminal offense
punishable by up to six years in prison for doctors and midwives who perform abortions and by 2-6
years in prison for the woman who undergoes the procedure, regardless of the reason. A separate
set of laws under the Midwifery Act and Pharmaceutical Act permit the revocation or suspension of
the license of any practitioner who performs abortions or provides abortifacients.

If a baby is a person then why would somebody get charged with double murder for killing a
pregnant woman? It’s because people know that an unborn child is a person. Having a child Isn’t a
“complication” that child can change your life in a good way. Maybe it’s not the life you had
imagined for yourself but it shows more content.

Therefore, I believe that abortion is murder. There are no special cases if you get pregnant
you are meant to have a child. Even in cases where the mother is claimed terminal if she
goes through with the birth. People can live when they are claimed terminal, it might be a
low chance that you survive but wouldn’t you rather take the chance for the sake of your
unborn child? Abortion should be illegal whether that woman was raped, got pregnant too
young, or just doesn’t want to have a child because you don’t think you’re ready. You can
always put the baby up for an adaption so they can go live with a family that will care for
them. When you abort your unborn child you are killing a person that is half of you. Do you
want to kill a part of you? Help stop these murders, it well past time for these innocent lives
to be saved from the cruelty.
Do women have the right to steal the life of a new living being? Killing a person is illegal, so
why should fetal murder be legal? You have to ask yourself these questions and realize that
when a woman aborts, she is acting like any other murderer. I discovered that begins at the
moment of conception in the mother’s uterus, therefore abortion end human life and
should be punishable by law. As well, nine short months of pregnancy is a small cost for life
without physical and health problems think about it.
