State of Indiana, County of Marion, SS: Probable Cause Affidavit

Vauhxx Booker was arrested for battery on a public safety officer. According to the probable cause affidavit from Officer Emanuel Toliver, Mr. Booker had been yelling about racist comments made towards him at a downtown bar. When police arrived, Mr. Booker became upset that no one was being arrested. Later, as Lieutenant Alan Hopkins was returning Mr. Booker's ID, Mr. Booker walked into the street yelling and did not return to the sidewalk as instructed. Instead, Mr. Booker shoved Lieutenant Hopkins in the chest with his upper body. Lieutenant Hopkins was able to shove Mr. Booker back and place him in handcuffs, arresting him for battery on a public safety officer.

PROBABLE CAUSE AFFIDAVIT

Sunday September 5th 2021 at 634am Indianapolis metropolitan police officers received a radio to 822 N.
Illinois reference a disturbance involving a female refusing to leaving the property of Downtown Ollie bar,
female left with friends and family. Officers received second run to Downtown Ollie bar 822 N. Illinois St.
Officers was advised that the female was still on the property. Upon arrival I was met by the bar manager she
stated they didn't called the police this time. I was approached by a black male yelling about the staff members
at Ollie's bar being intoxicated, rude yelling and screaming racist comments to him. I advised him that he
should contact the owner of the business ( Ollies) and express his experience inside of the business. I also
advised the staff at Ollie's to have him to leave the business if both parties could come to a agreement. The
b/m subject became upset with me for not locking anyone up and demand to speak to my supervisor. He stated
he was going to record me with his cell phone reference this incident. While trying to explain to subject that I
couldn't lock anyone up reference this incident he became very agitated and angry with me ( Officer Toliver) .
He started yelling at officer Chip Youmans about killing blacks in Indianapolis. While waiting on my
supervisor to arrive on the scene. The owner of Downtown Ollie arrived on the scene and attempted to have a
conversation with the subject identified as Vauhxx Booker. Officer Toliver supervisor arrived on the scene
Lieutenant Alan Hopkins reference the the request of his supervisor from the compilation. Lt. Alan Hopkins
talked the compilation for several minutes and told Officers Toliver to document the incident with the bar and
compilation by doing a police report. Lieutenant Hopkins asked for the identification of the compilation and
was given this information by handing over his license to Lieutenant Hopkins. Lieutenant Hopkins left the
compilation on the sidewalk. walked to my marked IMPD vehicle giving the compilation driver license to me
for my report. While standing next to the driver side of my police car door waiting on a police case number to
give to the compilation. The compilation ( Vauhxx Booker ) walked into the street yelling at Lieutenant
Hopkins about his driver license. He was asked several time to return back to the sidewalk by Lieutenant
Hopkins instead of following Lieutenant Hopkins directions of returning back to the sidewalk. The
compilation identified as Vauhxx Rushing Booker attempt walked threw Lieutenant Hopkins by shoving him
back with his upper body on the chest Lieutenant Hopkins who was dressed in full uniform. Lieutenant
Hopkins was able to regain his balance and shoved Vauhxx Booker back from him and placed handcuff on
him. Vauhxx Booker was arrested for battery on a public safety officer. He was transported to lock up by
Marion county wagon.
All three officer's BWC were on.
