APPLICATION FOR PROBATION

ACCUSED ROXAN BOOC GODINEZ, through the


undersigned counsel, unto this Honorable Court hereby applies for
probation under the provisions of Republic Act No. 10707, as
amended and declares:

1. That he is 39 years of age and a resident of Brgy. Pusok, Lapu-


Lapu City;

2. That on June 3, 2021, he pleaded to a lesser offense of Sections 5


and 11, Article II of R.A. 9165. In effect, he has been convicted for
violation of Section 12, Article II of R.A. 9165 and sentenced to
serve the term of imprisonment of not more than six (6) years after
entering a plea of guilty of a lower offense of his original charge;

3. That he has not begun to serve term of imprisonment imposed


upon him;

4. That the crime for which he was convicted is not an offense


against security of the state or any crime against the national
security or public order;

5. That he has not been previously convicted by final judgment of


any offense punished by imprisonment of more than six (6)
months and one (1) day and/or fine of mor than One Thousand
Pesos (P1,000.00); and

6. That he has not been on Probation under the provision of RA


10707, as amended.

PRAYER

WHEREFORE, it is respectfully prayed of this Honorable Court


to note the foregoing APPLICATION FOR PROBATION of
ACCUSED ROXAN BOOC GODINEZ. All other reliefs just and
equitable under the foregoing premises are also prayed for.
