TERMS AND CONDITIONS

By clicking ‘I Accept’ below, you are consenting to avail Services (as defined
hereafter) from HomeLane upon the terms and conditions set out below.

1. SCOPE OF SERVICES
1. The scope of the services (“Services”) provided by HomeLane are as follows:
1. Designing of home Interiors
2. Provision and supply of customized home furniture; and
3. Installation of the customised home furniture at your site - apartment, villa,
house etc.
2. EXECUTION TIMELINES
1. HomeLane shall deliver and install the customized home furniture within 45
(forty five) days from the date of completion of all the following requirements (
“45-day Guarantee”):
1. Both you and HomeLane signing off on the design and specifications for
the Services;
2. Payment of the Price (as defined hereafter) in accordance with the the
timelines set out below; and
3. Your preparation of the site in accordance with the ‘site readiness
checklist’ provided to you by HomeLane. The Site Readiness Checklist is
as per Annexure 1.
2. The 45-day Guarantee will be applicable only if all of the conditions above at
2.1.1, 2.1.2 and 2.1.3 are met in full and all aspects. Further, the 45-day
Guarantee will not be applicable if:
1. the scope of work includes false ceiling , painting , wooden flooring , civil
work, tile laying , demolition, plumbing etc.;
2. the following items are in your scope or the builder’s scope:
> granite supply or installation;
> hob and /or chimney supply or installation; or
> electrical point shifting;
3. If the site has restrictions on work timings in afternoon;
4. If you are not in full possession of the site and temporary possession has
been allowed by the builder;
5. If there is concurrent work being done at the site by any other 3rd party
contractor like Painting, WallPaper, Wooden Flooring or Carpentry Work
during installation, and work being executed by the builder such as civil
works, core-cutting, painting etc.;
6. The 45 days term shall not be applicable if there are any changes to
designs after the order is under production.
7. If you are living at the site at the time of installation;
8. Abnormal hindrances in execution like Continuous Lack of Power, Non-
Working Lifts, No Permission from Builder, etc
9. A force majeure event occurs.
10. OEM replacements due to functional defects found at the time of handover
are outside the 45 days guarantee. The replacements will be done free of
cost based on OEM timeline and HomeLane will facilitate the
replacements. Eg - Hardware, appliances like hob and chimney,
accessories,colour mismatch or scratches in handles etc.
11. Deep scratches found on shutters after peeling off of protective liners will
be replaced by HomeLane if they are not removable using polishing
agents, but they are outside of 45 day handover guarantee.
12. Shade variation for the same colour of shutter finish will be replaced based
on OEM (like Merino, Associate, ActionTesa etc.) timeline, free of cost, but
the same will be outside of 45 day handover guarantee. HomeLane will
facilitate the replacements through OEMs.
13. If the woodwork component of quote is equal or greater than 15L, the 45
day guarantee will not apply due to the volume of work involved.
3. If the 45-day Guarantee is applicable and HomeLane is in material breach of
the same, Homelane will pay you compensation at the rate of Rs. 1,000
(Rupees one thousand) for each day of delay, subject to a maximum of the
value of the Price.
4. All products and components mentioned in clause 2.2.1, clause 2.2.2, and
clause 2.2.3 are designed, supplied, and installed by HomeLane in a manner
where the materials are fixed to the walls and superstructure. Such fitments
once installed, cannot be removed without causing significant breakage or
damage to the materials.
3. PAYMENT FOR SERVICES RENDERED
1. The total price payable by you for the Services (“Price”) shall be as per the
quotation sent to you by HomeLane and accepted by you.
2. The Price shall be payable in installments, upon reaching the following
milestones:
1. 10% (ten percent) of the Price shall be payable when you book the work
order;
2. 40% (forty percent) of the Price shall be payable within 2 Working Days
from the time of design finalization and prior to the commencement of
manufacturing by HomeLane; and
3. 50% (fifty percent) of the Price shall be payable within 2 Working Days from
HomeLane’s ready-to-dispatch intimation to you. Such intimation will be
sent by HomeLane after completion of manufacturing and before dispatch
of materials, which is typically 15 (fifteen) days from the commencement of
manufacturing. Delay in payment beyond 48 (forty eight) hours from
HomeLane’s ready-to-dispatch intimation can lead to delay in dispatch of
materials and consequently affect installation and execution timelines.
4. In case you delay payment beyond 2 Working Days from HomeLane’s
ready-to-dispatch intimation, an additional period of a minimum of 7
(seven) working days will be added to the execution timelines. Further, in
case you delay of payment by 15 (fifteen) days or more, you will be liable to
pay applicable demmurage charges at the rate of Rupees 500/ - (Five
Hundred) for each day of delay.
3. The Price is inclusive of all applicable duties and taxes.
4. Except for payments below Rs. 10,000 (Rupees ten thousand) which can be
made in cash, all payments shall be made via cheque/demand draft/bank
transfer (NEFT/RTGS) only.
4. WARRANTY AND DISCLAIMER OF WARRANTY
1. Scope of Warranty:
1. In the event of there being any manufacturing defect in any of the products
(“Products”) enumerated below, within the specified warranty periods
following the date of delivery/installation, HomeLane shall, at its discretion,
repair or replace such Product(s) at its cost. This certificate of warranty
covers the following Products :
1. Cabinets made of laminated 16mm BWP, 17mm Prelam BWR, 17mm
Prelam Commercial plywood – 5 (five) years;
2. Cabinets made of laminated 18mm MDF  – 5 (five) years;
3. Cabinets made of pre-laminated 18mm particle board – 5 (five) years;
and
4. Shutters of all finishes and all materials – 5 (five) years.
5. Accessories, Hardware and Appliances as per the Manufacturer’s
Warranty
2. Warranty Terms:
1. HomeLane warrants to you that all Products will be free from any
manufacturing defect and defect in installation workmanship.
2. The warranty only applies if the Products are properly maintained, and
used for normal domestic use.
3. The warranty will not be applicable in case of resale of the Products or
transfer/sale of the apartment to another party.
4. The warranty period for (i) hardware; (ii) accessories and (iii) appliances that
are used in all our Products will be the same as that offered by the original
equipment manufacturer.
5. If a defect is observed within the respective warranty period(as per
Annexure 2 A & B), you must notify HomeLane in writing within a period of
7 (seven) days therefrom and, upon confirmation of the defect by an
authorized HomeLane representative, HomeLane’s sole responsibility shall
be, at its option to either:
1. arrange for repair of defective Product; or
2. arrange a replacement of defective Product.
6. If HomeLane chooses to replace a Product proved to be defective,
HomeLane shall, depending on availability, provide a replacement that is as
close as possible in dimension, function and colour to the defective
Product. HomeLane will not guarantee that the replacement will be exactly
the same in all aspects when compared to the Product being replaced.
7. This warranty is null and void if any person other than HomeLane’s
authorized representative installs, repairs or alters the Products without the
prior consent of HomeLane.
3. Warranty Disclaimer:
1. The warranty certificate sets forth HomeLane’s sole warranty obligation
with respect to the Products and is in lieu of all other warranties oral or
written, express or implied. HomeLane makes no warranty of
merchantability or fitness for a particular purpose with respect to the
Products and HomeLane shall not be liable for incidental, special,
consequential or other similar damages arising out of any breach of the
warranty.
2. HomeLane does not warrant against and is not responsible for: (i) any
condition of the Product attributable to; or (ii) any damage to Products
caused by any of the following:
1. Wear and tear suffered through normal use (including scratches, dents
and cuts) or damage caused by impacts or accidents;
2. Rusting of channels, hinges and other metallic parts. These could be
damaged due to household chemicals and sprays and hence care to be
taken while using such products around hardware and accessories.
3. Water leakage and seepage within the building structure and continuous
dampness of the surface beyond:
a.      72 (seventy two) hours for BWP grade plywood (IS710);
b.      (forty eight) hours for BWR grade plywood (IS303); and
c.      twenty four) hours for exterior grade PB and MDF materials.
4. Degradation, discolouration, damage, fading etc.   in colour, grain, or
texture of natural wood materials, laminates and other covering
materials due to exposure to intensive or excessive light, sunlight,
moisture or heat or other environmental factors;
5. Use of inappropriate chemicals, detergents, abrasives or other
inappropriate cleaning agents that can damage the wooden surface of
the Products or rust accessories;
6. Mistreatment, negligent use, misuse, insufficient or improper care
(including but not limited to exposure to harsh weather conditions);
7. Alterations, modifications or use of Products which is beyond or
inconsistent with supplied Product instructions and / or not been
authorized by HomeLane;
8. Damage or stains due to water leakage and/or seepage; or
9. Damage caused by any force majeure event (such as flooding,
hurricane, earthquake, lightning, etc.), environmental condition (such as
air pollution, solvent exposure, mold, mildew etc.), or staining from
foreign substances (such as dirt, grease, oils, sprays etc).
4. HomeLane’s liability will reduce over the warranty period according to the
following scale:
1. In the first 12 (twelve) months after the date of delivery/installation– 100%
(hundred percent) of replacement cost; and
2. From month 13 (thirteen) to month 60 (sixty) after the date of
delivery/installation – 80% (eighty percent) of replacement cost.
5. The products installed by Homelane should not be removed, as removal of
goods will cause damage to the installed products. Failure to adhere to this
condition shall void the warranty provided by Homelane and Homelane shall
not be responsible for any such damage.
6. Homelane specifically disclaims all warranties and indemnities, express,
implied or statutory, including without limitation, any warranty of
merchantability, fitness for a particular purpose, or any warranty arising from
the course of performance or course of dealing.
5. SERVICE AND MAINTENANCE CALLS
1. Homelane will provide one free service visit to the site to address routine
services which cover moving parts like hinges, channels etc. This service will
address issues like minor alignment, loose parts etc.
2. This free service is applicable and should be availed of during the first 6 (six)
months after the date of delivery/installation. Please call HomeLane care to
schedule a visit. Any service and maintenance calls thereafter will be done on
a chargeable basis (HomeLane’s current assessment / inspection fees is a
sum of Rs. 1500 (Rupees One thousand five hundred) per visit).
3. HomeLane’s assessment/inspection fees does not include the cost of
materials or labour used for addressing such service and maintenance calls.
6. LIMITATION OF LIABILITY
1. IN NO EVENT WILL HOMELANE OR ITS AFFILIATES, VENDORS OR
SUBCONTRACTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL LOSSES, HOWSOEVER ARISING,
WHETHER UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH
OF STATUTORY DUTY OR OTHERWISE, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH LOSSES.
2. HOMELANE’S MAXIMUM LIABILITY IN RESPECT OF THE PRODUCTS /
SERVICES SHALL BE LIMITED TO AND SHALL NOT EXCEED THE PRICE
ACTUALLY PAID BY YOU TO HOMELANE FOR THE RELEVANT PRODUCTS
/ SERVICES WHICH GAVE RISE TO THE CLAIM.
7. FORCE MAJEURE
1. HomeLane shall not be liable for any failure or delay in performing its
obligations hereunder due to force majeure conditions affecting HomeLane,
including but not limited to, break down or damage of HomeLane’s
machinery, shortage or non-availability of raw material components or
consumables, strikes, lock-outs, war, riot, civil commotion, acts of God, or
other causes beyond HomeLane’s reasonable control, provided that it notifies
you of such conditions as soon as reasonably practicable and uses its best
efforts to resume performance. Should such conditions subsist for a
continuous period of 15 (fifteen) days, HomeLane may set up a discussion
with you to discuss measures to mitigate the consequences of such
conditions and agree upon alternative modes of effectuating the terms set
forth herein.
2. In the event of there being no suitable alternative mode of effectuating the
terms hereof, this engagement may be terminated upon mutually acceptable
terms.
8. CANCELLATION POLICY
1. Neither of us may terminate this engagement. However, HomeLane may delay
or cease to provide the Services in case the Price payable remains unpaid or
is delayed; in which case, HomeLane shall have no obligation to refund the
amounts already paid by you.
2. After agreeing to these Terms and Conditions, in case you seek to not avail of
the Services, you will forfeit all the amounts already paid by you to HomeLane
and also be liable to pay the balance of the Price agreed to be paid to
HomeLane, as due compensation for the losses that will be suffered by
HomeLane in such an eventuality and not as penalty.
3. If there is a change in a HomeLane Policy that you don't agree with, you have
the option of getting a full refund of your 10% advance.If you would like to
cancel for any other reason, you can do so before site measurement is done
or within 48 hours of booking your order, whichever is earlier. We will refund
your complete advance amount.
9. GOVERNING LAW AND JURISDICTION
1. The terms and conditions contained herein regarding the provision of
Services, shall be governed and interpreted in accordance with the laws of
India, and any dispute arising therefrom shall be submitted to the exclusive
jurisdiction of the courts at Bangalore, India.

Annexure 1: Site Readiness Checklist Ver 10_ 2016

✔Has your apartment been completed in all major aspects from the builder and
handed over to you? If Not, Please ensure that your apartment/home is ready
for us to commence our work.
✔ Please confirm that there is NO civil work pending from the Builders Side.
Civil Work can include Tile Laying, Painting, Plastering, Core Cutting etc.
Homelane Crew will not work at the site if Civil work is being carried out.
✔ Has Core Cutting for Chimney Duct been completed ? If it is not, Please
ensure that the Core Cutting is done before Material is dispatched as there is a
chance of Dust being Generated.
✔ Please ensure that one coat of paint is done. The final Coat of paint should
be done after Interiors has been completed.
✔ If the builder requires a Secuirty Deposit, Please ensure that this paid to the
Builder Maintenance Team.
✔ If you are having False Ceiling / Painting / Plumbing done by another vendor
or Builder, Please ensure that this is completed and only then HomeLane Crew
will arrive at site. It is not possible for HomeLane Team to work in a site where
the above works are concurrently being done.
✔ One Set of Keys to the apartment have to be handed over to Homelane
Representative prior to execution. We need access between 8.30 AM to 7.00
PM Mon to Saturday. If we do not get clear 8 - 9 hours , We will not be able to
complete the project within the Guranteed Time.
✔ If the set of keys are with the builder representative, Please ensure that you
have communicated about your Interiors Contract with Homelane and to hand
over a set of Keys or provided clear access to the Homelane Team.
✔ If a Permission Letter / Email is required from you to Homelane and the
Builder authorising HomeLane Team to be allowed accessed, Please enusre
that this is completed.
✔ Please ensure that the apartment has secure access and that there are no
valuables/ appliances etc in any of the rooms. We will not be responible for any
damages / loose missing items from the site.
✔ Clean Power should be available in all the rooms. If Permanent Power is not
available, Please request the Building Engineer to provide Temporary Power to
each of the Rooms.
✔ Please ensure that we have permission to move our materials through the
Service or Passenger Lifts. If there is no lift available, there could be delay in
moving materials and any movement of materials by stairs above 2nd floor will
attract an additional charge.

Annexure 2 (B)
Things you should know about
Shutter Bends
Bend is a natural process which occurs due to weather conditions, moisture levels
in the atmosphere and usage. As an industry practice, HomeLane permits a
tolerance of 3mm for shutter bend. Any bend that is more than 3mm will be
corrected by either adjustment of hinges, using magnetic catchers, dismantling of
shutters and/or fixing of straighteners at the back of the shutter (at customer
location or taking it back to factory).

The following types of bends can be observed on the shutters:

Type 1- Bend in the Center

Type 2 - Bend at Top End


Type 3 - Bend at Both Ends

Type 4 - Bend at Bottom End

Correction will be done as per following scenarios:

a) If the Bend <=3mm, no action needed there will not be any functional
issue in the product
b) If the Bend >3mm, then following steps will be taken to correct the
same
Step 1: Adjust hinges to see if bend can be brought to within the
tolerance limit of 3mm.If deemed necessary, fix magnetic catchers to
tighten the ends.
Step 2: If STEP 1 doesn’t bring the bend within 3mm, then remove
shutter and bring it to the factory to correct the bend.
Step 3: If necessary, apply 2 straighteners at the backside of the shutter
(only for PB, PLPB, MDF boards. Straighteners cannot be applied on
Block Boards).
