OF ETHEL ANNE DE VEYRA DAUZ
Question: Please state your name, age, civil status, address and other personal
circumstances.
Answer: I am ETHEL ANNE DE VEYRA DAUZ, Filipino, of legal age, married,
with residence and postal address at of 24 Champaca St. Mapayapa
Village 2, Brgy. Holy Spirit, Quezon City.
Purpose: To prove the truth and veracity of the allegations stated in the
petition and to identify the documentary exhibits attached hereto.
PRELIMINARY STATEMENT
The person interrogating me is lawyer Elijah B. Bactol. The interrogation is
being held at #23 Bonifacio Street, Poblacion Central, General Tinio, Nueva Ecija. I
am informed and well-aware that I am submitting to his investigation under oath

and that I will be courting perjury if I told lies and falsehoods in these
proceedings.
Q1. Are you the same ETHEL ANNE DE VEYRA DAUZ who is named as the
petitioner in the above-entitled petition?
A1. Yes, sir. I am that person.
Q2. Do you have any proof of identity which will show that you really are ETHEL
ANNE DE VEYRA DAUZ?
A2. Yes, sir. I have here a copy of my Philippine Passport.
Petitioner hands over to Atty. Bactol a copy of her passport.
Q3. I will mark this passport with passport no. P6509207B as Exhibit “A”, will
you confirm this?
A3. Yes, sir.
Q4. Are you the registered owner of TCT No. NT—292601?
A4. No sir. The land subject of this petition is registered under the name of my
late mother, ELSIE B. DE VEYRA married to ERNESTO DE VEYRA as
evidenced by this Certified True Copy of TCT No. NT-292601;

Q5. I will mark this CTC of TCT No. NT-292601 as Exhibit “B”, will you confirm
this?
A5. Yes, sir.
Q6. Can you prove your filiation with the registered owners?
A6. Yes, sir. I have here the copy of my Certificate of Live Birth.
Petitioner hands over to Atty. Bactol a copy of her Certificate of Live Birth.
Q7. I will mark this Certificate of Live Birth as Exhibit “C”, will you confirm this?
A7. Yes, sir.
Q8. Do you have any proof that your mother passed away?
A8. Yes, sir. I have here the copy of her death certificate which indicates that
she passed away last 1 May 2022;

Q9. I will mark this document as Exhibit “D” will you confirm?
A9. Yes, sir.
Q10. Do you know the parcel of land covered by TCT No. NT-292601?
A10. Yes, sir. It is the parcel of land situated at San Leonardo, Nueva Ecija.
Q11. Who was in possession of the TCT No. NT-292601?
A11. The said title was in the possession of my late mother, and she kept it in her
wooden chest together with all the other titles to our property. My mother
is the custodian of my parents’ documents since my father’s physical and
mental health already dwindled decades ago;
Q12. Is the TCT in your possession?
A12. Unfortunately sir, the said TCT is currently missing, and we only found out
about its loss after my mother’s passing.
Q13. Do you know the circumstances attending the loss of TCT No. NT-292601?
A13. Yes sir. Years back, my mother told me that she already felt weak, and that
she knew that her time is about to come. She told me to look after our
assets and showed me the Titles to our property.
Q14. What happened next if any?
A14. I jestingly told her that she’s still strong and that she’ll outlive those
characters in the Bible.
Q15. What happened next?
A15. When my mother passed away last 1 May 2022, we decided to settle her
estate, and we looked for the titles to our property;
Q16. What did you do next if any?
A16. We checked her wooden chest, and there we saw majority of the
important documents of our family together with the title of our old house,
but when we were looking for the Title to our San Leonardo Property, we
found out that it was not on the same chest;
Q17: What happened next, if any?
A17: We looked for other places where my mom usually kept her things, but all
was for naught. We also inquired from our relatives if they have noticed the
missing title, but all of them said that they have not seen it. After rigorous
search, we became convinced that the title subject of this petition is
already beyond recovery;
Q18. What did you do after that?

A18. I executed an affidavit of loss concerning TCT No. NT-292601. Thereafter, I
caused the affidavit to be annotated on the memorandum of Encumbrance
and it was annotated as Entry No. 2022005009.
Q19. Do you have a copy of the said affidavit of loss?
A19. Yes, sir. It’s here with me.
Q20. I am requesting the Honorable Court to mark this affidavit of loss as Exhibit
“E”, will you confirm??
A20. Yes, sir.
Q21. Do you have proof that the annotation of the affidavit of loss was executed
in relation to the missing TCT?
A21. Yes, sir. Said annotation can be found as Entry No. 2022005009 on page 5
of the certified true copy of TCT No. NT-292601.
Q22. The annotation you mentioned will be marked at the trial as Exhibit “B-1”,
will you confirm it?
A22. Yes, sir.
Q23. Who pays the real estate taxes on this property?
A23. We paid it, sir.
Q24. Do you have proofs of this?
A24. Yes, sir. Here are the Tax Clearance for the Tax Declaration of Real
Property No. 17-22009 pertaining to the subject property, and the Official
Receipt No. 1752730 dated 6 June 2022 issued by the Office of the
Treasurer of San Leonardo, Nueva Ecija.
Q25. The copy of Tax Declaration of Real Property No. 17-22009 will be marked
as Exhibit “F”, while the Official Receipt will be marked as Exhibit “F-1. This
Tax clearance will be marked during the trial as Exhibit “G”, will you
confirm these?
A25. Yes, sir.
Q26. So Mrs. Dauz, what do you request of this Honorable Court?
A26. I most respectfully request of this Honorable Court to order the issuance of
a second owner’s duplicate copy of TCT No. NT-292601 which bears the
name of my parents.
Q27. I have no more questions to ask. Do you have any other thing to say?
A27. None for the moment sir.
