ln exercise ofthe powers conferred under Provision to Article 309 of the Constitution of
lndia, Bihar Governer is pleased to make the following Rules to regulate the recruitment and
promotion of lnstructor cadre (Non-Gazetted posts) in different lndustrial Training lnstitutes of the
State under the Directorate of Employment and Training (Training wing) of the Department of Labour
Resources:-

Part - 1
1. Short title, Extent and commencement:-
(1) These Rules may be called the "Bihar lndustrial Training lnstructor Cadre Rules, 2018".
(z) lt will be expanded all over Bihar.
(3) lt shall come into force immediately.

2. Definitions:-
In this Rule unless there is anything repugnant to the subject or the context -
(i) "Cadre" means the Bihar lndustrialTraining Instructor Cadre;
(ii) "Category" means category specified in Rule-3;
(iii) "Person appointed by direct recruitment" means a person recruited to the post of
instructor on the basis of recommendations of the Bihar Staff Selection Commission by
the com petent authority;
(iv) "lndustrial Training Institute" means Government lndustriat Training lnstitute of the
State of Bihar;
(v) "Appointing Authority" means Director, Employment and Training (Training), Bihar.

(vi) "Probationer "means a person appointed in instructor cadre on probation;
(vii) "Seniority list" means the seniority list of employees of instructor cadre which shall br:
maintained by the Directorate, Employment and Training (Training Wing) Bihar, Parna;
(viii)"Craft lnstructor Training Scheme (C.l.T.S.)"means Preparatlon of trained instructors for
Industrial Training Institutes through training scheme of National Councilof Vocational
Training (NCVT);
(ix) "Craft Training Certificate for any Trade" means Certificate provided by NCVT on
successful completion of one year training under Craft lnstructor Training Scherne
(C.l.T.S.) Or combined certificate provided by NCVI for successful completion of
specified modules under Modular Pattern;
(x) "National Council for Vocational Training (N.C.V.T.)" means Council established by
Directorate General of Training (DGT), Ministry of Skill Developmenr &
Entrepreneurship, Govt. of lndia to regulate vocational training all over lndia;

(xi) "National Trade Certificate

(1) Bihar lndustrial Training lnstructor cadre
will be of state level & its members will lro rh

time shall be applicable from the date of notification issued by the state Government for this
purpose.

(B) Kalawadhi (Time Period):- The minimum time for the promotion for different categories of
cadre will be the same as determined by State Government (General Administrative
Department) from time to time.

5. Determination of vacancies: - The State Government will determine vacancies for direct
appointment and promotion separately on 1't April every year. Requisition of vacancies will be
communicated to the commission by 30th April.

6. Advertisement: - The commission will periodically advertise commensurable to prevailing


procedure in order to recommend filling up the vacancies upon receipt of vacancies for direct
employment.

7. ABe Limit:- For direct appointment, the age of the candidate should not be less than 21 years as
on 1't August of the requisition year and the maximum age shall be the same as prescribed by
the General Administrative Department of the Government from time to time'

Reservation: - Bihar Reservation of vacancies in Posts and Services (for Scheduled Castes,
Scheduled Tribes and Other Backward Classes) Act, 1991 and rules as well as rosters made under
it by the State Government shall be applicable in appointment & promotion.
9. process of Employment: - (A) As per the provision issued for qualification of instructors for NCVT
affiliated lTls by DGT, Govt. of lndia for every two (1+1) unit, one lnstructor must have
Degree/Diploma in concerned branch of EngineerinS. For compliance of above mentioned
directions regarding direct appointment on the post of instructor, requisition of vacancies will be
sent to the Commission in two parts. Out of these two units, one post will be for the.qualified
candidates of Degree/Diploma and another post will be for lTls passed candidates. lf any post
remains in addition to the multiple of two in any trade, that post will be sent in requisition of
Degree/Diploma holder candidates in that trade.

(B) Requisition for appointment of Degree/Diploma holders and tTt pass candidates in:

(c) There will be a separate syllabus for both requisitions of Degree/Diploma holders anr
lTl pass candidates. Syllabus of examination will be determined by the Commission.

(D) The Commission will communicate and provide its recommendations to th'
Employment & Training, Labour Resources Department, after selection of candidate
of both requisitions on the basis of written examination held on the same date.

(E) According to Notification No.-8025 dtd- 21.5.2013 of General Administratrv


Department, as against the requisition sent by the state government for regula
appointment on the vacant posts of Trade lnstructors in lndustrial training lnstitute
under Directorate Employment & Training (Training Wing), Labour Resorrrce
Department, weightage of 05 (Five) marks for every year subiect to maximunr of 3
(Thirty) marks will be given by considering one complete year for the period above s
months of satisfactory service to those instructors who have been employecl an
working on contract and who have all the prescribed qualifications for regul;
appointment. ln the condition of excess age, relaxation of equlvalent period will t
Biven in maximum age for the experience of the period served in Directorate (
Employment & Training (Training Wing).

(F) Those applicants who do not have prescribed qualifications in different trades carr al:
apply for appointment but if they are selected, they will have to complete the coul
of C.|.T.S. in their trade within 03 years from the date of acceptance of work charl
and leave will be granted for that period. lf any person is not able to complete thc sa
course due to reasons beyond his control, one more year will be given to complete tl
said course. lf any person is not able to obtain C.l.T.S. certificate in the said period, tl
first annual increment will not be given and Govt. will consider ending the servr:c
such people and for that, no claim will be admissible. Degree/Diploma holder who lr
directly qualified the first semester of C.l.T.S. training, training of second semester
C.l.T.S. training will be essential within 03 years of appointment.
(G) The merit list of applicants for selection will be prepared as follows:-
(i) 50 percent of the percentage of marks obtained in written examination will be given
each candidate.
(ii)20 percent of the percentage of marks obtained in National Trade Certifice
(NTC)/Apprentice Certificate/Diploma Certificate/Degree Engineering Certificate wlll
given to each candidate.
(iii) 30 percent of the percentage of marks obtained in C.l.T.S. examination will be given
each candidate.
(H) Upon receipt of recommendation for Degree/Diploma and lTl pass candidates ir
transaction, the recommended candidates of Degree/Diploma will be considered sen
over lTl pass candidates.

(l) The final merit list of selected candidates will be prepared by the commission as per Poit
(H) by adding 9(G) and 9(E) marks (if any) and the same will be sent to Directorate

10. Examination Fees: - Fees determined by the Commission will be payable by the candidates.

11. Probation Period: - (1) All direct appointment will be made on probation. This period
will be of two years.
(2) lf work and conduct of any probationary employee is not found satisfactory, for reaso

12. Training: - ln probation period, it will be essential for the Trade lnstructor to participate
all such Training as prescribed.

13. Confirmation: - On.completion of probation period and passing out prescribed Department.
Examination, the service shall be confirmed.

L4 Conception of senlority of lnstructor category: - (1) Before the date ofthe introduction (
this manual, mutual seniority of the persons appointed in anygradeof the service will b
regulated by mutual seniority before the date as determined.
Provided that if seniority of any member or members of the service is nc
specifically determined before the specified date, then their seniority will be determined b
the controlling officer of the cadre.
(2) All lnstructors automatically included in any grade will be senior to those instructor:
whose appointment in that grade is after the prescribed date.
(3) After the prescribed date, mutual seniority of persons appointed in any grade by direc
recruitment will be determined in the sequence of merit list of Bihar Staff Selectior
Commission.
(4) Upon receipt of Degree/Diploma and lTl pass candidates for recommendation in i
transaction, the recommended candidates of Degree/Diploma will be considerer
senior over lTl pass candidates.

PART.III
PROMOTION
15 Promotion: - (1) Promotion in this cadre will be considerable on the basis of sen iority-cu m- me ril
recommendation of Departmental Promotion Committee.

(2) The seniority of the employees appointed in the service will be determined as pe\

PART- IV
Miscellaneous

tl Discipline, Contiol and appeal: - The provisions of Bihar Government servant


(Classification, Control & Appeal) Rules, 2005 (as amended from time to time) shall be applicable to
this cadre.

18 service conditions not specially provided in these Rules will be governed by the Bihar
service code and other decisions issued in the context ofthe employees of equivalent
levels by the State Government, from time to time.

19 ln case ofconfusion in interpretation of anyprovision ofthese rules, it will be referred to


the state Government and the decision of the Department after consulation with the law
Dept. shall be final.

20 lf any difficulty arises in implementing the provisions of these rules, the State
Government, by notification, may make such provisions, which are essential and
expedient for removal of such difficulties.

21 Repeal and Savings: - (1) Present Rules and Regu lations/Resolutions/lnstruction s and orders
related to this cadre already issued by the department from time to time are hereby
repealed.
(z) Notwithstanding such repeal, anything done or any action taken
under the said rules and regulations resolution instruction and orders will be deemed to be done or
taken under these rules as if these rules were enforced on the date on which such thing was done or
such action was ta ken.

(3) Notwithstanding such repear, any right deemed to be


accrued undr
sub rule (1) of this Rule and to the extent when they are not repugnant
to the provisions of thes
