LEAVE AND LICENSE AGREEMENT

This LEAVE AND LICENSE AGREEMENT is made and entered into at


Mumbai, on this 11th day of February, 2023 BETWEEN Mr. ASHWIN
KANJIBHAI FATAK, bearing Pancard No.ABCPF9103A, Age- 35 years,
Indian inhabitant, having address at- Society No. 44, Room No. 21, SVP
Nagar, Mhada, Andheri West, 400053 , hereinafter referred to as “THE
LICENSOR” (which expression shall unless it be repugnant to the context
or meaning thereof shall mean and include his/her heirs, executors,
administrators and assigns) of the ONEPART;
AND
Mr.VINOD KATARIYA, an adult, Indian Inhabitant, bearing Pancard no.
JLSPK0872G, having address at- Ladwan, Agar Malwa, Tahsil agar, Jila Agar
Malwa, Madhya Pradesh, 465230, Hereinafter referred to as “THE LICENSEE”
(which expression shall unless it be repugnant tothe context or meaning thereof
shall mean and include his/her/their heirs, executors, administrators and assigns)
of the OTHER PART;

WHEREAS the Licensor is the lawful owner and in exclusive use and possession of
Flat/Apartment Premises, lying being and situated at Society No. 86, Room No. 1,
Ground Floor, SVP Nagar, Mhada, Andheri West, 400053, hereinafter referred to
as the ‘SAID APARTMENT/FLAT PREMISES;
AND WHEREAS THE LICENSEE has approached the Licensor and made a request to
allow THE LICENSEE to use and occupy the said premises on “LEAVE AND
LICENSE” basis for 11 (Eleven) months commencing from 10/02/2023 to
09/01/2024 (Both days inclusive) for Residential purpose, and WHEREAS, the
Licensor has allowed and granted permission to THE LICENSEE for the same, on
the following terms and conditions:

NOW THIS AGREEMENT THEREFORE WITNESSETH AS UNDER:

1. That the Licensor has granted permission and license to use and occupy
the said premises for Residential purpose only, for 11 (Eleven) months on
Leave and License Basis.

2. It is agreed by and between the parties that THE LICENSEE shall pay to
the Licensor a sum of Rs.13,000/- (Rupees Thirteen Thousand Only) per
month and by way of the Monthly Compensation in respect of the said
premises during the period of this Agreement each and every month
without committing any default, payable on or before 10th to 15th day of
every month. Water bill is included in the monthly compensation.

3. That, on execution hereof, THE LICENSEE has paid a sum of Rs. 30,000/-
(Rupees Thirty Thousand Only) to the Licensor/ Owner being the
Interest Free Security Deposit amount, and the same shall be refunded
to THE LICENSEE by the Licensor on expiry of this Agreement, without
any interest thereon by deducting any dues. The Receipt of which shall
be acknowledged by the Licensor at the foot of these presents.

4. That THE LICENSEE shall pay electricity charges etc. separately to the
concerned Authorities in respect of the said Premises during the period
of this Agreement.

5. That the Licensor shall pay the Municipal Taxes, Maintenance charges
and other Society, etc. in respect of the said premises during the period
of this Agreement in respect of the said Premises.
6. That the Licensor shall be deemed to have the ultimate control and full
control over the possession of the said premises and THE LICENSEE shall
not claim any right by way of tenancy or any other right in any manner
whatsoever in the said premises.

7. THE LICENSEE shall not sell, mortgage, let or part with the possession of
the said Premises to any third party during the premises. This license is
granted by the Licensor to THE LICENSEE is a personal one for
Residential purpose only and shall not carry on any illegal business in the
said Premises.

8. LICENSEES shall not cause any nuisance, annoyance and/or disturbances to


the neighboring occupants of the said premises, and THE LICENSEE shall
not store any hazardous, illegal articles, which are prohibited by law and
not carry on any act or activities which are obnoxious, anti-social, illegal or
prejudicial to the norms of decency and etiquette.

9. That THE LICENSEE shall not make any alterations, additions, changes, to
the said premises without the consent of the Licensor during the period
of this Agreement.

10.That LICENSEE further agrees that in case of any breakage, damages, loss
to existing fittings or fixtures in the said premises he/she shall make good
these articles and/or repay the cost of the damages incurred to these
articles as may be mutually decided by parties hereto.

11.That THE LICENSEE shall abide all the Rules and Regulations of the
Housing Society during the period of his stay in the said Premises.

12.That either of the party shall terminate this Agreement by giving One
month notice in advance to the other party and the on expiry and/or
earlier termination of this Agreement, THE LICENSEE shall handover the
peaceful and vacant possession of the said Premises in good condition to
the Licensor without any recourse to law. It is agreed, understood and
declared that this Agreement is purely a license granted to THE LICENSEE
by the Licensor, and executed by the parties under Section 24 of the
Maharashtra Rent Control Act, 1999 as amended from time to time.

13.That the Licensee shall not claim any tenancy right and shall not have any
right to transfer, assign, or grant any license or sub- license in respect of
the Licensed Premises or any part thereof and also shall not mortgage or
raise any loan against the said premises.

14.That the Licensor has got every right to inspect/visit the said premises
at any time for which THE LICENSEE shall not raise any objection.
IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hands and signatures on the day and year first
hereinabove written.
