GOVERNMENT OF ANDHRA PRADESH ABSTRACT Prisoners — Grant of special remission to prisoners on the occasion of Independence Day, 2004 - Guidelines ~ Issued. HOME (PRISONS-C) DEPARTMENT G.0.Ms.No.190, Dated: 07-08-2004, Read the following: 1. G.0.Ms.No.17, Home (Prisons-B.2) Department, Dated: 17-01-2003. 2. From the Principal Secretary to Chief Minister Note Dated: 03-07-2004. ORDER:- On the occasion of Independence Day, 2004, the Government have decided to grant remission of sentence to certain categories of prisoners, who have been convicted for an offence or offences against laws relating to matters to which the executive power of the State extends, 2. Accordingly, Government issue the following guidelines giving one time exemption of the orders issued in the reference first read above, to consider the cases of following categories of prisoners in the State, who have been convicted by civil courts of criminal jurisdiction: a) Convicted prisoners sentenced to imprisonment for life and governed by section 433-A, Code of Criminal Procedure, 1973 (Central Act 2 of 1974) and who have undergone an actual sentence of 7 years and total sentence of 10 years as on 15-08-2004, and b) convicted prisoners sentenced to imprisonment for life and governed by section 433-A, Code of Criminal Procedure, 1973 (Central Act 2 of 1974) aged more than.65-yearsand have undergone an actual sentence of 5 years and total sentence of 7 years as on 15-08-2004. 3. The remissions and reduction of sentences in paragraph (2) above shall also apply to prisoners, who have been convicted by courts situated within the State of Andhra Pradesh and are undergoing sentence in other States, but shall not apply to the following categories of prisoners, namely: i) Prisoners convicted and sentenced ty Courts situated outside the State of Andhra Pradesh; ii) Prisoners convicted of offences against laws relating to a matter to which the executive powers of the Union extends; ili) Prisoners involved in and convicted for offences related to communal incidents; iv) Prisoners convicted under the Essential Commodities Act; ¥) Prisoners convicted under the Protection of I Rights Act, 1955; vi) Prisoners convicted under the Andhra Pradesh Schedul i ied Castes and ‘Scheduled Trites (Prevention of Atrocities) Act, 1993, and
