1. The above mentioned suit is pending adjudication before this Hon’ble
is now listed on 26.05.2023
2. That during the pendency of the above matter, the plaintiff and the
defendants have amicably settled all their disputes and differences
vide Memorandum of Understanding/Settlement Deed dated _____.
which may be treated as part and parcel of the present application and
the contents of the same are not here repeated for the sake of brevity.
3. That it is further agreed between the parties that they shall give the
undertaking to this Hon’ble Court to remain bound by the terms and
condition of this Settlement Deed which is annexed herewith as
Annexure A/1.
4. That the plaintiff and the defendant have agreed that they have entered
into the present settlement out of their own free will and after taking
the legal advice and without any pressure, force, coercion, or
mispresentation from any side.
5. That the present application is bonafide and in the interest of justice.
PRAYER:
In view of the above mentioned facts and circumstance, it is, therefore,
prayed that the Hon’ble Court may be pleased to:
a. Record the aforementioned compromise on record and accept the
undertaking of the parties in terms of Settlement Deed dated
