On-Call Employee Contract

This On-Call Employee Contract ("Contract") is made and entered into this ____________
between:

________________________, a company organized and existing under the laws of the Republic
of the Philippines, with its principal place of business at ___________represented by its Officer In-
Charge _________________ hereinafter referred to as the “First Party”

-and-

___________________, an individual residing at _______________ of legal age, Filipino and


hereinafter referred to as the “Second Party”.

-WITNESSETH-

1. That the FIRST PARTY is in need of Truck Helper (On-Call) basis

2. That the SECOND PARTY hereby possesses the education, experience and skills required to perform
the job as On-Call truck helper.

3. That the SECOND PARTY has signified his intention, to which the FIRST PARTY has accepted to
provide the service needed by the latter and that the FIRST PARTY will provide advance notice to
SECOND PARTY of any on-call shifts, and SECOND PARTY agrees to be reachable and ready to work
during those times.

4. That in view hereof, the SECOND PARTY is hereby contracted as an on-call Truck Helper and that his
services will be required as needed and may vary in duration and frequency

5. That SECOND PARTY will be compensated for the actual days worked while on-call at the daily rate of
Php _______ and to be paid every Friday of the month.

6. That the SECOND PARTY agrees to comply with all Company policies and procedures, including but
not limited to those relating to confidentiality, professional conduct, safety, and security.

7. That it is understood that this contract does not create an employer-employee relationship between
the FIRST PARTY and the SECOND PARTY, that the services rendered hereunder are not considered and
will not be accredited as company’s service; and the latter is not entitled to any benefits enjoyed by the
regular personnel of the First Party in which case the terminating party shall serve the other party a
notice of termination at least fifteen (15) days prior to the termination.
