AFFIDAVIT OF DESISTANCE / WAIVER

We, MHAFE DEMESA CAÑON , minor and PERLA DE MESA


CAÑON, both Filipino and a resident of Purok 7, Balading, Malinao, Albay,
after having been sworn to in accordance with law do hereby depose and
state:

1. That we are the private complainant in Criminal Case No. T-8894


entitled “People of the Philippines vs. Edison Policar” for
Statutory Rape and in Criminal Case No. T-8895 entited
“People of the Philippines vs. Edison Policar” for Rape
through Sexual Assault in relation to Section 5 (b), Article III
of R.A. 7610 as amended by R.A. No. 11648 pending before the
Regional Trial Court, Branch 3, Family Court;

2. That after discussing the matter with the accused and his family,
there appears to be an amicable settlement as we already forgiven
the accused, we came to the decision that there is no more use for
us in pursuing this case, hence, we are no longer interested in
prosecuting the said case and we hereby waive all actions we may
have against EDISON POLICAR in connection with the said
incident;

3. That we are now desisting in the further prosecution of the case


and praying unto this Honorable Court to immediately recommend
the dismissal of the above-mentioned case;

4. That we were never been coerced, forced or intimidated in signing


this affidavit of desistance and further prays for the dismissal of the
above-mentioned case of which we are the private complainant;

5. That we are executing this affidavit in order to attest to the veracity


of the foregoing statements and to affirm that the same are true
and correct to the best of our knowledge and belief, and for the
purpose of asking the Honorable Court to DISMISS the case I filed
against EDISON POLICAR.

IN WITNESS WHEREOF, we have hereunto affixed our signature


this 19th day of January, 2023 at Tabaco City, Albay, Philippines.
