CONSTRUCTION AGREEMENT
This agreement made the ________ day of _____month ________year At _________ Town,
Ethiopia, between the _____________________________ ( here in after called "The EMPLOYER
") of the one part ,and _______________________________________ (here in after called " The
CONTRACTOR " whose registered office is situated at ______________________of the other part.
WHERE AS THE EMPLOYER is desirous of having constructed, completed & maintained the
documents enumerated and referred to in clause 2 here of the contractor to execute the
__________________________ (here in after called "THE WORKS") and has caused the drawings,
Specifications and Bill of Quantities be prepared by The Employer, here in after called Project
supervisors who is appointed to administer the contract in accordance with STANDARD
CONDITIONS OF CONTRACT FOR CONSTRUCTION OF CIVIL WORKS PROJECT , DEC 1994
MWUD.
WHEREAS THE CONTRACTOR HAS agreed to undertake the construction works
as per the terms and conditions of the contract documents enumerated in clause 1 below.
1. GENERAL PROVISION
a) In this agreement works and explanations shall have the same meaning as are respectively assigned
to the in the STANDARED CONDITIONS OF CONTRTACT REFERED IN CLAUSE 2(d)
below.
b) For the consideration here in after mentioned, the CONTRACTOR will up on and subject to the
conditions here to annex execute and complete the works shown in the said drawings and described or
referred to in the said bills of quantities, specifications and the said conditions.

2. CONTRACT DOCUMENTS
It is agreed and under stood that the following documents:-
a) This agreement
b) The instruction to bidders
c) Signed form of Bid of the contractor
d) Standard conditions of contract for construction of civil works project MWUD Dec. 1994.
e) Standard Technical Specifications and Methods of Measurement ,as per MWUD Dec .1994
f) Signed prints of sketches, and
g) Signed prints of damage Assessment Sheets.
Shall be known as “ THE CONTRACT DOCUMENTS” and represent the agreement between the
EMPLOYER and CONTRACTOR and that other is no there agreement or any other document
relating to in any way affecting this agreement at this stage and that these document supersede all
other agreement and drawings the date here off .
3. AGREEMENT CONSIDERATION
In consideration of payments to be made by the EMPLOYER ,CONTRACTOR here by convents with
the EMPLOYER to execute and complete the works with in ____ Calendar days and remedy and
defects there in conformity ,in all respects with the provisions of the contract and the EMPLOYER here
by covenants to pay CONTRACTOR in consideration of the execution and the works and the
remedying of defect here in the total Contract price of birr

Contract Documents.

4. CONTRACT ADMINISTRATION
The CONSULTING ENGINEER shall responsible for interpreting & administering the contract in
accordance with the Contract Documents specified in article 2 here above & witnesses this agreement
as here under .
5. STATUS OF CONTRACT
It is agreed and understood that the said contract documents shall be interpreted according to the
Ethiopian law.
It witness where of the parties have caused their respective common seals to the hereunto affixed in the
day and year first above written.

APPENDIX OF THE CONSTRUCTION AGREEMENT
