1.Indian Union of Muslim League vs. Union of India
Related – CAA
Held:
➢ The Union Home Ministry (MHA) on 11th March ,2024 notified the
Citizenship Amendment Act (CAA) Rules.
➢ The CAA, enacted by the government in 2019, seeks to grant citizenship to
persecuted non-Muslim immigrants, including Hindus, Sikhs, Jains,
Buddhists, Parsis, and Christians, from Bangladesh, Pakistan, and
Afghanistan who entered India before December 31, 2014.
➢ Court order for reply by Centre on the stay application limited to five pages
till April 2 and file a 5-page reply to the application by April 8.
2.Srikant Upadhyay v. State of Bihar
➢ Related – Section 82 of Cr.pc
➢ Held: SC held that mere pendency of an application for anticipatory bail
does not bar a trial court from issuing proclamation against absconding
accused under Section 82 of the Cr.pc.
➢ The Court further clarified that when a warrant of arrest or proclamation is
issued, an applicant would not be entitled to invoke the extraordinary power
of grant of anticipatory bail but “this will not deprive the power of the Court
to grant pre-arrest bail in extreme, exceptional cases in the interest of
justice.”
3.Association For Democratic Reforms v. Union of India
➢ Note-Earlier, the Supreme Court had refused to stay the law while issuing
notice in a batch of petitions.
➢ Held-Writ petition filed before SC for stay on the implementation of
Section 7 of the Chief Election Commissioner and Other Election
Commissioners (Appointment, Conditions of Service and Term of Office)
Act, 2023.
➢ Two posts of Elections Commissioners lying vacant and the Election
Commission is functioning at less than the envisioned capacity of three
official posts.
4.Dablu Kujur v. The State Of Jharkhand
➢ Related -New Guidelines On Police Report Procedure
➢ A report in the form prescribed by the State Government.
➢ Police officer in charge shall clearly state in the Report about the
compliance of Section 169 Cr.P
➢ When the report in respect of a case to which Section 170 applies the police
officer shall forward to the Magistrate along with the report, all the
documents.
➢ In case of further investigation, the Police officer in charge shall forward to
the Magistrate a further report or reports regarding such evidence in the
form prescribed.
5.Association For Democratic Reforms v. Union Of India
➢ Held- SC held electoral bonds scheme as unconstitutional. The SBI shall
submit the details of electoral bonds purchased and name of the political
party to the Election Commission of India within 3 weeks i.e 6 March.
6.Sita Soren v. Union of India
➢ Held: SC held that Members of Parliament (MPs) and Members of
Legislative Assemblies (MLAs) cannot claim any immunity under Articles
(105 and 194 of the Constitution) when they are accused of taking bribes.
➢ The Court also overruled a contrary judgment rendered by it in 1998 in the
case of PV Narasimha Rao v. State.
7.Prem Raj v. Poonamma Menon & Anr
➢ Related – Section 138 of the NI Act, 1881
➢ Held: SC quashed the concurrent conviction, emphasizing that the Civil
Court’s declaration regarding the cheque’s purpose as security bound the
criminal proceedings.
➢ Said that when a Civil Court already decided on the nature of a transaction,
criminal proceedings based on the same transaction are unsustainable
8.Anjum Kadari and Anr. V. Union of India and Ors
➢ Held:The Allahabad High Court declared the U.P. Board of Madarsa
Education Act, 2004 unconstitutional, stating that the State lacked the
authority to establish a Board solely for religious education.
9.WhatsApp Messaging Services, why is in Newa?
➢ Held: Chief Justice DY Chandrachud on 25th April announced the new
initiative of integrating the WhatsApp messaging services with the IT
services, launched by the Supreme Court.
➢ The CJI clarified that through this initiative, the Advocates on Record and
parties in person will receive automated WhatsApp updates/ automated
messages regarding:
1. Electronic filing
2. Cause lists
3. Orders and judgements.
