NOTICE RELATING TO THE PROCESSING OF PERSONAL DATA WITH REGARDS CONTRACTS WITH CUSTOMERS
IN ACCORDANCE WITH ART. 13 AND 14 OF THE REGULATION (EU) 2016/679 (“GDPR”)

PERSONAL DATA PROCESSED and DATA SOURCE: "Data" means:
- in the case of the legal person “customer”: the shared data of natural persons, processed by the company in order to stipulate and implement the contractual relations - i.e. those of the legal
representative who signs the contract in the name of and on behalf of the customer, and those of the customer's employees/consultants involved in the tasks described in the contract and/or those who
receive training (name, surname, telephone, company e-mail). In the latter case, the data source is the customer;
- in the case of the natural person “customer”: the shared data of natural person customers, processed by the company in order to stipulate and implement the contractual relations.
DATA PROCESSING AIMS / LEGAL BASIS OF THE PROCESSING / DATA CONSERVATION PERIOD
1) Aims linked to the definition and implementation of contractual relations between the customer and the company. / Implementation of the contract for the data of natural person customers or for the legal
representative of the legal person customer.
Legitimate interest for the data of the customer's employees/consultants involved in the tasks described in the contract and/or those who receive training. / The duration of the contract, then a further 10
years.
2) Fulfilment of administrative and bookkeeping requirements, such as bookkeeping and cash management along with invoicing (e.g. the checking and registration of invoices), in accordance with the
regulations in force. / The need to fulfil a legal obligation that the company is subject to. / The duration of the contract, then a further 10 years.
3) The recovery of extra-judicial credit. / Legitimate interest. / The duration of the contract, then a further 10 years.

purchased; the sending of customer satisfaction surveys or questionnaires. / Legitimate interest (“soft spam” in accordance with art. 130, para. 4 of Italian legislative decree 196/03, as modified by Italian
legislative decree 101/2018, the so-called "Privacy Code"). / Until the opposition exercised by the party concerned.

PROVISION OF DATA
Data provision is compulsory for the conclusion and/or execution of the contract. Refusal to provide the data will therefore prevent the establishment of the contractual relations and/or the fulfilment of the
relative obligations.
DATA RECIPIENTS
The data may be passed on to third parties in their role as Autonomous data controllers, or processed - on behalf of the company - by third parties nominated as Data processors who have received
suitable operating instructions, such as: banks and credit institutions, credit insurance companies, commercial information companies, audit companies, forwarding agents, couriers, depositories,
professional and consultancy studios, insurance firms, public authorities (only if envisage by law), suppliers, agents, manufacturing companies, other group companies whose products are sold by the
company in question.
PERSONS AUTHORISED TO PROCESS THE DATA
The data may be processed by employees of the company departments appointed to pursue the above aims, explicitly authorised to carry out this task, and in possession of the necessary operating
instructions.
TRANSFER OF PERSONAL DATA TO COUNTRIES OUTSIDE THE EUROPEAN UNION
The data may be transferred abroad, to non-European countries where the Biesse Group companies, including HSD, are based:
i) Australia, New Zealand, Canada, Switzerland, countries considered suitable by the European Commission (https://www.garanteprivacy.it/home/provvedimenti-normativa/normativa/normativa-
comunitaria-e-intenazionale/trasferimento-dei-dati-verso-paesi-terzi).
ii) countries not considered suitable by the Commission, signing the Standard Contractual Clauses adopted by the European Commission in accordance with art. 46, 2, sub-paragraph c) of the GDPR.
This transfer is made for internal administrative purposes (considering 48 GDPR) and is intrinsic to the operation of the customer management system used by Biesse Group.
RIGHTS OF THE PARTY CONCERNED - COMPLAINTS TO THE CONTROL AUTHORITY
The party concerned can send an e-mail to
[email protected] to ask the company for the possibility to access his/her data, delete data, correct any imprecise data, supplement incomplete data or limit the
processing procedure in the cases envisaged by art. 18 GDPR, or oppose (for reasons linked to his/her own particular situation) the processing carried out for the legitimate interests of the data controller.
If the data processing is based on consent or on the contract, and is carried out with automated tools, the party concerned has the right to receive the data in a structured, commonly used format that can
be read by an automatic device. He/She also has the right to transmit such data to another data controller without hindrance if this is technically feasible.
The party concerned has the right to present a complaint to the relative controlling authority in the member country where he/she normally resides or works, or the country where the presumed violation
occurred. The party concerned has the right to oppose the processing of his/her data for marketing purposes at any time, easily and free of charge, by clicking on the “unsubscribe” link found in every e-
mail send out for this purpose.
