Under Order VIII, R. 1 of Code of Civil Procedure, 1908
1. It is submitted that the defendant has gone through the averments made in
the plaint and affidavit filed in support of the plaint. The averments, which
are not specifically admitted, are denied. The Plaintiff is put to strict proof of
the same. Most of the averments are not correct and false and the suit is not
maintainable
2. That the suit has not been properly valued for the purpose of court fees and
jurisdiction and is therefore liable to rejected out rightly.
3. As the plaintiff has stated the defendant has taken amount Rs.1,50,000 /-
(Rupees one lakh fifty thousand only) is false and are hereby specifically
denied by Defendant.
4. That the suit is liable to be dismissed out rightly as the Plaintiff has not
given the mandatory notice
5. The allegation made regarding payment of interest @12% p.a. by plaintiff is
false and are hereby specifically denied by Defendant. The defendant is not
bound to pay any interest
6. Defendant has not signed any demand promissory note on 15.01.2020 and
the signature obtained on black paper was by coercion.
7. There is absolutely no cause of action against the Defendant.
8. The suit is therefore liable to be rejected on this ground.
9. Hence, it is prayed that this Hon’ble Court may be pleased to dismiss the
suit with costs.
