TANONG: Ikaw ba ay nakahandang magbigay ng isang malaya at kusang loob na salaysay na lahat na
iyong sasabihin ay pawing katotohanan lamang?

SAGOT: Opo.

02. T : Maari mong bang sabihin sa akin ang iyong tunay na pangalan at ibang bagay na nauukol saiyong
pagkatao?

S: Ako po si SherimaeBanderadaFranquia, 41 anyos (June 3, 1975), may- asawa, empleyada at nakatira

sa Brgy. Tonggohin,Infanta,Quezon.

03. T: Anong dahilan at naririto ka ngayon sa aming silid siyasatan at nagbibigay ng kusang loob na
salaysay? (WHAT)

S: Naririto po ako upang pormal na magsampa ng kaukulang demanda laban sa lalaking nagnakaw ng
aking mga personal na kagamitan.

04. T: Kailan, saan at anong oras nangyari itong sinasabi mong pagnanakaw? (WHEN & WHERE)

S: Kanina po, mga mahigit kumulang na 10:30 ng umaga, petsa 25 ng Oktubre, 20w4, sa loob ng KFC
Store na matatagpuan sa panulukan ng Batican Infanta,Quezon.

05. T: Sino naman itong inirereklamo mo? (WHO)

S: Nakilala ko eto sa pangalang Johnloyd Balasta, 34 anyos (June 17, 1982), may-asawa, empleyada,
tubong Batican Infanta Quezon at nakatira sa Gumian Infanta Quezon.

06. T: Kung makakaharap mo ba etong si Johnloyd Balasta ay makikilala mo siya?

S: Opo.

07. T:Tingnan mo nga etong mga kalalakihang ihaharap ko saiyo at sabihin mo sa akin kung naririto
etong si Johnloyd Balasta? (CONFRONTATION/POLICE LINE-UP)

S: Eto po (Complainant finger pointing to the suspect Johnloyd Balasta), siya po ang tinutukoy ko na
nangnakaw ng aking bag.

08. T: Maari mo bang isalaysay sa akin ang buong pangyayari na may kaugnayan dito sa sinasabi mong
pagnanakaw? (WHY & HOW)
S: Ganito po ang pangyayari, mga humigit kumulang na 10:30 ng umaga, petsa 24 ng Oktubre 2024, ako
ay nagpunta sa KFC Store sa may Retiro upang mag-almusal at dahil yong mesa na malapit sa Counter ay
bakante ay inilapag ko ang aking Gucci Hand Bag at nagtungo ako sa Counter para mag order dahil ito ay
abot tanaw ko naman kaya tiwala ako ngunit ako ay napalingon duon sa kabilang lamesa dahil may
dalawang babae na nag-aaway at matapos kung makuha ang order ko ay nagulat na lang ako at wala na
ang aking bag duon sa aking mesa.

09. T: Ano ang sumunod mong ginawa?

S: Agad po akong lumapit sa Security Guard na si Mark Angel Murphy na agad naming umakto at
tiningnan naming yong CCTV nila at duon ko nakita na kinuha yong aking bag ng isang lalaki na kulay
brown ang t-shirt at maong na short pants at isinilid nya eto sad ala nyang paper bag.

10. T: Anong sumunod nyong hakbang?

S: Sinamahan po ako ng SG Espetero sa labas at natanaw naming duon sa kabilang kalsada sa tapat ng
Jollibee yong lalaking may dalang paper bag na pasakay ng jeep.

11. T : Ano ang ginawa nyo?

S: Humingi po ako ng tulong duon sa pulis na si PO3 Carlito Morilla at matapos kung sabihin ang
pangyayaring nakawan at ituro yong nagnakaw ay agad nya etong hinuli at nabawi din yong aking hand
bag.

12. T: Ano ang sumunod na naganap?

S: Sinamahan po ako ni PO3 Morilla sa opisina ng Investigation Section ng Infanta Police Station at
inendorso nya po ako pati yong suspect sa Desk Officer.

13. T: Magkano ang halaga ng iyong bag at ano-ano naman ang laman ng iyong bag na sinasabi mong
ninakaw sayo ni Ringo.Johnloyd Balasta?

S: Yong Gucci Hand Bag ko ay halagang Php 60,000.00, mayron din laman na pera po duon na Php
9,000.00, isang Samsung Note 5 na halagang Php 36,000.00 at mga importanteng dokumento po.

14. T: Tingnan mo nga etong mga nakalatag sa ibabaw ng mesa kung may kaugnayan eto sa sinasabi
mong mga kagamitan mong ninakaw?

S: Eto po lahat ay pag-aari ko sir.

15. T: Lalagyan ko eto ng mga marka na (MAM-RRR), eto ay mga letra na umpisa ng iyong pangalan at ng
suspect para medaling makilala sa oras na ikaw ay tumestigo na sa korte?

S: Opo.
16. T: Pansamantala ay wala na muna akong nais na itanong pa saiyo, mayron ka p bang gustong sabihin,
idagdag o ibawas sa salaysay mo?

S: Wala na po sir.

17. T: Nakahanda ka bang lumagda sa ilalim ng salaysay mo na eto bilang patunay na lahat ng iyong
sinabi ay tutuo at pawing katotohanan lamang?

COMPLAINT AFFIDAVIT

I, SherimaeBanderadaFranquia, 41 years old (June 3, 1975), married, government employee and with
postal address at Brgym Tonggohin,Infanta, Quezon, after having been duly sworn to in accordance to
law do hereby depose and states;

That, I am formally charging JohnloydBalasta, 34 years old (June 17, 1982), married, employee, native
of Infanta Quezon and residing at 86 Gumian Infanta Quezon for the crime of Theft before the Quezon
City Prosecution Office that was committed as follows;

That, on or about 10:30 o'clock in the morning of October 24, 2024, while I was taking my order at
KFC Store located at the corner of Brgy. Batican Infanta, Quezon, when my attention was caught by two
females who were then on top on their voice arguing in an adjacent table. Few minutes thereafter, I
notice that my Gucci Hand Bag Php 60,000.00 and containing Php 9,000.00 cash money, Samsung Note 5
Cellular Phone worth Php 36,000.00 and other important documents which I placed on top of the table
was missing;

That, I immediately reported the incident to Security Guard Mark Angel Murphy and upon review on the
CCTV Footage, we found out that suspect Johnloyd quickly passes beside my table then took my bag and
put it inside a paper bag that he was carrying, then went out the store.

That, subsequently, we hurriedly went out from the store and we were to chance upon the suspect who
was then about to board a passenger jitney in front of Jollibee just opposite to KFC located along Infanta
Quezon.

That, at that precise moment, I sought the assistance of PO3 Carlito Morilla who was the conducting
patrolling the area that resulted to the arrest of the suspect and also recovery of my hand bag together
with its contents;

That, after the arrest of the suspect and recovery of my personal belongings, PO3 Morilla assisted and
referred us to PO3 ArnelP. Borreo, the Investigator of the Investigation Office of Infanta Police Station
for formal investigation;

That, inside the Investigation Room, the suspect and the recovered pieces of evidence was
presented to me by the Investigator and in the presence of other police officers, I positively identifies
Ringo Ramos as the same person whom I saw from the CCTV Footage to took my hand bag. Likewise, I
affirm to the Investigator that the contents of the hand bag were my personal belongings;

That, I am executing this affidavit to attest the foregoing facts and circumstances and to form part as
additional documentary evidence in prosecuting the case against the suspect;

AFFIDAVIT OF ARREST
I, PO3 Carlito Morilla, of legal age, filipino, police non-commissioned officer with postal address at c/o
Station Investigation and Detective Management Section, Infanta Police Station,after having been duly
sworn to in accordance to law do hereby depose and states:

That, as bonafide member of the Infanta Police Station, I am particularly designated as Beat Patrol
Officer and as such rendering tour duty from 7:00 AM to 7:00 PM;

That, on or about 10:30 o'clock in the morning of October 24,2024, while I was performing my official
duty particularly conducting beat patrolling along Brgy. Batican Infanta Quezon when I was approached
by female person who requested me to hold a male person who was then about to board a passenger
jitney bound towards A. Brgy. Batican Infanta Quezon with information that the sais person had took his
handbag;

That, I simultaneously approached the male person while introducing myself as a police officer as well
inform him of the accusation imputed against him and timely prevent him from fleeing;

That, initially, the suspect tried to resist, however, after a just and reasonable force, I was able to subdue
him and placed him under arrest and also resulted to the recovery of the stolen items;

That, subsequently, a general inquiry was conducted to the suspect who gave his name as
JohnloydBalasta, 34 years old (June 17, 1982), married, employee, native of Infanta Quezon residing at
Brgy. Gumian Infanta Quezon while the female complainant was identified later as Myra Asuncion y
Mejiano, 41 years old (June 3, 1975), married, government employee and with postal address at Brgy.
Tonggohin Infanta Quezon.

That, subsequently, I turned-over the suspect, together with the complainant and the recovered pieces
of evidence such as Hand Bag containing Php 9,000.00, one Unit of Samsung Note 5 and other personal
documents of the complainant to the Duty Desk Officer for proper disposition;

That, he prepared the Incident Record Form (IRF) the Desk Officer referred us to the Investigator for
formal investigation wherein, in our presence, the suspect was informed of his Constitutional Rights and
thereafter, I was instructed by the Investigator to bring the suspect to the Government Hospital for
medical verification;

That, I am executing this affidavit to attest the foregoing facts and circumstances and form part as
additional documentary evidence in this instant case.

duty, Duty Desk Officer SPO1Cedrck Laus turned- over to me the person of JohnloydBalasta, 34 years old
(June 17, 1982), married, employee, native of Infanta Quezon and residing at Brgy. Gumian Infanta
Quezon for investigation based on complaint of SherimaeBanderadaFranquia, 41 years old (June 3,
1975), married, government employee and with postal address at Brgy. Tonggohin Infanta Quezon for
Theft,

That, the Desk Officer likewise turned-over to me pieces of recovered evidence recovered from the
suspect, such as Hand Bag, Php 9,000.00, one unit of Samsung Note 5 and other personal documents
owned by the complainant,

That, I informed the suspect of his constitutional rights and also confronted him to the complainant
wherein the latter positively identify him to be the same person who took his hand bag containing the
recovered pieces of evidence which was also identified by the complainant as her personal belongings;

That, I instructed the arresting officer PO3 Carlito Morilla to bring the suspect to the Government
Hospital for medical verification;

That, I personally marked the recovered pieces of evidence with MAM-RRR in the presence of the
complainant for purposes of identification, That, I cause the preparation of all the investigative
documents of this instant case;

FACTS OF THE CASE:

Investigation conducted disclosed that on or about 10:30 o'clock in the morning of October 24,2024,
inside the KFC Store, located at Brgy. BaticanInfanta, Quezon, while complainant was taking her food
order at the Counter when her attention was destructed by the two females in the adjacent table who
were then engaged in an argument and to her dismay, she notice that her Gucci Hand Bag was missing
when she return to her table.

Thereafter, the complainant reported the incident to Security Guard Mark Angel Murphy and upon
review on the CCTV Footage, they found out that the above- named suspect had quickly passes beside
her table then with intent to gain, took and carted away the above-described articles involved and put it
inside a paper bag that he was carrying, then went out the store without her knowledge nor consent.

Subsequently, complainant hurriedly went out and was able to chance upon the suspect who was then
about to board a passenger jitney in front of Jollibee just opposite to KFC located at Brgy. Batican
Infanta, Quezon that instance, she sought the assistance of PO3 carlito Morilla who was the conducting
patrolling the area that resulted to the arrest of the suspect and also recovery of the stolen items.
