WHEREAS, the licence for the right of selling by Shop is to be granted for the
licence period from 12-10-2024 to 30-09-2026 and whlreas the Director oi prohibition
&
Excise has fixed the n_umber of Shops to be licenced in the Mandal/Nagar panchayat
.
/Municipality/Municipal corporation vide cr.No. zgo6l2024lcpE/E3, ot.so.og.z-02+.

Excise (Grant of licence of selling by Shop and conditions of licence) Rules, 2024

following Notification for information of the public and intending apflicants who may enroll
online for registration/ filing of application on or before 5:00 PM on Og.tO.2024 or offline for
registration / submission of application for consideration for grant of licence for the
licence
period mentioned abovethrough drawl of lots on or before S:bO pU on 09.10.2024

The applicant, who will be granted the right to sell Indian Made Forergn Liquor/
Foreign Liquor by Shop as specified in the list appended to this Notification for tie licence
period from 12-10-2024 to 30-09-2026, shall be selected through drawl of lots.

The drawl of lots will be conducted at 08:00 AM on LI.LO.2OZ4 at MSR kalvana

S+d3oam. Jammula Palem Road, Flvover Down. Bapatla Town (placdf drawl of
lots), by the authority as specified under Rule to of Rndhra pradesh'Excise (Grant of
Licence of Selling by Shop and Conditions of Licence) Rules, 2024.Theterms and conditions
governing the drawl of lots and details of the Mandals, Nagar Panchayats, Municipalities
and
Municipal Corporations where licences are to be granted are appended herewith. '

The rates of Retail Excise Tax for the Shops in the different population slabs have
been notified in G.O.Ms.No.212, Revenue (Excise) Department, dated.gO.Og.ZO24, a copy of
which is appended herewith.

 CONDITIONS GOVERINING DRAWL OF LOTS

(1) Procedure for online enrolment:

The applicant may submit any number of applications for any number of Shops for
participation in the seledion process of Shop through online or offline mode.

a) Applicant shall open URL: https://hpfsproJect.com online and click on "Enroll" button,
applicant shall provide all the required information for enrolment as per Form Ai (A)
and password.
b) After enrolment, applicanvuser shall Iogin into his account with his User ID
(Registered Mobile number) and password.
c) After lo99in9 in, the applicanvuser will be able to initiate a new application against
Shop Gazette serial number in "create application" screen,
d) Applicant shall enter all the fields as seen in the "create applicat,on" screen and
select the payment mode and accept the terms and conditions
e) Applicant can apply for any number of Shops GSL Nos. and number of applications
against same shop.
0 Applicant can view the all the applications he has submitted and can view the status
of each application.
g) Applicant can download/ print Registration ceftificate in Form R1, Form 43 (B) and
Entry pass E1 for the applications generated by clicking on Print icon.

Application Payment Modes:

Online model:
In case the applicant opts for online mode for registration and submission of
application through online mode, he shall fill in Form-A3(A) as per Rule 11 ofAndhra
Pradesh Excise (Grant of licence of selling by shop and conditions of licence) Rules,
2024. He shall select Gazette Sl.No of the Shop notified in a Unit(Municipal
Corporation/ Municipality /Nagar Panchayat / Mandal) and pay the Nonrefundable
application fee of Rs 2,00,000/- by way of Debit Card/Credit cardlNet Banking. On
successful payment, the applicant may download the documents in Form- A3(B),
Registration certificate in Form-Rl and Entry Pass in Form-El, which are system
generated.
Hvbrid Modeh
In case the applicant opts for online mode for registration and submissicn of
application through online mode, he shall fill in Form-A3(A) as per Rule 11 of Andhra
Pradesh Excise (Grant of licence of selling by shop and conditions of licence) Rules,
2024. He shall select the Gazette Sl.No of the Shop notifled in a Unit(Municipal
Corporation/ Municipality /Nagar Panchayat / Mandal) and select the payment mode
as manual in CFMS. He shall take system generated receipt and proceed to the SBI
and make payment of Rs 2,00,000/- towards Nonrefundable application fee. After
successful payment he can download Form- A3(B) , Form-R1 and Entry Pass in
Form-El, which are system generated.
offline Model:
In case the applicant opts for offline mode for registration and submission of
application through offiine mode, he shall fill in Form-A3(A) as per Rule 11 of Andhra
Pradesh Excise (Grant of licence of selling by Shop and conditions of licence) Rules,
2024. He shall select the Gazette Sl. No of the Shop notified in a Unit (lvunicipal
Corporation/ Municipality /Nagar Panchayat / Mandal) and select the payment nrcde
as offline, He shall pay Rs. 2 Lakhs towards Non-Refundable Application Fee by way
of Demand Draft drawn on a scheduled bank in Andhra Pradesh in favour of the
Licensing Authority. He shall enter the Demand Draft number in the system. He shall
note the application number which is system generated and needs to go to
Designated Center as per gazette notiflcation and submit the Demand Draft in
original. After successful acknowledgement of payment by the Center incharge, he
can download Form- A3(B), Form-Rl and Entry Pass in Form-El, which are system
generated.

In complete omine mode, the Applicant can also directly go the notifled Application
Reception Centers (Excise Station in the District) with his details. The staff on duty
at the counter will digitize the application after receiving of the DD drawn as
specified above and after verirying the DD, acknowledgement, Entry pass and other
system generated documents will be printed and provided to the Applicant. SHOS of
 the concerned station will be responsible to receive genuine DDs and safely hold till
these are transmitted to Licensing Authority. The Demand Draft drawn in favour of
the Licencing Authority of a district shall be valid for submission in that distrid only
and shall not be submitted in any other district.

h) The applicant(s) shall also enclose the following along with the application

(i) Two recent passpoft size photographs along with photostat copy of Vote; ID
Card/Driving Licence / Passport /
Bank PassbooV AADHAR card/ Any other
government approved ldentity Card.
(ii) Scheduled Tribe Certificate and local Scheduled Area Residence Certificate (only
in resped of local S.T. candidates applying for Shops in Scheduled Areas).
(2) Entrv Pass (Rule 6)
The applicant shall submit/upload passport size photograph which shall be
reflected in the Entry pass (system-generated). Such an Entry Pass should be
brought by the applicant on the day of drawl of lots for getting entry into the place
of drawl of lots. Persons without presenting Entry Pass will not be allowed to enter
into the place of drawl of lots.
(3) Persons not elioible to file aoolications and oarticioate in the drawl .rf
lots (Rule 7)

The following persons shall not be eligible to participate in the drawl of lots.
a. A person who is below the age of 21 years.
b. A person who has been convicted of any offences specified in clause (d) of
sub-section (1) of Section 31 of the Act in respect of which he has been
penalized or convicted within the preceding ten years:

c. A person who has been convicted or whose licence has been cancelled for
breach of any of the conditions of licence granted under Section 31 of the Act
within the preceding ten years;
d. A person who has been held guilty either in a departmental proceeding or in
a Court, of an offence under Section 37 of the Act for adulteration of toddy
by mixing any article injurious to public health or otherwise within the
preceding ten years.

e. A person who is a defaulter of excise revenue; or

f. A person who is adjudged as an insolvent by a competent Court.
(4) Impersonation not allowed (Rule 8)
No person shall submit application on behalf of any other person unless he or
she holds a power of attorney from such person.
(5) Announcement of names of persons who filed applications: (8.ule

11(8Xb)
At the commencement of drawl of lots the licensing authority shall first
announce the names of persons and the number of persons who have filed
applications for a particular Shop, which has been taken up for drawl of lots.
(6) Aoolicants and drawl of lots : (Rule 11(8)(d))
Where there are more than one application for a notified shop, the selection
among the eligible applicants for grant of licence shall be by drawl of LOT by the
Colledor, irrespective of the presence of the applicants.
(7) Drawl of lots bv the authority: Rule l1(8)tc & d)
(a) The authority under whose aegis the drawl of lots may take place shall i'rthe
case of any Shop where only one application is received, declare the same in

favour of that applicant subjed to the condition that all the other conditions
 have been fulfilled. Where there are more than one application, the authority
under whose aegis the drawl of lots may take place, shall proceed with the
drawl of lots and one applicant shall be selected and his name shall be
declared as selected. The successful applicant's application shall be accepted
and the remaining rejected.
(b) The Colledor, after selecting the applicant in respect of a Shop, may
continue drawl of lots and select two more applicants from among the
remaining applicants as reserve applicants, the first and the second who
may, subject to the provisions of these rules, be allotted the Shop in the
order of selection, in case the selected applicant fails to comply with the
conditions laid under the rules on the day of drawl of lots or subsequently.
(8) ConfirmationReoister:-
Every person whose application has been accepted shall sign his name or
affix his thumb-impression against the relevant entry in the register
maintained for the purpose.
(9) Postponement of drawl of lots :. (Rule 11(7))
If the authority under whose aegis drawl of lots is conducted, considers that
the drawl of lots should be postponed for a future time and date for any reason
he may do so after recording the reasons thereof.
(10) One person can obtain licences for more than one Shoo:- (Rule 11(8!(f))
There shall be no restriction on the number of shop licences, a person can hold
at a time.
(11) Pavment of l"t installment of Retail Ex€ise Tax bv the successfgl
applicant:- (Rulel5(4))
The applicant shall pay a sum equal to the 15t installment of the annual Retail

Excise Tax for the Shop by way of Challan in treasury g!_!hg!ayglsgleg!!9!

or on the succeedino bank workino dav after successful selection. The RET

pald for 11 days period from 01-10-2024 to LL-L0-2024 shall be adjusted in the
12ft instalment of Retail Excise Tax payable,

(12) Procedure to be followed in case of non-oavment of 1st installment of

Retail Excise Tax!: (Rule 16 and Rule 17)
In case of failure to remit l"t installment of the Retail Excise Tax q!-thgjay
of selection or the succeedino bank workino dav, the shop shall be allotted to
the reserve applicant or action shall be taken as per the provisions of Rule 17 to
dispose of the Shop.

(13) Other reouirements to be fulfilled bv the selected applicant (Rule

15(31!
The successful applicant shall submit Bank Guarantee in Form A-5, for the
amount equal to one sixth of the annual Retail Excise Tax valid till the expiry of the
license period, issued by a Scheduled Bank situated in Andhra Pradesh, within thirty
days of his selection.

(14) Re-allotment in case of failure to furnish B.c.:-

In case of failure to furnish the Bank Guarantee as required under Rule 15[3]

within the time specified, the seledion made for the concerned Shop shall be

cancelled by the Distrid Collector and the amounts already paid shall be fofeited to
the Government. In such a case the Shop may be re-allotted to the reserve
 applicant selected under the provisions of Rule 1f (8)(e), and if no one is
available, action may be taken to re-notiff the Shop or action may be taken under
Rule-17 with prior permission of the Commissioner of Prohibition and Excise.
The first applicant shall continue to be responsible for the Retail Excise Tax
of that Shop till the next successful applicant takes over

(fD Selected aoplicant to execute Counteroart Aoreement:- (Rule 18)

The successful applicant after making payment as required under Rule 15(4)
and furnishing B.G as required under Rule 15(3), shall execute a Counterpart
Agreement in conformity with the tenor of the licence in Form 4-6 on the stamp
paper of the requisite value as per the provisions of the Indian Stamps Act, 1899
before taking out a licence for the sale of Indian Liquor and Foreign Liquor.

(16) Selection of Premises:- (Rule 24)

The successful applicant after fulfilling the formalities under Rule 15 before
obtaining licence shall select a suitable premises anywhere in the unit viz,. Mandal,
Nagar Panchayat, Municipality or Municipal Corporation, as the case may be, in
which the Shop is notified for sale of IMFL & FL in conformity with Rule 24 and
obtain a licence in form A-4 from the District Prohibition & Excise Officer to
commence business from l2-t0-2024.
(17) The licensee shall sell IMFL & FL at MRP rates only as required under Rule 40 of
Andhra Pradesh Excise (Grant of licence of selling by Shop and conditior': of
Licence) Rules, 2024.

(18) Licenceto be qranted to the successful aoolicant in Form A-4 wil! be

qoverned bv:
1. The A.P. Excise Act, 1968 and rules made thereunder.

2. A.P. Intoxicating liquors (Prohibition of Advertisements) Act 1978

3. The A.P. Excise (Grant of licence of selling by shop and conditions of licence)

Rules, 2024.

4. A.P. Excise (Import, Export and Transport of Indian made Foreign Liquor and
Foreign Liquor - Permits) Rules, 2005.
5. The orders issued by the Commissioner of Prohibition & Excise, Andhra

Pradesh from time to time as the Chief controlling authority in all matters
connected with the administration of the Andhra Pradesh Excise Act.

Depatment will not be held responsible. The intending applicants for participation in the
