TENANCY AGREEMENT

1. NOW THEREFORE IT IS MUTUALLY AGREED As follows;


(a) The landlord shall let and the tenant shall take on rent one residential house

the Demised premises) with effect from ……..….………. for period of …..……….….. with no
option to review and renew the tenancy.

The initial payment of …………………… has been paid in advance on execution of this
agreement. Thereafter the tenant shall pay for one month in advance for the rest of the
tenancy. This one month advance will cater for security.

2. THE TENANT HEREBY COVENANTS WITH THE LANDLORD As follows;

(a) To pay the aforesaid rent at the time and in the number aforesaid into CENTENARY bank

(b) To keep the premises and all installations and fixtures thereto in tenantable repair and
conditions (fair wear and tear excepted) and without any alterations save as may
only specifically be sanctioned by the landlord.

(c) To yield up the premises in the aforesaid conditions at the termination of term hereby
granted or any extension thereof as may be agreed upon by the Landlord and the Tenant.

(d) To permit the landlord and/or its representatives or duly authorized agents at all reasonable
times in the day to enter upon and to examine the condition of the premises.

e) Not to assign, under-let or part with possession of the premises or any part thereof without
the consent in writing of the landlord.
(f) To use the premises for residential accommodation only with a maximum of 4 permanent
residents of which maximum 2 can be adult.

(g) To repair any article that may be damaged or destroyed due to the negligence of the tenant
or its agents.

(h) To perform and observe the covenants and condition on its part herein contained and
implied by the law (save as herein modified)

(i) Not to carry on in the premises any offensive trade or act of nuisance to the neighbors

(j) To pay water and electricity bills on time.

(k) At the expiration of the term hereby granted, the tenant shall repaint the premises internally
with two coats of paint in original colours and all repairs, if any, must be done before
the premises are handed over to the landlord.

(l) Report immediately to the landlord any structural defect in the premises which may develop.

3. THE LANDLORD COVENANTS As follows;


(a) That the tenant paying the rent hereby reserved and performing and observing several
covenants on its part therein contained shall peaceably HOLD and enjoy the premises
during the term of this agreement without any interruption by the landlord or any person
rightly claiming under it or in trust for it.

(b) To pay ground rent and owners' site rate if any as and when the same shall fall due.

4. PROVIDED ALWAYS AND IT IS HEREBY AGREED As follows;

(a) If, the rent hereby reserved or any part thereof shall remain unpaid for 30 days , after
becoming payable (whether formally demanded or not) or if any covenant to the part of the
tenant, herein contained shall not be observed or performed, it shall be lawful for the landlord to
re-enter upon the premises without re-course to court and thereupon the term created shall
absolutely be terminated but without prejudice to any right of action of the landlord in respect of
breach of the covenant here contained.

(b) In the event that the tenants breach clause 4(a) hereof and compelling the landlord to re-
enter or close-up the premises, the landlord shall under this agreement, retain the tenants
valuables and shall have a lien over such valuables for the owed rent sums, the cost of necessary
repairs and the cost of painting the premises internally.

(c) If the rent arrears are not settled within (7) seven days after the re-entry and the landlord
taking lien over the retained valuables the landlord shall exercise the right to sell such items as
will cover the arrears and any incidental costs WITHOUT first obtaining àny court order
PROVIDED the landlord shall first give the defaulting tenant a (14) days 'written notice of
intention to sell AND this shall be without prejudice to the landlord's right to sue the tenant for
any shortfall or balance or rent and other incidental costs after the above sale.

(d) The term herein created may be extended for such further period and upon such terms and
conditions as may be mutually agreed upon.

(e) Either party can terminate the tenancy agreement hereby created by giving the other two-
months written notice.

(f) Any notice required to be given under the tenancy shall be in writing and sufficiently served
on the tenant if left at the premise addressed to the tenants or sent to the tenant's last known
address and on the landlord's if served on its last address unless and until notified otherwise by
the landlord.

(g) IN WITNESS whereof the parties hereto have hereunto set their respective seals the day and
year first above-mentioned.
