Sub: Non-Use of items supplied by Germany for manufacturing of Cluster Munitions.
Dear Sirs,
You may be aware that Germany has imposed restrictive conditions in allowing
‘access to certain export control items. The ground for such restriction is that such items may
bbe used directly or indirectly in the context of cluster munitions.
2. Asan effort of Govt. of India, Germany has agreed to allow access to certain export
controlled items by Govt. of India entities subject to a certificate to the effect that “the goods
in question will not be used in the context of cluster munitions” being issued by the Govt. of
India. Joint Secretary (DIP) in the Department of Defence Production has been nominated as
the Competent Authority to issue such a certificate on behalf of Govt. entity, Format of the
Certificate is enclosed.
3. __Ithas been decided with the approval of Competent Authority in this Department, that
the Certificate should be signed by the Chairman/CMD of the Indian entity and the End User
in the Service HQs. etc. Thereafter, it will be countersigned by JS(DIP) on behalf of the
Indian facility that is sourcing the item in question and is owned, operated or controlled by, or
under contract to the Government of India.
4, This issues with the approval of competent authority.
