GENERAL- Terms and Conditions applicable to epic Mobile and Fixed services and WiMax services
l These Terms and Conditions together with the attached Sign Up Form and the specific terms and conditions of any
applicable Service options, tariff plans or promotions constitute a legally binding contract (the "Contract") between
epic ("We"/"Us"/"Our") and the Customer ("You/Your"). This Contract shall commence when We accept Your
application and connect You to the Network. All services not included in the tariff signed-up for overleaf shall be
charged as per existing tariff plans.
l This Contract is personal to You. You shall not, except with Our written consent or in accordance with Our standard
transfer procedures, assign or otherwise transfer this Contract in whole or in part
l Our Specific Terms relating to the various tariffs and promotional offers shall apply. You are advised to review the
Specific Terms accordingly. Access to the Specific Terms is available by visiting Our retail outlets or Our websites,
www.epic.com.mt for Our Mobile and Fixed Services or internet.epic.com.mt for Our WiMAX Ser vices.
l Fees and Charges, Deposit, Payment Terms, Interest and Taxes. We may determine and impose Access Fees and
Charges, the Payment Terms and the Prescribed Rate and may vary or revise any or all of them from time to time
and such variation or revision shall take effect as from the date determined by Us. Such Charges and Payment
Terms may be dependent upon Your credit rating with Us.
l Other Limitations. We reserve the right not to entertain Your migration requests from one tariff plan onto another In
such cases You shall have to terminate Your present Customer Agreement and enter into a new Agreement

Use of the service and epic equipment (including software)
l Upon receiving the device and the relevant warranty from Us in accordance with an applicable promotion/ deal, all risk
risk and responsibility in relation to such device shall pass onto You.
l You hereby acknowledge that We do not keep voice and data content. However, certain details and logs are
retained; subject to public policy requirements, as well as subject to inter alia data protection and data retention
applicable laws and regulations. You may have access, at Our discretion to certain details and logs, subject to
aforementioned laws and regulations.
l You may use the Service whilst located outside the Territory, however access to local networks shall depend upon
the arrangements between Us and local operators. Roaming charges shall apply to those of You who are using the
Service outside the Territory. Please refer to Our website for current tariff rules/details or call Us on 247. Conditions
may change frequently due to new/amended agreements with other operators. You are advised to visit Our website
www.epic.com.mt for updated information.
EPIC WIMAX - BROADBAND AND VOICE OVER IP SERVICE
Access to premises and charges for attendance and inspection
Upon Our request,You shall procure that Our authorised personnel or contracted outsourcer be permitted:-
l to enter any premises occupied/controlled by Yourself at such time as shall be communicated to You, and to remain
on such premises for such period as may be required:
l to install, carry out any inspection, repair or testing of any of Our Equipment and other equipment relevant to the
provision of any Service and any inspection;
l to check and verify the manner in which any Service is being utilised by Yourself and Your compliance with the
General Terms, Specific Terms and the Law in the use of any Service or any of Our Equipment;
l to install, collect, remove, maintain or replace any of Our Equipment; and/or
l for any other justified purpose whatsoever.
Use of the service and epic equipment (including software)
l You shall be responsible and liable for obtaining and maintaining in Your name and at Your own expense all
necessary permits and consents, required for the provision of the Service or the installation or the use of any
equipment (including Our Equipment) in conjunction therewith for the entire duration during which the Service is
provided or made available to You.
Notices
l This Service will not function in the event of a power failure within Your premises where the Service is installed or a
power failure arising from the network, unless Our Equipment and Your equipment has an adequate power back-up
facility.
l SHOULD YOU REFUSE TO INSTALL A POWER BACK-UP FACILITY, YOU SHALL BE SOLELY RESPONSIBLE
FOR THE NON- FUNCTIONING OF THE SERVICE IN THE EVENT OF POWER FAILURE WITHIN THE
PREMISES OR ARISING OUT OF THE NETWORK.

Renewal: For assistance to renew your Agreement please get in touch with us.
Termination: If you terminate the Agreement prior to the expiry of the 24-month term, a termination fee applies and is calculated as
follows: 30% of the Monthly Access Fee multiplied by the remaining months. To terminate your agreement, please visit one of our retail
stores. The termination request will be processed by us within 30 calendar days.
Downgrade/Upgrade: If you downgrade your Tariff Plan during the 24-month term, the fee is calculated as follows: 30% of the difference
in Monthly Access Fee multiplied by the remaining months plus the above administrative fee. If you upgrade, no fees apply.

1. The Epic Standard tariff plan (‘Tariff Plan’) is offered by Epic Communications Limited ('we') to its new and existing customers ('you')
under these terms and conditions (‘Specific Terms and Conditions’). When you subscribe to this Plan, you are automatically accepting to
adhere to these Specific Terms and Conditions, Mobile General Terms and Conditions (https://www.epic.com.mt/tc-general/) and any other
relevant terms and conditions which will constitute a legally binding agreement between you and us (the ‘Agreement’).
2. You may subscribe to the Tariff Plan as from the 17th November 2020. This version of the Specific Terms and Conditions is
applicable as from 1st August 2024.
3.1 This Tariff Plan provides you with the monthly benefits listed in Table 1 below (the ‘Monthly Bundle’).
3.2 Upon subscribing to the Tariff Plan you will benefit from the Monthly Bundle that includes:

3.3 Any unutilised benefits from the Monthly Bundle shall not be carried forward and will be forfeited at the end of the month.
3.4 Any usage beyond what is provided in the Monthly Bundle shall be charged at the rates set out in term 5 below. Any activity made
towards local premium-rated numbers or other services will not be consumed from the Monthly Bundle and will be charged separately as per
the rates as set out in term 5 below.
3.5 For the first month of the Agreement, the Monthly Bundle will be allocated in full. This means that you will pay a proportion of your
Monthly Access Fee which will be calculated on the number of days between your Tariff Plan activation date and the date of the first billing
cycle. However, you will still receive the full benefits included in the Monthly Bundle.
3.6 Mobile data speeds may vary from time to time due to contention ratios on the network and other factors outside our control, which
include dependency on the network coverage as well as on your device Currently our mobile data service on this Tariff Plan is able to
support speeds up to 90Mbps Upload Speed & 1500Mbps Download Speed and are only available on 5G capable devices that are enabled
on the Epic network and are subject to location.
4. Monthly Access Fee
4.1 All rates and charges quoted below are inclusive of VAT but are exclusive of excise tax or any other taxes which may be applicable.
4.2 You may benefit from the Tariff Plan at the price of thirty-four euros & ninety-nine cents (€34.99) per month (the ‘Monthly Access
Fee’). In case your agreement will expire and will not be renewed, your Tariff Plan price will be thirty-nine euros & ninety-nine cents (€39.99)
per month. Should you subscribe to DDM, you shall benefit from a monthly discount of two euro (€2) including VAT which will be deducted
from your monthly bill. For avoidance of any doubt, should you be subscribed to more than one service, the DDM discount shall be
applicable per account. By this choice, you are automatically authorising us to directly debit your account on a monthly basis.
4.3 In the event that you wish to add a device to this Tariff Plan you may opt to benefit from the Device Monthly Payment Scheme.
From Tier 0 to Tier 5 are available with this Tariff Plan (please refer to the Device Monthly Payment Scheme Terms and Conditions).
5. Rates outside Monthly Bundle and Information on Charges
5.1 The rates and charges provided in this term shall apply to any usage which goes beyond what is provided in the Monthly Bundle,
i.e. once you use up your monthly benefits included in Monthly Bundle, or if you use services that are not included therein.

6. Roaming
6.1 The EU/UK roaming benefits provided with the Monthly Bundle of this Tariff Plan are subject to the Fair Use Policy in line with the
EU/UK Regulations further explained under Mobile General Terms and Conditions (https://www.epic.com.mt/tc-general/ ).
6.2 The Monthly Bundle provided with this Tariff Plan does not apply whilst roaming in Rest of World countries. When roaming in Rest
of World countries, the Traveller together with the respective terms and conditions shall apply at this link : https://www.epic.com.mt/wp-
content/uploads/2022/05/Rest-of-World-Traveller-for-Pay-Monthly-Plans.pdf. This is the default tariff when roaming in Rest of World
countries on this Tariff Plan. You may not opt out from the Traveller tariff plan.
7. Administrative charges
7.1 The following administrative charges shall apply in any of the following circumstances when subscribed to this Tariff Plan:

8.2 In case you are benefiting from other services together with this Tariff Plan the applicable fees in accordance the relevant terms
and conditions shall apply.

2. You may benefit from this Scheme as from the 1st May 2021. This version of the Specific Terms and Conditions is applicable as
from 1st May 2024.
3. The Scheme
3.1. Through the Scheme you are purchasing a mobile device, an accessory, or a TV set (the “Device”) by means of monthly payments
made for a thirty-six (36) month term (the ‘Term’) unless terminated in accordance with these Specific Terms and Conditions.
A one-time activation fee of €9.99 applies upon subscription to the Scheme (after the successful completion of the vetting process).
3.2. You can benefit from this Scheme only if you subscribe to a pay monthly mobile plan offered by us which is described on our
website and/or in respective pay monthly mobile tariff plan’s terms and conditions as being compatible with this Scheme (the ‘Eligible Plan’).
In case you are already benefitting from any pay monthly mobile plan and you wish to benefit from this Scheme, you will have to terminate
your current agreement in accordance with applicable terms and conditions and enter into a new Eligible Plan agreement. For the avoidance
of any doubt, termination fees may apply.
3.3. The Agreement shall therefore commence on the same date as your Eligible Plan agreement.
3.4. You can select one of the following Scheme Tiers:
3.5. You are only entitled to choose one Device and one Tier throughout the duration of the Agreement. We reserve the right to limit the
choice of Tier available to you. For the avoidance of any doubt, once you sign your Agreement you will not be able to change the Tier which
you opt for unless you terminate your Agreement in accordance with term 5 below and sign up to a new one.
3.6. The Scheme shall be paid in thirty-six (36) equal Monthly Payments (as listed in term 3.4 above), which payments are inclusive of
applicable VAT but excluding any other applicable taxes. Subject to your regular payments, the Monthly Payments are interest free. You
accept that the payments due in terms of your Eligible Plan and this Agreement shall be paid via direct debit.
3.7. In the event that the Device which you select is of a higher value than the sum of your Monthly Payments, you would be requested
to pay the difference in value immediately upon signing the Agreement.
3.8. Each Monthly Payment shall appear and be charged on the same bill as your Eligible Plan for the duration of the Term (the first
Monthly Payment will be charged on the following calendar month’s bill).
4. Eligibility
4.1. The Scheme is available with any Device available at our retail stores or online shop with a selling price of or higher than €143.64.
4.2. We reserve the right to accept or refuse you as our customer. Our acceptance and conclusion of the Agreement and provision of
the Scheme is subject to:
4.2.1. our assessment of your creditworthiness;
4.2.2. valid proof of your identity and address and such evidence of residency in Malta, as we may require;
4.2.3. valid proof of a long-term commitment to reside in Malta, as we may require;
4.2.4. you being over eighteen (18) years of age;
4.2.5. valid proof of your employment;
4.2.6. any other documents that we may reasonably request;
4.2.7. truthful and accurate provision of all requested information and data at the point of placing the order, or any other additional
information as we may reasonably request;
4.2.8. payment in advance when deemed necessary on the basis of credit rating status and history with us;
4.2.9. security deposit as may be reasonably required by us as a guarantee for the fulfilment of your obligations. Such deposit will be
refunded to you at the end of the Agreement subject to the payment of all outstanding Monthly Payments and settlement of any other bills.
4.3. We reserve the right to carry out further credit checks and other related checks during the Term in order to safeguard our interests
and ensure that you are and remain eligible for the Scheme. Should we have reasonable cause to believe that you are no longer eligible, we
reserve the right to terminate the Agreement.

remaining balance due in terms of the Monthly Payments; for the avoidance of any doubt, termination fees shall apply.
5.2. Apart from instructions by You to terminate the Agreement or your Eligible Plan, you understand that the following circumstances
shall also automatically bring about the termination by you of this Agreement and that term 5 shall apply:
5.2.1. A request for change of ownership of your Eligible Plan;
5.2.2. A request to downgrade or move to a pay monthly mobile plan that is not the Eligible Plan;
5.2.3. A request to port-out from your Eligible Plan to another service provider; or
5.2.4. A request to alter your Scheme in any way.
5.3. We may suspend, restrict or terminate this Agreement and your Eligible Plan if you breach any of your obligations under the
Agreement, including but not limited to persistent late or non-payment of your Monthly Payments.
5.4. Unless otherwise indicated by us within our sole and exclusive discretion, any termination under this term shall require you to pay
the outstanding Monthly Payments in full and a €50 termination fee upon notification of termination by you or by us and you bind yourself to
pay such outstanding amount in full without delay.
5.5. We reserve the right to pass on any liability arising out of this Agreement to third parties, including international debt collection
agencies, without prior notice to you.
5.6. In the event that you fail to pay the Eligible Plan Monthly Access Fee and/or the Monthly Payment for two (2) consecutive months,
we reserve the right to deactivate your Device. In order to re-activate your Device you would need to pay any outstanding amount in full, an
administrative fee of €20 and any other termination or administrative charges as applicable with your Eligible Plan.
6. Legal Ownership
6.1. On the 5th calendar day of the month following entry into this Agreement between you and us, any and all rights arising out of this
arrangement in favour of us shall be assigned to MeDirect Bank (Malta) plc which shall from such day be the legal owners of any rights
arising between us and you under these Specific Terms and Conditions unless we advise you otherwise. This will further involve the sharing
of certain personal data relating to you and your participation in this scheme with MeDirect Bank (Malta) plc, the particulars of which are set
out in our dedicated privacy notice accessible at https://www.epic.com.mt/wp-content/uploads/2024/04/Schedule-8-Privacy-Policy.pdf.
6.2. For the avoidance of doubt, we will continue to be liable to you for any obligations arising out of these Specific Terms and
Conditions, including without limitation matters relating to Device warranties.
6.3. By accepting these Specific Terms and Conditions, you acknowledge and accept that MeDirect Bank (Malta) plc is the rightful
owner of the rights arising between us and you under these Specific Terms and Conditions. We will continue to correspond with you and we
will continue to issue invoices to you. When doing so, we are acting on behalf of and collecting any funds for the benefit of MeDirect Bank
(Malta) plc.
7. General
7.1. Once we provide you with the Device, ownership of the Device is transferred to you. This means that it is your responsibility for
proper care and diligent use of the Device, battery and any other accessories provided with the Device throughout the Term. It is also your
sole responsibility that the Device is used in a manner consistent with the manufacturer’s recommendations and instruction manuals.
7.2. You will still be responsible to pay all remaining Monthly Payments for the Term if the Device is damaged, lost or stolen or if the
Device develops a fault and we shall not be held liable in any such case. Faults developed during the statutory guarantee period shall be
handled in accordance with obligations at law.
7.3. We reserve the right to suspend indefinitely or for a definite period, amend/alter/delete or terminate these terms and conditions or
the Scheme at any time at our sole discretion.

enquiry services; however, this is entirely at your discretion and you are not obliged to do so. Should you not wish to release such data into

2. lf you are a post-paid customer. it is equally at your discretion whether to make your personal data available for reverse searches. If you
do so. others may search for your details on electronic directories by inputting fields other than your name.Thus, for example, in classic
reverse searches, others may carry out a search by entering your telephone number and your name as the name of the person who the
number Is attributed to would then be given by the directory enquiry service. Other searches could Include entering a street name and
locality.
3. You may at any time and at no cost also, review and amend the contents of the data submitted, the opt·in/opt-out choices made in
accordance with this clause. While it is possible to change your subscriber details or change your status from directory to ex-directory, keep
in mind that, any data which would already have been published and/or distributed In written format, whether in paper format or any other
electronic media, cannot and will not, in anyway, be retracted.
4.Epic respects your choices and any information provided to us by virtue of this clause shall be used only for the purpose of directory
information services and not for any other purpose such as direct marketing.
Once I consent to the Inclusion of my personal data for the purposes of directory Information services, I am:
(i) consenting to the sharing of my details with all other authorised directory information service providers established in the EU/UK, provided
that such sharing takes place when and only if all Legal requirements relating to such sharing are met; and
(ii) Agreeing that my personal data can be included in any form of directory information service that may be provided locally and/or anywhere
