1) I hereby inform you the grounds of detention order mentioned in
below paragraph no. 6 passed under section 3 sub–section (2) while
implementing section 8 of The Maharashtra Prevention of
Dangerous Activities of Slumlords, Bootleggers, Drug Offenders,
Dangerous Persons, Video Pirates, Sand Smugglers and Persons
Engaged in Black Marketing of Essential Commodities Act, 1981
(Amendment 1996, 2009 and 2015) along with Article 22 (5) of
Constitution of India. The names and identi cation marks of the
witnesses / victims of the underlying statement mentioned in
paragraphs 6 (B) (i) and 6 (B) (ii) of the following documents
submitted to me cannot be given to you in the public interest and I
have special powers to that respect.
2) Your criminal record shows that you are a “Dangerous Person”
and are involved in dangerous activities and has been identi ed
because of the acts done by you till date. In this proposal, it is found
that you have created an atmosphere of terror in the area. You have
used violence and intimidation to create panic and fear in the minds

of people. Your movement and actions are serious threat to the
public peace and public order of the society.
3) You, Aman @ Mastan Ashif Khan, Age 22 years, R/o Baba
Mastanshah Ward Bhandara, Dist. Bhandara, do not have a legal
instrument of livelihood and you are running your livelihood on illegal
means. Against you, in Bhandara District, various cases of Attempt
to Murder, hurt, abusing people in public places, pointing weapons
at people, and robbery with attempt to cause death or grievous hurt,
have been registered at various police stations in the district . Also,
preventive action has been taken against you from time to time to
stop your illegal acts. However, there has been no change in your
behavior. You repeatedly commit crimes like attempt to murder and
robbery after being released from jail.
4) It is seen from the available records that you have been involved in
various serious offences pertaining to chapter XVI of IPC, XVII of
BNS, and Arms Act. Following offences are registered against you:

prevent you from committing violent crimes. These preventive

6) Your involvement in the following recent incidents and your


tendency and habit show that you will continue to commit illegal acts
such as obstruction of public order in the future. Particulars of
offence and other criminal activities which have been taken into
consideration for issuing the detention order are as follows:

A Report of Mr. Mangesh Ashok Murkute age. 41 Yrs, R/o


Ravindranath Tagore Ward, Near Lalaji Lane, Khat Road, Bhandara
vide crime no. 645/2024 u/s 311,351(2) of B.N.S
I) On 04/07/2024 at 13:00 hrs, while the complainant was going by
motor cycle from Kham Talav chauk, he saw that an accidents
occurred between two motor cycles and a ght was going on
between the two drivers. At that time, the complainant stopped near
them and intervened to resolve the ght. At that time, you along with
your other accomplice injured the complainant by hitting on his face,
nose and neck with knives and iron rods and took Rs 2000 from his
pocket by force. The said crime is registered on the report of the
complainant and the investigation is going on by the police.
II) On the oral complaint of the complainant, crime has been registered
against you and case is under police investigation.
III) From the report of the complainant regarding this incidence, offence
has been registered in Police Station, Bhandara vide Crime No.
645/2024 U/s 311,351(2)of B.N.S. on 04/07/2024. The case is under
police investigation.

IV)The crime is being investigated by Police Sub Inspector Dipak
Chalurkar, Police Station Bhandara. The Spot Panchnama, Seizure
Panchnama, Arrest of Accused, and MCR has been prepared in the
investigation of the crime.

B. During the con dential interrogation, two of the victims of your


criminal act have stated the facts of the crime, as you have in icted on
them, on the condition that their names would not be disclosed. In order
to maintain con dentiality in the names and identities of the witnesses,
they have been referred to as Witnesses "A" and "B". The brief text of
their statement are as follows.
Witness “A” identi ed you as a "Dangerous Person."
(i) Witness “A”
In the month of March 2024, while the witness was closing
the shop at night, you approached the witness and took out a knife
from your pocket and said, “tune dinbhar achi kamai ki, sab paise
nilak nai to mai tera game baja dunga” (you have done a good
earning in the whole day; give me some money otherwise I will you).
Witness has seen you threatening people with knives and extorting
money many times. The people of Baba Mastanshah Ward,
Bhandara and Muslim Library Chowk, Bhandara area are afraid of
you as you are gunda (goon) of that area. So no one reports against
you in the police station. You had created an atmosphere of fear
among the people in the surrounding area. On the condition that his
name be kept con dential, the witness has testi ed. The facts are
contained in the statement.
ii) Witness “B”
In month of May 2024, when the witness was walking in his
neighbourhood after eating dinner, you approached the witness and
asked “muze daru pine ko 200 rupe do (give me Rs 200 for drinking
liquor)”. When the witness refused to pay as he did not have any
money, you abused and threatened to kill him. Even before this, the
witness saw you threatening people with knives and demanding
money many times. The people of Baba Mastanshah Ward,
Bhandara and Muslim Library Chowk, Bhandara area are very afraid
from you as you are a gunda (goon), so no one reports against you
in the police station. You had created an atmosphere of fear among
the people in the surrounding area. On the condition that his name

be kept con dential the witness has testi ed. The facts are
contained in the statement.
The statement of the witness has been veri ed by Mr. Ashok
Bagul, Sub-Divisional Police Of cer, Bhandara, District Bhandara,
and I am personally satis ed with it.
7) Your past history shows that you have no respect for the law. You
have a tendency to commit crimes without fear of the law. Crimes
viz. 1) PS Lakhani Cr.No. 217/2022 u/s 307,323,504,34 of IPC, 2)
PS Bhandara Cr.No. 163/2023 U/s 307,34 IPC., 3) PS Bhandara Cr.
No. 927/2023 U/s 294,323,427,504,34 IPC, and 4) PS Bhandara
Cr.No. 22/2024 U/s 4,25 Arm Act, and 5) PS Bhandara 645/2024 U/s
311,351(2) B.N.S. are registered against you. From this, it can be
seen that you have become a habitual criminal. By seeing the
offences registered against you it is concluded that you have no fear
of law and you will commit offences again and again. It has become
dif cult to maintain public order due to your illegal activities.
Accordingly public order has come in danger.
8) Looking at the criminal records led against you at District
Bhandara, I am personally satis ed that you are a “Dangerous
Person” and criminal with dangerous activities under section 3(1) of
The Maharashtra Prevention of Dangerous Activities of Slumlords,
Bootleggers, Drug Offenders, Dangerous Persons, Video Pirates,
Sand Smugglers and Persons Engages in Black Marketing of
Essential Commodities Act, 1981 (Amendment 1996, 2009 and
2015). As you are involved in criminal activities and you are a
notorious criminal the public order is in danger because of you. You
have created panic in the minds of the people residing in jurisdiction
of above mentioned police stations, as well as in the minds of law
abiding of cials. Legal action taken against you under various laws
prevailing today are not enough to curb your criminal activities.
Therefore it has become necessary to detain you as per provision of
section 3 (1) of The Maharashtra Prevention of Dangerous Activities
of Slumlords, Bootleggers, Drug Offenders, Dangerous Persons,
Video Pirates, Sand Smugglers and Persons Engages in Black
Marketing of Essential Commodities Act, 1981 (Amendment 1996,
2009 and 2015).

9) I have carefully perused all the records presented before me and I
am sure that your involvement in such illegal and antisocial activities
is a threat to public order and public peace. I am also convinced that
the various actions taken against you under various existing laws
are not found enough to control your criminal activities. In order to
prevent you from engaging in such dangerous behaviour in the
future, it has become imperative to detain you under section 3(1) of
The Maharashtra Prevention of Dangerous Activities of Slumlords,
Bootleggers, Drug Offenders, Dangerous Persons, Video Pirates,
Sand Smugglers and Persons Engages in Black Marketing of
Essential Commodities Act, 1981 (Amendment 1996, 2009 and
2015).
10)You are informed that you have the right to make a statement to the
State Government against the detention order issued against you
and you will be given an opportunity to do so as soon as possible.
You can make a statement to Hon. Additional Chief Secretary
(Home), Department of Home Affairs (Special), Government of
Maharashtra, Ministry, Mumbai 400032 through the Superintendent
of Prisons in which you have been detained on your desire to do so.
11)I further inform you that under Section 3 (3) of this Act, while the
approval of the Detention Order is pending from the State
Government, you have the right to make a statement against the
Detention Order to me, i.e. the District Magistrate. If you wish to
make such a statement, you should forward it to the District
Magistrate, Bhandara. On the date when the order is approved by
the State Government, you will be informed by the Superintendent
of Prisons in which you are detained. After the State Government
approves the detention order under section 3 (3) of the Act, the right
to make statements/representation to the detention authority will
automatically come to an end.
12)You are also informed that within three weeks from the date on
which you are detained by the State Government, your case will be
referred to Advisory Board constituted under section 9 of The
Maharashtra Prevention of Dangerous Activities of Slumlords,
Bootleggers, Drug Offenders, Dangerous Persons, Video Pirates,
Sand Smugglers and Persons Engages in Black Marketing of
Essential Commodities Act, 1981 (Amendment 1996, 2009 and

2015). Necessary information regarding your detention would be
submitted to the Advisory Board so that it make its opinion on
whether there are suf cient reasons for your detention. The Advisory
Board will send a report to the State Government within seven
weeks from the date of detention, taking into account all the
evidence presented before them and after making appropriate
inquiries.
13)You are further informed that if you wish to make any report to the
Advisory Board against the Detention Order, you can do so and the
same should be addressed to The Chairman of the Advisory Board,
C/o. Section Of cer, Room no.10, Home Department, Government
of Maharashtra, Ministry, Mumbai - 400032 established under
Section 9 of The Maharashtra Prevention of Dangerous Activities of
Slumlords, Bootleggers, Drug Offenders, Dangerous Persons, Video
Pirates, Sand Smugglers and Persons Engages in Black Marketing
of Essential Commodities Act, 1981 (Amendment 1996, 2009 and
2015), and the same should be submitted through the
Superintendent of Prison in which you are detained.
14)You are further informed that if the Advisory Board deems it
necessary, or if you wish to do so, the Advisory Board will hear you
in person. You can inform such wish through the Prison
Superintendent, so that the same can be informed to the Advisory
Board. And for this purpose necessary measures can be taken for
your personal appearance before the Advisory Board on the date
xed by the Advisory Board with that respect.
