BERNABE PENALOSA REYES, FRANCISCO P. REYES,
CARMEN REYES GO, TRINIDAD REYES BORROMEO, MARIO
P. REYES, ELSIE REYES HERBULARIO (deceased)
represented by Emmylou Reyes Herbulario, Christine
Herbulario Loplop, Joy Herbulario Lercana, Ivy Herbulario
Rios, and Rex Reyes Herbulario. , all of legal ages, married,
Filipino citizens, and all residing in Brgy. Poblacion, Municipality
of Mambahao, Province of Camiguin, Philippines.
WITNESSETH, that:
WHEREAS, VICENTE PENALOSA, DOLORES PENALOSA REYES and MELECIO
PENALOSA are the sons and daughter and sole Heirs of RITA PENALOZA who died

outstanding debts in favor of any person or entity, left certain Real properties in

WHEREAS, after the demise of MELECIO PENALOSA and his spouse
SULPECIA PENALOSA, his shares of the estate devolved unto the Heirs of VICENTE
PENALOSA AND DOLORES PENALOSA as the next rightful heir pursuant to Article
962 of the Civil Code and related laws of intestate succession.
WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the
Philippines, and being with full capacity to contract, we do hereby adjudicate unto
ourselves the above-described parcel of land in equal shares.
WHEREAS, we ROMEO MALINAO PENALOSA, EVELYN PENALOSA AQUI,
ANAVILES PENALOSA VILLANUEVA, FLORDELIZA PENALOSA DUE and
JUNEVI MALINAO PENALOSA as HEIRS OF VICENTE PENALOSA (whose
personal circumstances are mentioned above) have agreed and covenanted to
WAIVE and RENOUNCE our share over the declared “PROPERTY No. 1”, rights and
participation over the above-described parcel of land in favor of our co-heir
FRANCISCO P. REYES.
WHEREAS, we undertake to have this Deed published in a newspaper of
general circulation in three (3) consecutive weeks.
