AFFIDAVIT
I, Bankatlal Ladda, S/o, Late Radhavallabh Laddha, aged about 77 years,
occupation; business. residing at No.64, Vallabh Vihar, Basappa Layout,
Hanumanthanagar, Bengaluru-560019, do hereby solemnly affirm and state
on oath as follows:
1. I am the petitioner in the above case. I know the facts of the case. Hence,
I am swearing to this affidavit.
2. I state that, I have filed this petition for recovery of possession and arrears
of rent.
3. I state that at the time of filing of the plaint along with documents, I was
filed only copies of documents above mentioned and is now being
produced the originals of the same. Without these documents it is
impossible to for the plaintiff prove his case, Hence, the same may be
taken on record and permit to lead evidence.
4. I submit that the non-production of the documents is not because of
latches or negligence.
5. I submit that if the annexed application is allowed no hardship and
prejudice would be caused to the other side and other hand if this
application is not allowed the plaintiff will be to great hardship loss and
injury.
WHEREFORE, I pray that this Hon'ble Court may be pleased to allow the
accompanying application as prayed for in the interest of justice and equity.
