otherwise described in these Bills of

The Contract Sum shall be deemed to have


been calculated to include all duties on
materials to be incorporated in the finished
works. Duties shall include all customs and

Value Added Tax (where applicable) is


included separately at the appropriate
section(s) of the Bills of Quantities as a
percentage addition, and shall be included
at the percentage rate applicable at the

The Contractor is required to inspect all


drawings and must acquaint himself with all
the requirements needed to fulfill this
contract. No claims will be entertained as a
result of the non-compliance with above.
Should any drawing or part thereof be
unclear, the tenderer must seek an
explanation from the Architect/ project

registered with the Engineering Institute of
Zambia (EIZ) or other applicable. Where-as
the works are to be done in house, the said
works may be supervised by a registered
engineer of the relevant discipline subject
to ratification and approval by the Project

The contractor’s attention is drawn to the


fact that he will have to execute the work in
this contract in conjunction with other Sub-
M contractors and Direct contractors. Item 0

The contractor must ensure, inform himself


and allow for any cost implication he might

SETTLEMENT OF FINAL ACCOUNT H3 0

The contractor shall be supplied with a copy


of the final account for signature. Should
the contractor not object to, or sign the
final account within 30 (thirty)( days of date
of issue, it shall be deemed that he has
accepted the Final Account and he shall
thereafter not be entitled to payment of
any amount other than those set out in the

borne by the contractor. The contractor

are to be installed in strict compliance to
the Engineer’s detail and manufacturers
specifications by an approved specialist. 0

dimensions and details with the Project
Manager’s, Structural Engineer's, Electrical

EXISTING AND ADJACENT PROPERTY H3 0

The attention of the Contractor is drawn to


the fact that the adjoining
premises/buildings will be fully occupied
and operational during the course of the
works and that he must comply with all
requirements or restrictions regarding the
phasing and control of pollution applying to
these works. The restrictions may relate to
type of plant to be used, the methods of
works to be adopted, the hours of working
and may, in addition impose a maximum
noise level within the work area which may
not be exceeded. The Contractor must take
all steps necessary to safeguard existing and
adjacent property, make good at his own
expense any damage to persons or property
caused thereon, and hold the Employer
indemnified against any such claim arising. 0

The Contractor shall confine to the site all


persons employed on the works including
Subcontractors, keeping all unauthorised
persons off the site, take all measures to
safeguard the works against theft and
provide, erect, maintain and alter as
necessary temporary barriers and the like
required for this purpose. 0

The Contractor will be held fully responsible


for the safety of the existing and adjacent
buildings, Landscaped areas and for any
damage caused in consequences of these
Works. He must reinstate all damages at his
own expense and indemnify the Employer
against any loss. 0

All operations necessary for the execution
of the works and for the construction of any
temporary works shall, as far as compliance
with the requirements of the contract
permits, be carried on so as not to interfere
access unnecessary or improperly with the
Employers convenience or the access to use
or occupation of the building, public or
private roads and footpaths or of
properties, whether in the possession of the
Employer in respect of all claims, demands,
proceedings, damages, costs, charges and
expenses whatsoever arising out of it in
relation to any such matters. The
Contractor must take such steps and
exercise such care and diligence as to
minimise nuisance from dust, noise or any
other cause to the occupiers of the existing
and adjacent property. The Contractor shall
deal with any complaints which may arise
due to lack of the foregoing precautions and
such arrangements and negotiations as may
be necessary, including temporarily
suspending any portion of the works. No
instruction issued by the Project Manager
shall relieve the Contractor from his
obligation to comply with these clauses. 0

If through neglect, nuisance does occur, the


Contractor will be held wholly responsible
and he is to indemnify the Employer and
hold him harmless against all or any claims
which may be made in this respect. 0
