III. FACTS OF THE CASE:
6. 10:30 pm in evening on December 9, 2020, PO2 Anna Dacillo responded to
Robbery incident that transpired in Public Plaza in Poblacion 2, Villanueva
Misamis Oriental and requested for a SOCO Team assistance. SPO4 Kenneth
Cardenas, thus involved evidence collected were as follows:
E1- 4 inches of knife E3- Black slipper
E2- Fingerprint E4- Blood Pool
E5- Footprint
Initial Investigation conducted by responding police officers SPO4 Cardenas and
PO2 Dacillo. The identified suspects are Sulit Nico 24 years old and Roque Jerome
23 years old, Single resident of Barangay 3, Purok 6, Villanueva Misamis Oriental.
According to this victim was sitting while using a cellphone, after a few minutes
there were men walking back and forth near the victim's house, the witness said,
And it was said that while the victim was sound asleep, it was here that the
suspects tried to enter the house of the victim. Cellphone, Jewelry, Laptop and
Important equipment of the victim were taken. According to the witnesses,
Pedregosa noticed two armed men returning to the house of Ms. Llagas at 1 am.
the witness also saw the suspects entering her house and leaving carrying tools.
The CCTV footage also showed the two entering and taking equipment from the
victim's house and quickly leaving the scene .
IV. DISCUSSION/FINDINGS:
1. A witness named Rhenalyn Pedregosa, 22 years old, said that she saw
two men named Nico Sulit and Jerome Roque running at the Crime Scene.
The fingerprint and footprints that matched those of two named Sulit and
Roque seen living in crime scene and the evidence found at the crime
scene were the two actually pointed out as the suspected.
V. CONCLUSION:
7. Based on the following evidence which is fingerprint and footprint
matching the accused and the statement of the witness named Rhenalyn
Pedregosa, the office concluded that the accused Nico Sulit and Jerome
Roque committed the crime.
VI.RECOMMENDATION:
8. Due to the evidence gathered pointing to Nico Sulit and Jerome Roque
as the culprits in this case, this office recommends the filing of Republic
Act No. 373 of 1949 to amend Article 295 of the Revised Penal Code to
increase the penalty in certain cases of theft. against criminals.
