Petition dated : 27.02.2025 U/s. 482 B.N.S.S through e-filing prays to grant
anticipatory bail.
This petition is coming on this day for hearing before me, in the presence of
Thiru.N.ESAKKIRAJA, Advocate for the petitioners and
THIRU.K.SUBRAMANIAN, the Public Prosecutor for the respondent and upon
hearing both sides arguments, this court passed the following:
ORDER
The Petitioners/accused seeks anticipatory bail for the alleged offences under
Sections 420 of IPC, registered by the respondent police.

The case of the prosecution is that, this petitioners joined hands with other
accused have received Rs.1,38,000/- from the defacto-complainant for getting job at
abroad. But subsequently he failed to do the same and also refused to return the
money. Hence this case.

The learned counsel for the petitioners submitted that, petitioners have not
received any amount from the defacto-complainant. Alleged transactions were held
only between the Accused No.3 , 4 and the defacto-complainant and they have enlarged
on anticipatory bail in the year 2019 itself and the petitioners are only the introducer of
other accused to the defacto-complainant. Petitioners are in no way connected with the
offences. Prays to grant anticipatory bail to the petitioners subject to any conditions.
The learned Public Prosecutor submitted that, out of four accused this petitioners a
re Accused No.1 and 2. Final report not yet filed. Both the petitioners have involved in
each one case which were disposed now.

Records perused. On perusal of FIR, it is seen that alleged occurrence is said to


have taken place in the year 2018 and FIR h as been registered in the year 2019. But so
far petitioner is absconding. Prosecution has reported that final report not yet filed. In the
above circumstances, considering the nature of the allegations stated against the
petitioner, the amount involved in this case is not yet secured, petitioners are absconding
nearly for the past 6 years and also considering the bad antecedent of the petitioner, this
Court is not inclined to grant anticipatory bail to the petitioners/accused.

In the result, this anticipatory bail petition is dismissed.
