AFFIDAVIT-CUM-DECLARATION
I, MS. SHALINI SELVARAJ NADAR, Age 29 Years, adult,
Indian Inhabitant of Mumbai, residing at Flat No. 56, 5 th Floor,
Lourdes Apartment CHS Ltd., Opp. Orlem Church, Gautam
Buddha Marg, Orlem, Malad-West, Mumbai-400064, do hereby
solemnly affirm and state on oath as hereunder :-
1. I say that my Father SHRI. VELU SUYAMBU SELVARAJ
NADAR, was the member of Lourdes Apartment CHS Ltd., Opp.
Orlem Church, Gautam Buddha Marg, Orlem, Malad-West,
Mumbai-400064, and holding five shares of Rs. 50/- each bearing
Distinctive Numbers from 101 to 105 under Share Certificate No.
021 issued by the said Society and holding Flat No. 56,
5th Floor in the building of the said Society.
2. I say that my Father SHRI. VELU SUYAMBU SELVARAJ
NADAR, was also the member of Lourdes Apartment CHS Ltd.,
Opp. Orlem Church, Gautam Buddha Marg, Orlem, Malad-West,
Mumbai-400064, and holding five shares of Rs. 50/- each bearing
Distinctive Numbers from ___ to ___ under Share Certificate No.
____ issued by the said Society and holding Shop No. 4A, Ground
Floor in the building of the said Society.
3. I say that my Father SHRI. VELU SUYAMBU SELVARAJ
NADAR died on 22/07/20217 without making any Nomination
and died intestate, and due and diligent search has been made
for his Will, but nothing has been found.
4. I say that my late Father SHRI. VELU SUYAMBU
SELVARAJ NADAR left behind him surviving heirs and next of
kins according to Hindu Succession Act, 1956 by which he was
governed at the time of his death, the following persons with the
age and address set out against their respective names as
mentioned hereunder:

5. I say that my brother Late Mr. Satish Selvaraj Nadar
expired on 12/12/2020. I say that save and except
above, there are no other heirs left behind by my late Father
SHRI. VELU SUYAMBU SELVARAJ NADAR
6. I say that my Mother SMT. SELVI SELVARAJ NADAR had
applied to the said society to transfer the shares of the said Flat
No. 56 and Shop No. 4A standing in the name of my late
Father SHRI. VELU SUYAMBU SELVARAJ NADAR to the name of my
Mother SMT. SELVI SELVARAJ NADAR. I say that the said society
was reluctant to transfer the said Flat No. 56 and Shop No. 4A to
the name of my Mother SMT. SELVI SELVARAJ NADAR and she
was asked for a Succession Certificate from the Court of
Competent Jurisdiction.
7. I say that to get transfer the assets and properties, movable and
immovable of my late Father SHRI. VELU SUYAMBU SELVARAJ
NADAR to the name of my mother SMT. SELVI SELVARAJ NADAR,
my mother has filed a Petition in the Hon’ble High Court, Bombay for
grant of the Succession Certificate in her favour.
8. I say that the purpose of executing this Affidavit-cum-
Declaration is to record my “No Objection” of whatsoever
nature if the Hon’ble High Court, Bombay grant the Succession
Certificate in favour of my Mother SMT. SELVI SELVARAJ
NADAR in respect of the assets and properties, movable and
immovable of my Late Father SHRI. VELU SUYAMBU SELVARAJ
NADAR. I say that through this present Affidavit-cum-
Declaration, I am relinquishing and surrendering all my right,
title, claim and interest of whatsoever nature in respect of the assets
and properties, movable and immovable of my Late Father SHRI. VELU
SUYAMBU SELVARAJ NADAR in favour of my Mother SMT.

9. I have made the above statement out of my own free will
and volition and there has been no force or coercion of
whatsoever nature. I am executing this Affidavit-cum-Declaration
to be submitted by the Petitioner to the Hon’ble High Court,
Bombay.
10. I hereby state that whatever is stated herein above are true
and correct to the best of my knowledge and belief and I have
neither concealed nor misrepresented any material facts.
