Act:

(1).नवीनता / NOVELTY:
(I) ऊपर उ रत द तावेज़ के संदभ (1-24) मे िदये गए पकटन के पूवानुमान को यान मे रखते हए, िन निलिखत कारण से दावा(व ) (1-24) मे
नवीनता क कमी है /
Claim(s) (1-24) lack(s) novelty, being anticipated in view of disclosure in the document cited above under
reference D1 for the following reasons:
The references to the document are given in parentheses.
Regarding claim 1, document D1 discloses a method of generating a final network output comprising a plurality
of outputs conditioned on a network input, the method comprising: obtaining the network input; initializing a
current network output; and generating the final network output by updating the current network output at each of
a plurality of iterations, wherein each iteration corresponds to a respective noise level, and wherein the updating
comprises, at each iteration: processing a model input for the iteration comprising (i) the current network output
and (ii) the network input using a noise estimation neural network that is configured to process the model input to
generate a noise output, wherein the noise output comprises a respective noise estimate for each value in the
current network output; and updating the current network output using the noise estimate and the noise level for
the iteration (see section 4).
Thus, in view of the teachings of D1, the technical aspects as claimed in independent claim 1 are lacking the
'novelty' aspect as per Section 2(1)(j) of the Indian Patent Act 1970, as amended.
The same reasoning applies to the subject matter of the corresponding independent claims 20, 23, and 24, which
therefore are also considered not new.
Dependent claims 2-19 and 21-22 do not contain any features which, in combination with the features of the
claim to which they refer. Features of said claims are directly known from D1. Hence the subject matter of claims
1-24 is not novel.

(2).आिव कारी कदम / INVENTIVE STEP:

reference D1, D2 for the following reasons:


If novelty should be disputed based on some minor difference of interpretation, it is pointed out that the subject
matter of these claims would in any case not involve an inventive step, given that D1 attempts to solve the same
problem and describes the same type of solution as presently claimed.
Regarding claims 2-5, applying a mel spectrogram of a speech segment, with the spectrogram having been
generated by a text-to-speech model, and providing a waveform for the speech segment as the final network
output is commonly known. Therefore, the subject-matter of these dependent claims either relates to features
which are already known from the prior arts or to obvious design options which come within the scope of the
customary practice followed by persons skilled in the art.
Regarding claims 7-9, the additional features of claims 7-9 are disclosed by D2, page 4, Algorithm 2, line 4.
Regarding claims 10-11, the additional feature of claims 10 and 11 are anticipated by each of D1 (see D1, e.g.
section 4.3, first paragraph) and D2 (see D2, e.g. section 3.2 incl. line 1 of Algorithm 2) individually.
Regarding claim 12, D1 discloses the additional feature of claim 12 that "the model input for each iteration
includes the noise level corresponding to the iteration" (see D1, e.g. page 6, Algorithm 1, line 6: noise level o; for
each iteration input to the model).
Regarding claim 13, the additional feature of claim 13, according to which "the model input for each iteration
includes an aggregate noise level for the iteration generated from the noise levels corresponding to the iteration
and to any iterations after the iteration in the plurality of iterations", is apparently not disclosed or rendered
obvious by persons skilled in the art.
The dependent claims 6, 14-19, and 21-22 do not contain any additional features which, in combination with the
features of any claim to which they refer, meet the requirements of the Patent Act 1970, with respect to inventive
step. The subject-matter of these dependent claims either relates to features which are already known from the
prior arts or to obvious design options which come within the scope of the customary practice followed by
persons skilled in the art.

(3).पेटट अयो यता /NON PATENTABILITY:


(I) िन निलिखत कारण से धारा 3 के खंड (k )के पावधान के तहत दावा(वे) (1-24) सांिविधक प से पेटट यो य नह ह /
Claim(s) (1-24) are statutorily non-patentable under the provision of clause ( k ) of Section 3 for the following
reasons:
Without prejudice to objection U/S 2(1)(j), Claims 1-24 appear to fall under sub clause (k) of section 3 of the
Indian Patent Act 1970 (as amended), for falling within the scope of "software program" or “computer program per
se”. The said claims claiming a processor which comprises storage medium having a computer program
executable by the processor. Therefore, it seems that main function lies in the stored computer program which is
nothing but computer program per se which is executed in the form of an algorithm, hence it attracts section 3(k)
of the Patents Act.

(4).आिव कार क एकलता /UNITY OF INVENTION:


(I) दावा(व ) 1-24 मे आिव कार क एकलता क कमी है य िक दावे िकसी एक आिव कार या आिव कार का समूह जो िमलकर एक आिव कारी
संक पना क संरचना कर उससे संबि धत नह ह Claim(s) 1-24 lack(s) unity of invention as the claims do not relate to a
single invention or to a group of inventions linked so as to form a single inventive concept:
Claims 1-19, 23-24 relates to method of generation of final network output.
Claims 20-22 relates to method of training the noise estimation neural network.
These two set of claims donot combine to form a single general inventive concept asper Section 10(5) of the

Patents act, 1970(as amended) and hence only one set of claims shall be allowed in further prosecution.

(I) दावा(वे) 1-24 के संबंध मे प प से परीभािषत नह ह.
Claim(s) 1-24 are not clearly worded in respect of:
1. In absence of reference numerals in claims 1-24, the subject matter does not seem to be clear U/R 13(4)
and U/S 10(4) of Indian Patent Act, 1970. Hence comply with this requirement.
2. Independent and its subsequent dependent claims of the instant application should be clearly formulated
defining the correct scope of the invention, U/s 10 (4) of the Indian patent act, 1970.
3. The wording “further” should be deleted from all the claims wherever applicable because it is broadening
the scope of the claims. Hence same should be rectified U/S 10 (5) of the Indian patent act, 1970.
4. The phrase of dependent claims “of claim” should be rephrased as “as claimed in claim” for clarity.
5. The independent claims should be cast in the two-part form where appropriate, with those features known in
combination from the prior art being placed in the preamble and the remaining features being included in the
characterizing part.
6. There is the use of expressions 'any one of claims' in the dependent Claims which tends to make their
dependencies vague and unclear. The claims should be suitably re-drafted to make their respective
dependencies clearer.
7. Regarding claim 1, 20, 23, and 24, the iterative process that is performed for generating a final waveform is
considered as being central to the invention. An iterative process is however defined by: 1) initial conditions,
2) update mechanism and 3) stopping/exit condition. All of the three requirements are however missing in
claim 1, i.e. it is not specified how the waveform is initialised, it is not clear in which way the model input is
processed and it is not clear, either, at which point the iterative process stops. It goes without saying that
such an iterative process must be clearly defined so that the claimed method can credibly provide an
advantageous solution over the prior art in the whole claim breadth.
8. Moreover, claim 1 (correspondingly each of claims 20, 21, 23 and 24) is unclear, because (i) it neither allows
to understand whether - and possibly how - the network providing the "output” relates to the "noise
estimation neural network", nor whether - and possibly how - a "value in the current network output” relates
to the "plurality of outputs", and (ii) it remains unclear from the wording of the claim which of the plurality of
noise estimates (constituted by the claimed expression "a respective noise estimate for each value in the
current output”) is used for the claimed "updating the current network output using the noise estimate".
9. The two independent claims(1 and 20 ) in same category of method shall not be allowed. The claims
otherwise fall under Section 10(5) due to factor of divisionality.

(8).अ य आव यकताएँ /OTHERS REQUIREMENTS:


(I)
1. If any amendment is necessitated in the complete specification then it is required to clearly identify
(submission of marked copy) the amendments carried out and to indicate the portion (page no and line no)
of the complete specification as filed on which these amendments are based on.
2. Details regarding the search and/or examination report including claims of the application allowed, as
referred to in Rule 12(3) of the Patent Rule, 2003, in respect of same or substantially the same invention
filed in all the major Patent offices along with appropriate translation where applicable, should be submitted
within a period of six months from the date of receipt of this communication as provided under section 8(2)
of the Indian Patents Act.
