JUDICIAL AFFIDAVIT

I, RAMON A. CORDERO JR., 40 years old, born on August


17, 1984, single and resident of Block 2, Lot 267, Old San Isidro,
Buhangin, Davao City, after having been duly sworn in
accordance with law, do hereby depose and say;

That I am the same and identical person who caused for the
execution of this Judicial Affidavit under the supervision and at
the law office of the undersigned counsel with the name and
address stated below;

That I had given my answers on the questions below stated


with full consciousness, and I did so under oath, and that I may
face criminal liability for any false testimony or perjury;
That the following are the questions asked by the
undersigned counsel with corresponding answers which I had
given;

Q1: Please state your name, age, address and other personal
circumstances for the record.

A1: I am Ramon A. Cordero Jr., 40 years old, married to Ailyn


Cordero and currently residing at Block 2, Lot 267, Old San Isidro,
Buhangin, Davao City.

Q2: Why are you here now?

A2: To give my sworn statement by way of judicial affidavit, the


same to constitute as my direct testimony, in the above-
mentioned case.

(Para ihatag akong sworn statement sa pamaagi sa Judicial


Affidavit, nga mag silbing nahpamatood nako bilang testigo sa
maong kaso.)

Q3: For the record, please state the name and address of the
lawyer who is now conducting or supervising your examination
and the place where the examination is being held now?
(For the record, palihog ko paki ingon ang pangalan ug ang pinuy-
anan sa abogado na nag conduct or nag supervise sa imong
examination ug ang lugar sa kung asa mo nag examination
karon)

A3: Atty. Muhammad Monjid D. Abpi is now conducting or


supervising my examination at his office at Door 5, 3rd floor, VCS
Building, Bolton Extension, Davao City.

examination karon diri sa iyahang opisina sa Door 5, 3rd floor,
VCS Building, Bolton Extension, Davao City.)

Q4: In what language do you want your examination to be


conducted?

A4: It is okay if it is in Bisaya and English, Atty.

Q5: Do you undertake to answer the questions to be asked of


you, full conscious that you will do so under oath, and that you
may face criminal liability for false testimony or perjury?

Q7: When did you first meet the accused?

A7: I met her on May 15, 2019.

Q8: How did you know about the accused?

A8: I knew the accused through my wife, Ailyn.

Q9: I am now holding the Contract to Sell between you and the
accused, do you confirm that you signed this document?

(Gina gunitan nako karong ang Contract to Sell ninyo sa akusado,


gina kumpirma ba nimo na ikaw nag pirma ani nga dokumento?)

A9: Yes, I confirm that I signed the Contract to Sell.

Q10: What made you agree to execute and sign the Contract to
Sell?

(Unsay rason ngano ka nisugot mag execute ug mag pirma sa


Contract to Sell?)

A10: The accused offered a reasonable price for a 500 square


meter lot and assured that she is the owner of the said lot by
showing the Deed of Absolute Sale between her and the previous
owner and the Original copy of its Transfer Certificate of Title.

(Nag offer ang akusado sa akoa na mura nga presyo para sa isa
ka 500 square meter na yuta ug gi sigurado niya sa akoa na siya
ang tag-iya sa lote unya gipakita niya sa amoa na naa siyay Deed

yuta ug gipakita pud niya ang Original copy sa Transfer of
Certificate of Title)

Q13: In the Contract to Sell, why does it say that the accused
owns the five hundred (500) square meter lot?

(Sa Contract to Sell, nganong naka ingon didto na ang akusado


ang tag-iya sa 500 square meter lot?)

A13: Because the accused showed us the Deed of Absolute Sale


and the Title and assured us that she bought the property from
Aida Ramos Pinili and that she have not made the transfer to her
name yet.

(Kay gipa kita sa amoa sa akusado ang Deed of Absolute Sale ug


ang Titolo ug gi sigurado niya sa amoa na gipalit niya ang yuta
kay Aida Ramos Pinili ug wala pa niya napa transfer sa iyahang

Q14: Who caused the notarization of the Contract to Sell?

A14: It was the accused who caused the notarization of the


Contract to Sell.

Q15: Do you know the Notary Public who notarized the Contract
to Sell?

A15: No, Attorney.

Q16: Have you met the lawyer who notarized the Contract to
Sell?

Q17: When did you make the partial payment on the Contract to
Sell?

A17: I made the partial payment on May 16, 2019.

A19: I made the final payment on November 29, 2024. It was


with an Acknowledgement receipt.

Q20: What happened next?

A20: The accused offered me and my wife to buy the remaining


500 square meters with a house built on it and we agreed to buy
the house and lot with a total of 1000 square meters.

nabilin na 500 square meters na naay apil nga balay ug nag agree
mi na paliton ang tibuok house and lot na 1000 square meters.)

Q21: What was your basis for your agreement to buy the entire
1000 square meters house and lot located in Dragon Compound,
Cabantian, Davao City?

A21: The agreement was put into writing on the


Acknowledgement receipt dated November 29, 2024.

Q22: How much is the agreed total price of the entire house and
lot?

Q28: What is the reason that you did not execute the Deed of
Absolute Sale?

A28: The accused suddenly disappeared. She cannot be


contacted anymore since she is not answering our calls or
replying to our messages.

wala na niya gina tubag ang among mga tawag sa iyaha ug wala
na pud siya naga reply sa among mga mensahe.)

Q29: What other modes did you try to reach or contact the
accused?

A29: My wife contacted accused’s son, Ray Elorcha, which is his


name on his Facebook.

Q30: What did her son tell your wife?

(Unsa ang giingon sa iyahang anak sa imong assawa?)

A30: He told my wife that his mother is in Cebu, but she will be
back soon.

Q31: Did the accused come back?

A31: No, Attorney.

Q32: What happened after that?

A32: We tried to contact the accused and her son again but to no
avail.

Q33: After that, what other ways did you and the victim do to
locate the accused's whereabouts?

(Pag human ato, unsa pang mga pamaagi ang inyong gibuhat
para ma tunton ang akusado?)

A33: We tried to locate the residence of the accused but we


cannot find it. We also waited for her to come back but for 3
months, we did not hear from her.

wala mi nabalitaan.)

Q32: What did you and the victim do after not being able to
contact and locate the accused?

A32: My wife and I went to our lawyer to seek legal relief.

Q33: During the consultation with your lawyer, what happened?

A33: Our lawyer looked at the documents and had a suspicion


since he found out that Atty. Jerry Catague, the named Notary
Public, has a different Roll No. in the Contract to Sell and the
Deed of Absolute Sale.

siya kay nakit an bisto niya na lahi ang Roll number ang Notary
Public na si Atty. Jerry Catague sa Contract to Sell ug sa Deed of
Absolute Sale.)

Q34: What happened next?

A34: Our lawyer checked the IBP Archives and found out that the
Roll number of Atty. Catague was indeed different from the two
documents, and he tried contacting Atty. Jerry Catague.

Q35: What did Atty. Jerry Catague say?

A35: Atty. Catague said that it was fake and that he did not
cause the Notarization of the two documents. He even told my
lawyer that he is not a Notary Public.

siya Notary Public.)
