INSTITUTIONAL FRAMEWORKS FOR AIRCRAFT HIJACKING

International Civil Aviation Organisation (ICIAO)

An International agency finding its legitimacy in the Chicago Convention 1.The agency has is given the
mandate to develop standards and make recommendations for the aviation policies which also has to
deal with security and safety of the airlines that also provides for rules prohibiting unlawful interference
and hijacks2.The agency plays a crucial implementing the recommended principles through risk
assessments whereby it requires a state to asses the security threats and adjusts to the requirement
but also it provides technical assistance to the state incase of training and equipping them with
cabalities to assist them to fit within the required technology. In collaboration with the member states
the agency also provides information for the trends of hijacks and security threats for the states to take
required actions to prevent hijacks on aircrafts and enhance capacity building for the member states to
assist with technological advancements given that not all states have equal technology. The agency has
also been on the forefront in the establishment of other laws and International conventions regulating
security and aviation systems for example The Tokyo Convention and Hague Convention were
established with some of the recommendations from the agency.

National Aviation Authority

International law serves some privileges and opportunities for member states to deal with the issues
arising within their states regarding aviation. For instance states have the right to sue any criminal
offence within the airlines using ther domestic laws ,also the establishment of agencies responsible for
civil aviation of a particular state for example in Tanzania we have the Tanzania Civil Aviation Authority
(TCAA) which is given the mandate to deal and govern the security policies and requirements for
airlines. Also the organisation regulates the security systems and the implementation of the required
International standards. Therefore each states under their own authorities have a wider opportunity in
dealing with hijacks and the preventive measures not forgetting the implementation of the laws based
on the state incase of hijacks.
