Madam,
With reference to the Government of India, Ministry of Personnel & Training, and Pensions, Department of Personnel &
Training,.Establishment (JCA) Section F. no.7/1/2016-JCA, dated 14.11. Regarding the implementation of the awards of the Central
Board of Arbitration, I would like to draw your kind attention to the discussion held with Shri Sanjay Prashad, Additional Secretary,
Department of Expenditure, on November 23,2023.
The award dates back to 24.08.2004, i.e. 19 years have elapsed since the Central Board of Arbitration upheld the demand of
the staff side, unanimously, granting higher pay scale to the Accounts Assistants of Railway Accounts Department, Senior Auditors,
and Senior Accountants of the Organized Accounts Department, and of IA&AD. The actual anomaly arose with the grant of a higher
pay scale to the Assistants of the CSS by an order dated 31.07. 1990, giving benefits with a retrospective date of 01.01.1986. This
decision of the government has disturbed the parity in pay scale that existed hitherto between the similarly placed senior auditors
and Senior Accountant Cadres of the Organised Accounts Departments and IA&AD with the assistants of the CSS. . Therefore, 37 long
years elapsed in implementing the award to resolve anomalies that arose out of decisions taken by the government in respect of the
grant of higher pay scales to Assistants of the CSS, ignoring the recommendations of successive Central Pay Commissions from the
Fourth CPC to the Seventh CPC with respect to the placement of Senior Auditors/ Senior Accountants in the same pay scales.
During our discussion with the aforementioned authorities, we were requested to submit a comparative statement of the
table of pay scales showing the pay scales of the cadres of IA&AD and Organised Accounts Departments vis-aa-vis the CSS cadres. This
Confederation has prepared the same with utmost precision. I, on behalf of the Confederation, submit the statement for your kind
consideration.
According to Article 22 of the Constitution of the JCM (NC), the implementation of the award (CA Ref. No.3/2001) reached finality
on 24.09.2007. This Confederation approached the Government vide letter dated 15 th September 2022,addressed to the Cabinet
Secretary, for implementation of the decision of the Hon’ble Delhi High Court judgment in the case of WP© 2981/2021. This
Confederation authorized the Leader of the Staff Side to negotiate with the Government and settle it. Accordingly, in the meeting of
the representatives of the Staff Side,JCM (NC) with the Additional Secretary, DOPT, dated 12.10.2023, it was decided that the award
(CA Ref. No. 3/2001) shall be implemented in the following manners:-
1. The award shall be implemented notionally w.e.f. 01.01.1986 and the actual payment shall be made from 01.01.2016. The
Staff side agreed to forego arrears from 12.11.2001 to 31. 12. 2015.
2. The award shall be implemented maintaining vertical relativity with the higher cadres.
This Confederation has prepared the enclosed statement in accordance with the decisions made at the meeting dated 12.10
2023.
The audit and accounts employees and officers are eagerly awaiting your expedited decisions. On behalf of this Confederation,

*Upgraded the pay scale of Assistants of CSS from 5500-9000 to 6500-10500 vide OM 20/29/2006-CS II, Dtd.25 -09-
2006 of DoPT, effective from 15-09-2006 under 5th CPC. Pay fixation benefits under 6th CPC were allowed, taking into
account the pre-revised scale of 6500-10500, thereby granting Grade Pay of 4600 under 6th CPC and consequential
benefit of Matrix Level – 7 under 7th CPC.
Remarks: The above-mentioned benefits allowed in the case of Assistant Section Officer in CSS (Erstwhile designation:
Assistant Grade) should be extended to the Sr. Accountants/Sr. Auditors/ Accounts Assistants of the Organised
Accounts Departments and IA&AD to maintain parity.

Remarks: As this post has been created in IAAD (under 7th CPC pay scale) for professional requirements, granting of

upgraded to the next higher level in pay matrix, i.e. (Rs.47,600 – 1,51,100) in Level -8 to maintain vertical relativity…

Remarks: The pay scales of SOs and AAOs in Organised Accounts Departments& IA&AD need to be upgraded at each
stage of the three CPCs mentioned above, as was done in the case of SOs of CSS, to maintain vertical relativity of
promotional hierarchy and horizontal relativities within the benefits granted to them (SOs of CSS) under different
Government Orders as well as CPCs’ Recommendations.

Remarks : The pay scales of the Selection Grade Assistant Accounts Officer (Rlys)/ Senior Accounts
Officer/ Sr. Audit Officer need to be upgraded and placed at par with the pay scales of the posts of the
Deputy Secretary in the CSS for reasons that the duties and responsibilities attached to these posts are
of a higher professional nature. Moreover, the Senior Audit Officers are entrusted with the duties and
responsibilities of a quasi-judicial nature.
