AGREEMENT FOR
THIS AGREEMENT made at DAR ES SALAAM this 30 th day of December 1997
between GETRUDE KITABURAZA and DIGNA BYABATO of P. O. Box 4076 Dar
es salaam (hereinafter called the Vendors) of the ONE PART, and Mr. TONY NALEO
of P. O. Box 23195 Dar es salaam (hereinafter called the Purchaser) of the OTHER
PART.
WHEREAS the Vendors are the joint offerees of the parcel of land located at Plot No 104
Block “J” Mbezi High Density in Kinondoni District Dar es salaam more particularly
described in an offer letter reference No D/KN/A/31057/4/MHKH issued by the District
Land Office and dated 6/11/1989;
AND WHEREAS the Vendors have agreed to sell the said property for a consideration of
Tshs 3,000,000.00 (three million) out of which the Purchaser has paid a sum of Tshs
2,000,000.00 (two million) as part payment of the purchase price and in order to enable
the Vendor process transfer and change of name in respect of the Offer for the said Plot;
AND WHEREAS the Vendors and the Purchaser mutually agree that payment of the
balance of purchase price will be made upon the Vendor completing the transfer
documentation process and handing over the same in the Purchaser’s name;
NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:
1. The Vendor shall sell and the Purchaser shall purchase the three bedroom unfinished
building structure located on the Plot above specified for a total purchase price of
Tshs 3,000,000.00 (three million).
2. The Vendor shall process the said transfer of Offer and upon payment of the balance
of purchase price shall hand over all title documents duly endorsed and issued in
the purchaser’s name to the Purchaser.
3. The Purchaser shall pay the balance of Tshs 1,000,000.00 upon being given transfer
documents in his name on Plot No 104 Block “J” Mbezi High Density.
IN WITNESS WHEREOF the parties aforementioned have executed this Agreement in
triplicate on the day, month and year first above written.
