Expression of Interest (EOI) for Empanelment of Construction Material
Testing Laboratories

Madhya Pradesh Lok Nirman Vibhag (MPPWD) invites Expression of Interest (EOI) from
Const4uction Material Testing Laboratories for empanelment in the department.

Eligibility Criteria: ,.

1. The laboratory must have valid accreditation from NABL or any other accreditation body
that operates in accordance with ISO/IEC-17011 and accredits laboratories as per
ISO/IEC-17025 for testing and calibration.
2. The empan"i-bnt shall be-for two year, which may be renewed annually upon payment
of the prescribed renewal fee.

Application Fee:

Validity & Renewal:

. Empanelment shall be valid for Two years.

. Renewal can be done after Two years upon payment of t10,000/- renewal fee.

 SECTION – I
BRIEF DESCRIPTION

1.1 INTRODUCTION

Madya Pradesh Public Works Department, a STATE govt. Agency for Execution
of Public works Through the professional expertise in disciplines including
Architecture, Engineering, and Project Management coupled with
comprehensive experience in Road, Bridge & building construction and
maintenance. MP PWD has been serving the State and has executed priority of
works in difficult and demanding geographical and climatic conditions. It is a
comprehensive construction management department, which provides services
from project concept to completion, consultancy and maintenance management.

It is headed by E in C, who is also Head of the Department, The Zones and The
Circles are headed by Chief Engineer and Superintending Engineer
respectively.

MPPWD has ability to undertake construction of complex projects even in

difficult terrain and maintenance in post construction stage.

 NOTICE OF EXPRESSION OF INTEREST (EOI)
Expression of Interest (EOI) is invited for Empanelment of
Construction Material Testing Laboratories for testing of various
materials involved in the construction of works under MP PWD.
EOI IS PUBLISHED IN MPPWD WEBSITE THROUGHOUT THE YEAR.

1. Expression of Interest (EOI) is invited for empanelment in MPPWD, for

different Region in Madhya Pradesh from the interested Construction
Material Testing Laboratories having valid accreditation from National
Accreditation Board for Testing and Calibration Laboratories (NABL) or any
other accreditation body which operates in accordance with ISO/IEC-17011 and
accredits Labs as per ISO/IEC-17025 for testing and calibration scopes, Bureau
of Indian Standards (BIS), IRC or any other Standards as applicable Approved.
The detailed credentials, information about infrastructure, work handling
capacity, accreditations, empanelment in other Government & Semi
Government Organizations are to be furnished with documentary proof. The
empanelment shall be done strictly on merits amongst the applicant
laboratories fulfilling the terms & conditions.
2. Performance of the tests / analysis strictly in accordance with the recognized
parameters of standards and delivery of test / analysis reports in time and
consistency of the analysis results is the most important factor to be adhered to by
the Empanelled Laboratories.
3. The period of empanelment shall be for two yeasr from the date specified in the
Letter of Empanelment andcan be revalidated for next two years
after evaluation of performance and payment of requisite fee. The
empanelment shall be applicable for the entire jurisdiction of the Engineer In Chief
(B&R)

 1.2 INTENT OF INVITATION OF EXPRESSION OF INTEREST (EOI):

The purpose of EOI is to empanel Construction Material Testing Laboratories for testing
of various materials involved in the construction of works for MPPWD.
1.3 INSTRUCTIONS TO THE APPLICANTS
The EOI is to be submitted alongwith the prescribed fee through speed post or by self in
sealed envelope. The envelope superscripted as “EMPANELMENT OF
CONSTRUCTION MATERIAL TESTING LABORATORIES” should be duly sealed and
delivered at the following address:

Envelope shall contain the followings:

1) Letter of Transmittal (ANNEXURE -A) and demand draft of fee.

2) Letter of EOI as per Performa given in this document at (ANNEXURE-I) duly

signed and stamped by the authorized representative.

3) Brief profile of the applicant stating the following:-

a. An applicant may be a neutral person, private entity, government-owned entity, or any

combination of them with a formal intent to enter in to an agreement. Details of Testing
Laboratory on the format placed at (ANNEXURE- II) duly signed and stamped by
the owner(s)/ authorized representative.

4) Annual Turnover Statement with Profit/ Loss Statement on the format placed at
(ANNEXURE-III) duly certified by the Auditor/Chartered Accountant(CA).

5) Declaration on the format placed at (ANNEXURE-IV).

6) Details of Testing and Analysis of Construction Materials for Government

Department during last three years on the format placed at (ANNEXURE-V).

7) Check list of Documents on the format placed at (ANNEXURE-VI).

8) Complete EOI Document as downloaded from website, Corrigendum /Addendum, if

any, duly filled in, signed and stamped on each page by applicant.

9) Copy of power of attorney/ partnership deed/ Board resolution, duly attested by

Notary Public Authorizing the person who signs &submit the EOI.

10) Any other information as required to be submitted along with the EOI.

11) Documents as per check list (ANNEXURE–VI).

1.4 GENERAL CONDITIONS:
1. MPPWD shall not be responsible for any postal or other delays/lapses and
applicant should take care to ensure the submission of EOIs.
2. All alterations, erasure(s) & or over-writings, if any, should be duly authenticated by
the person signing the EOI.
3. All Performa forming part of EOI documents must be duly filled- in, signed and
stamped by the applicant.
4. Applicant who has any query/clarification about this proposal may send their
queries through e-maili- pwdbhop@mp.nic.in.
5. EOI shall be valid for two years.
6. Mere submission of offers/EOIs will not be treated as acceptance/selection of the
offer. The laboratories will be selected based on evaluation of offers considering
various factors as mentioned in the technical information/criteria of evaluation.
7. The empanelment shall be done for two (02) years. However, MPPWD reserves
the right to review any time the empaneled laboratory subject to fulfillment of the
facilities and requirements stated in the EOI. The empanelment of such laboratory
may be revoked in case of any breach.
8. MPPWD reserves the right to accept or reject any or all the submitted Expression of
Interest without assigning any reasons.

1.5 CRITERIA FOR EMPANELMENT OF CONSTRUCTION MATERIAL LABORATORIES:

The following criteria, with or without modifications, shall be adopted for Inspection for
Empanelment of Construction Material Laboratories:
a) Construction Material Testing Laboratories having valid accreditation from
National Accreditation Board for Testing and Calibration Laboratories (NABL) or
any other accreditation body which operates in accordance with ISO/IEC-17011
and accredits Labs as per ISO/IEC-17025 for testing and calibration,

 scopes, Bureau of Indian Standards (BIS) Approved, will only be considered for
extensive scrutiny & inspection.
b) The laboratories shall have valid Approval/accreditation for at least 6 months.
c) The laboratory should not have been black listed in last five years valid as on the
last date of submission of EOI by any Govt Department.
d) The laboratory must have witness facility (physically or digitally) for testing of any
construction material any time.
e) The laboratory must have facility of online tracking of sample sent for testing by
the department (From sample collection to generation of report).
f) The laboratory shall have average annual turnover from material testing works
only, not less than 100 lakhs and shall be in profit after taxes for last three
consecutive years.
g) The laboratory must have under taken testing and analysis of construction
Successfully for at least One Government Departments/Body
materials
for more than three years from the last date of submission of EOI.

h) MPPWD reserves the right to accept or reject any or all the EOIs or annul this
process at any time without assigning any reason what so ever.

1.6 THE INSPECTION OF TESTING FACILITIES OF LABORATORY

a) Inspection of the testing facility will be at the discretion of the EOI Inviting
Authority. Such inspection may be at any stage before or after empanelment.
b) All the testing facility in the lab will be subjected to inspection / auditing. The applicant
will have to provide necessary arrangements to conduct the inspection of all the
sections and failure to co-operate with the inspection in showing the different
facilities, will lead to disqualification. Entry to all the areas of lab for testing shall
be facilitated.
c) The recommendations of the Inspection team will not be communicated to the
applicant.
d) The availability of technical experts, analytical facility as claimed in the EOI offer
along with the compliance of standard operating procedures adapted for each
procedure including validation and valid calibration of testing equipments, shall
be evaluated by the team for considering the eligibility of the lab. Claims of
holding the valid accreditation by NABL or any other accreditation body which
operates in accordance with ISO/IEC-17011 and accredits Labs as per ISO/IEC-
17025 for testing and calibration scopes, Bureau of Indian Standards (BIS)
Approved, will not be of any avail, if the procedures or if the available facility are
not in proper condition or if contraventions of accreditation bodynorms/scope are
observed at the time of inspection. In the event of failure to facilitate inspection,
obstruction to carry out the inspection, non-cooperation during the inspection,
failure to furnish any record needed for verification etc., and the EOI offer will
automatically be rejected.
e) All testing equipment/instruments shall be calibrated/maintained at fixed intervals
through authenticated service providers during the approval period.
f) The Lab shall remain open to inspections by authorized

 representative of MPPWD as and when required, with or without prior intimation.
The Lab shall allow witnessing of testing by the PWD Engineers or their
authorized representatives. Video recording of testing of materials shall be done,
whenever required.
g) The laboratories shall retain the balance material after testing for at least thirty
days from date of report sent to the department.

h) On receiving of samples, the Lab shall perform the tests within prescribed period
as per MPPWD Specifications/BIS or other relevant codes/standards and shall
submit the test results/reports within three days of conducting test.

i) The lab shall report the acknowledgement of receipt of sample on same day via
e-mail at official email ID of concerned AE/EE/SE/CE and Contractor. Soft copy
in PDF format of Test Report shall be sent to the official email IDs of the
concerned offices on the date of issue of Test Report as well as hard copy in
original to the Engineer-in-charge of the work and Contractor.

j) It is understood that, to assess the correctness of the test results, laboratory

samples at random, may also be sent to the Government lab for testing and if
any variation is found, the results would be informed to the concerned laboratory.
If there is any gross variation in the analytical reports furnished by the concerned
laboratories (either pass or fail) with that of a Government Lab on three occasions
in a period of one year, the concerned laboratory may be debarred for a period
of two years.
k) It is understood that approved lab is liable to be debarred for a minimum period
of one year in case any adverse remarks are received against the laboratory or
repeated delays in issue of test reports for more than 7 days, are reported by the
Executive Engineer to the approval authority.
l) Copy of one full set of the EOI offer should be made available at the time of
inspection.
m) Originals of all the documents submitted in the EOI offer should be produced for
verification by the inspection team. Failure to produce of the original document
will result in the rejection of the offer.

1.7 CORRUPT OR FRAUDULENT PRACTICES

It is required by all applicants/ empanelled laboratory to observe the highest
standard of ethics during the process. In pursuance of this policy, the MPPWD
defines, for the purpose of this provision, the terms set forth below as follows:-
a) “Corrupt practices” means the offering, giving receiving or soliciting of anything of
value to influence the action of a public official in the Quality control process or in
execution and operation; and
b) “Fraudulent practices” means a misrepresentation of facts in order to influence
empanelment process to the detriments of the M P PWD and includes collusive
practice among applicants (prior to or after EOI submission).Such other acts termed
as fraudulent practices elsewhere in this document or any act to deceive the
PWD or any of its employees or any act adversely affecting or calculated to affect
the normal/proper function or activities of the MPPWD such as delaying of reports,
furnishing of incomplete reports etc. shall also be deemed as fraudulent practices.
c) No applicant shall contact M P PWD or any of his officers on any matter relating
to its offer to influence the selection process for empanelment. Any such actshall
also constitute a fraudulent / corrupt practice and would result in rejection of the EOI
offer.

 d) If it is revealed that the Laboratory is involved in any form of fraud and collusion,
the laboratory will be blacklisted for a period of 5 years. The applicant shall also
be liable for action under criminal law and the matter will be notified to the NABL
or other accreditation body, Competent Authority for penal action against them.

1.8 CONFLICT OF INTEREST

An applicant or any of its constituents shall not have conflict of interest. All
applicants found to have a conflict of interest shall be disqualified. An applicant shall
be considered to be in a conflict of interest with one or more parties in this
process ,if, including but not limited to:
(a) They have controlling share holders in common; or
(b) They receive or have received any director in direct subsidy from any of
them; or
(c) They have the same legal representative for purposes of this EOI; or
(d) they have a business relationship with each other, directly or through
common third parties, that puts them in a position to have access to
information about or influence on the EOI of another applicant, or
(e) an applicant cannot participate as a single entity or as a partner of JV in
more than one EOI in this process. Participation by an application more
than one EOI will result in the disqualification of all EOIs in which the
partner is involved. Also, an applicant cannot be a sub-contractor to
another applicant. However, this does not limit the inclusion of the same
subcontractor in more than one EOI;

1.9 LANGUAGE OF EOI

The EOI, as well as all correspondence and documents relating to the EOI
exchanged by the Applicant and the Employer, shall be written in English.
Supporting documents and printed literature that are part of the EOI may be in
another language provided they are accompanied by an accurate and
authenticated translation of the relevant passages in English in which case, for
the purposes of interpretation of the EOI, such translation shall govern. In case
the documents are in foreign language or Indian Language other than English,
a translation of the same by an authorized translator shall be submitted.

1.10 CLARIFICATION OF EOI

To assist in the examination, evaluation and comparison of the EOIs, the

Employer may, at its discretion, ask any Applicant for a clarification of its EOI.
Any clarification submitted by an Applicant that is not in response to a request
by the Employer shall not be considered. The Employer’s request for
clarification and the response shall be in writing and delivered to concerned
applicants. The due date and time to response these queries will also be
communicated.

The applicant shall respond to the queries. If a Applicant does not provide
clarifications of its bid by the date and time set in the Employer’s request for
clarification, their application shall be evaluated as per the available information
in the submitted EOI.

1.11 NOTIFICATION OF EMPANELMENT

The Employer shall notify the successful applicant, in writing, that its EOI has
been accepted by the Employer. Such notification (hereinafter called the “Letter
of Empanelment”). The Letter of Empanelment shall be issued by the Engineer
-in-Chief, MPPWD Bhopal. The successful applicant can also down load the
same.

1.12 CONFIDENTIALITY

a) Information relating to the examination & evaluation of EOIs and

recommendation shall not be disclosed to applicants or any other persons not
officially concerned with such process until information on Empanelment is
communicated to all Applicants.
b) Any attempt by an Applicant to influence the Employer in the examination and
evaluation of the EOIs or decisions shall result in the rejection of its EOI.

1.13 WITHDRAWAL, SUBSTITUTION AND MODIFICATION OF EOIs

a) An applicant may withdraw, substitute, or modify its EOI Document by making

application in this regard before the notification of Empanelment to E-in-C,
MPPWD.
b) EOI once requested to withdraw shall not be allowed to be resubmitted.
c) No EOI may be withdrawn, substituted, or modified in the interval between the
notification of Empanelment and the expiration of the period of EOI validity or any
extension thereof, if any.

1.14 Submission of EOIs

Submission of EOIs shall be open throughout the year.

a) I/We have downloaded the document for submission of EOI for Empanelment of
Construction Material Testing Laboratories from the official website of MPPWD.I/We
hereby unconditionally accept the EOI conditions in its entirety for the Empanelment
of Construction Material Testing Laboratories. I/We understand that MPPWD
intends to Empanel Construction Material Testing Laboratories for Construction of
works for MPPWD after due diligence of the offer & related documents in the manner
MPPWD may deem fit.
b) The contents of EOI document (Instructions to Applicant) have been noted wherein it is

permissible to put any remark(s)/condition(s) in the EOI enclosed in the respective

c) In case any provision of the EOI document is found violated at any time after

collusive, or coercive practices in competing for the empanelment and will sanction a
party or its successor, including declaring ineligible, either indefinitely or for as
tasted period of time, to participate in Employer’s activities;
h) We are not participating, as an applicant, in more than one EOI in this process;
However, an applicant can submit separate EOI for empanelment of Laboratory in
Madhya Pradesh.
i) We declare that we are not liable to be disqualified in Accordance with Clause
1.5(c), and we undertake that “I/We have not been Blacklisted/ banned for business
dealings with any govt.department at any time and/or no such blacklisting is in
force as on the dead line for submission of EOI".
j) We declare and confirm that in the submission of this EOI, no agent, middle man or
any intermediary has been, or will be engaged to provide any services or any other
item of work related to the empanelment and testing. We acknowledge the right of
the Employer, if he finds to the contrary, to declare our EOI to be noncompliant and
if the empanelment has been issued, to declare the empanelment null and void.
