BHR 4402: LABOUR LAWS

Course Purpose: To equip the students with the legal knowledge relating to employees
Expected Learning Outcomes
By the end of this course, students should be able to:
i. Familiarize with all the relevant enactments, legislations and regulation pertaining to
Labour Relations in Kenya
ii. explain the legal principles governing employment relationship both at the individual
and collective level.
iii. Evaluate the practical problems inherent in the implementation of labour statues in
Kenya.
iv. Solve labour disputes while taking into consideration economic and legal contexts.
Content
Introduction to Labour Law and relation: definition, scope and sources, functions. Statutory
legislation governing the employment relationship: the role of regulatory legislation in the
employment relationship, the scope of regulatory legislation in Kenya, analysis of the new
constitution provisions relation to labour, analysis of the employment act, Cap 226, analysis
of the regulation of wages and conditions of employment Act, Cap 229; minimum wage
legislation, analysis of the labour relations Bill 2007, review of the aforesaid Acts & any
other governing employment relationship. The Kenya industrial relations charter: the genesis
of the Kenya industrial relations charter, provisions of the charter, the theory of collective
bargaining, the legal status and effect of collective bargaining. Union recognition and
employee safety: the right to organize and freedom of association, the role of trade union
unions in the management of labour, status of occupational health and safety in Kenya, legal
notice No. 30 of 2004. International dimensions of labour regulations: the role of
international labour organization (ILO), the implementation of ILO conventions and
recommendations. Contemporary cross cutting issues in labour law; strikes and the law: the
freedom to strike, the legality and illegality of industrial action (strike), effect of industrial
action on the contract of employment. Minimum wage legislation in Kenya: 2011 proposal
and its legal reality.
