Terms and Conditions of Use
The District of Columbia Department of Energy & Environment (DOEE), in partnership with the U.S. Department of Energy, the Northeast Energy Efficiency Partnership, and Clearly Energy, have created the Building Energy Analysis Manager (BEAM) Owner Portal application ("application" or "software"). This software allows building owners to view, and give stakeholders access to, data submitted by the owner of each building under the District's Building Energy Benchmarking Program and Building Energy Performance Standard (BEPS) Program. All data viewable through this portal has already been submitted to comply with the District's Green Building Requirements set forth at D.C. Code §§ 6-1451.01-.11, the District's BEPS Program requirements set forth at D.C. Code § 8-1772.21, and the associated regulations. Use of this application does not relieve a building owner user of any of its responsibilities under these laws and regulations.
In addition to compliance with all applicable laws, your access to and use of the application is subject to the following terms and conditions. By accessing, browsing, and using the application, you affirm your acceptance of these Terms and Conditions of Use without limitation or qualification.
Modification of the Agreement: The District maintains the right to modify these Terms and Conditions of Use and may do so by posting notice of such modification on this page. Any modification is effective immediately upon posting unless otherwise stated. Your continued use of the application following the posting of any modification signifies your acceptance of any and all modifications. You should periodically visit this page to review the current Terms and Conditions of Use of this application.
Freedom of Information Act: Information and data you transfer to the District through this BEAM Owner Portal, including that which is stored in an electronic format, is considered a public record under the District's Freedom of Information Act (FOIA) (see D.C. Code §§ 2-531-539). Under FOIA, any person has the right to request access to records. All public bodies of the District government are required to disclose public records, except for those records or portions of records that are protected from disclosure by the exemptions authorized by FOIA. Exemptions include trade secrets and commercial or financial information, and information of a personal nature (see D.C. Code § 2-534(a)).
Disclaimer of Warranty: This software is provided by the copyright holders and contributors "as is" and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall the copyright owner or contributors be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, even if advised of the possibility of such damage. Information and data transferred under this agreement is at your request and on your behalf. Each user expressly acknowledges that the use of the application and its contents is at the user's sole risk. The District of Columbia will not be liable for any damages or injury (including but not limited to special or consequential damages) that may result from the use or inability to use any part of the application or from anything submitted or posted by users. These terms will survive any termination of this agreement.
