When Interest Becomes Void: UAE Court of Cassation Reinforces the True Nature of Murabaha in Islamic Finance In a landmark judgment (No. 9/2025), the UAE Court of Cassation reaffirmed a cornerstone of Islamic finance — Murabaha is a sale, not a loan. This decision clarifies that any clause imposing late payment interest or additional returns in Murabaha contracts is null and void, even if both parties consent. The Court drew a firm distinction between interest and compensation, underscoring that renaming interest does not change its legal character.
