Given that (1) a recipient can choose to comply to one or the other license (2) The BSD license is very permissive (3) The BSD license gives all the permissions given by the Ruby license (and some more) with less restrictions I don't see why a recipient would choose to comply to the Ruby license instead of the BSD license. Therefore, I think that the Ruby license should be dropped completely, which has the immediate advantage of making it easier for legal departements to understand the Ruby licensing situation.
