𝗥𝗲𝘃𝗶𝘀𝗶𝗼𝗻 𝗼𝗳 𝗙𝗜𝗡𝗠𝗔𝗦𝗔 𝗶𝗻 𝗦𝘄𝗶𝘁𝘇𝗲𝗿𝗹𝗮𝗻𝗱: 𝗦𝘁𝗿𝗲𝗻𝗴𝘁𝗵𝗲𝗻𝗶𝗻𝗴 𝗜𝗻𝘁𝗲𝗿𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗖𝗼𝗼𝗽𝗲𝗿𝗮𝘁𝗶𝗼𝗻 On 12 September 2025, the Swiss Federal Council adopted the draft 𝗙𝗶𝗻𝗮𝗻𝗰𝗶𝗮𝗹 𝗠𝗮𝗿𝗸𝗲𝘁 𝗦𝘂𝗽𝗲𝗿𝘃𝗶𝘀𝗶𝗼𝗻 𝗔𝗰𝘁 (𝗙𝗜𝗡𝗠𝗔𝗦𝗔) revision, aimed at modernising the Swiss legal framework applicable to international cooperation.   Key measures include: - Clarifying rules for 𝗱𝗶𝗿𝗲𝗰𝘁 𝘁𝗿𝗮𝗻𝘀𝗺𝗶𝘀𝘀𝗶𝗼𝗻 𝗼𝗳 𝗶𝗻𝗳𝗼𝗿𝗺𝗮𝘁𝗶𝗼𝗻 by supervised institutions to foreign authorities. - Revising 𝗮𝗱𝗺𝗶𝗻𝗶𝘀𝘁𝗿𝗮𝘁𝗶𝘃𝗲 𝗮𝘀𝘀𝗶𝘀𝘁𝗮𝗻𝗰𝗲 𝗽𝗿𝗼𝗰𝗲𝗱𝘂𝗿𝗲𝘀, particularly for insider trading and market manipulation cases. - Enabling FINMA to authorise 𝗱𝗶𝗿𝗲𝗰𝘁 𝗮𝘂𝗱𝗶𝘁𝘀, including of non-regulated service providers, in the context of international supervision.   This reform highlights Switzerland’s commitment to enhancing international recognition of its regulatory framework and ensuring the competitiveness of its financial centre globally.   𝗥𝗲𝗮𝗱 𝘁𝗵𝗲 𝗳𝘂𝗹𝗹 𝗮𝗿𝘁𝗶𝗰𝗹𝗲 𝗯𝘆 𝗗𝗿 Vaïk Müller 𝗵𝗲𝗿𝗲: https://lnkd.in/ef7Pm-jp   #FINMASA #SwissFinance #FINMA #FinancialRegulation #CrossBorderCooperation #FinancialCompliance #CMSLaw

𝗦𝘂𝘀𝘁𝗮𝗶𝗻𝗮𝗯𝗶𝗹𝗶𝘁𝘆 𝗠𝗼𝗻𝘁𝗵 𝗯𝗲𝗶 𝗖𝗠𝗦 𝗦𝗰𝗵𝘄𝗲𝗶𝘇: 𝗨𝗻𝘀𝗲𝗿 𝗩𝗼𝗹𝘂𝗻𝘁𝗲𝗲𝗿𝗶𝗻𝗴-𝗘𝗶𝗻𝘀𝗮𝘁𝘇 Diese Woche engagierte sich CMS Schweiz bei einem Volunteering-Einsatz auf dem Bauernhof der 𝗦𝘁𝗶𝗳𝘁𝘂𝗻𝗴 𝗣𝘂𝘂𝗿𝗲𝗵𝗲𝗶𝗺𝗲𝘁 𝗕𝗿𝗼𝘁𝗰𝗵𝗼𝗿𝗯 in Stallikon. Die Stiftung bietet Menschen in herausfordernden Lebenssituationen individuell begleitetes Wohnen und Arbeiten auf einem biologisch geführten Bauernhof und gibt ihnen so wieder Halt und Perspektive. An drei Tagen tauschten wir unser Büro gegen frische Landluft und packten im Garten, in der Küche und in der Landwirtschaft mit an. So erhielten wir direkte Einblicke in die vielseitige Arbeit der Stiftung. Der Einsatz unterstreicht nicht nur die Bedeutung gesellschaftlichen Engagements, sondern stärkte auch den Zusammenhalt innerhalb unseres Teams. 𝗦𝘄𝗶𝘁𝘇𝗲𝗿𝗹𝗮𝗻𝗱 𝗶𝗻𝘁𝗿𝗼𝗱𝘂𝗰𝗲𝘀 𝗮 𝗰𝗲𝗻𝘁𝗿𝗮𝗹𝗶𝘇𝗲𝗱 𝗨𝗕𝗢 𝗿𝗲𝗴𝗶𝘀𝘁𝗲𝗿 With the Federal Act on the Transparency of Legal Entities, Switzerland is introducing a centralized UBO register to which companies must report their beneficial owners in the future. The new law contains comprehensive obligations for companies, shareholders and beneficial owners, and provides for short implementation deadlines and possible sanctions in case of violations. Last week, we had the pleasure of hosting a 𝗵𝘆𝗯𝗿𝗶𝗱 𝗿𝗼𝘂𝗻𝗱𝘁𝗮𝗯𝗹𝗲 𝗮𝘁 𝗖𝗠𝗦 𝗦𝘄𝗶𝘁𝘇𝗲𝗿𝗹𝗮𝗻𝗱 to launch the Compliance and Policy Center of the Blockchain Lawyers Forum together with the Chapter Head Delphine F. Joined by leading experts, we discussed pressing regulatory developments and the challenges posed by 𝗗𝗢𝗥𝗔, 𝘀𝘁𝗮𝗯𝗹𝗲𝗰𝗼𝗶𝗻𝘀, and broader compliance and risk management issues.   Special thanks go to our Tina Rebecca Balzli for welcoming the participants on behalf of CMS Switzerland and for leading the discussion on Digital Operational Resilience (#DORA) & Cybersecurity + FINMA Practice, as well as to Hanna Khrystianovych, Lena Klaaßen, Laetitia Lehmann, LL.M, Katie Richards MPhil, MSc, FRM, RAI, Dr. Mattia L.
