Welcome to DigiWomen, a Laval-based non-profit organization dedicated to transforming the digital landscape through the empowerment and inclusion of women. Empowering women to take the reins of technology is at the heart of our mission. Join a movement of ambitious women who are closing the gender gap in technology through training, mentoring and an engaged community. These Terms of Use (“Terms”) govern your use of the DigiWomen website, platform, programs, services and resources (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

Prevalent French version
In accordance with the Charter of the French Language and Bill 96, these Conditions are provided in French as a priority. All communications and documents are available in French first. In the event of a conflict between the English and French versions, the French version shall prevail. If you have requested an English version, it is provided as a convenience only, and you may express your explicit wish to be bound only by a version in another language after reviewing the French version.

Applicability of the Consumer Protection Act
Notwithstanding anything to the contrary, nothing in these Terms limits your rights under the Consumer Protection Act (Quebec), if applicable. DigiWomen, as a non-profit organization, primarily provides free or low-cost services as part of its mission to empower women in technology, but certain provisions of the law may apply to our interactions.

  1. Acceptance of Terms
    1.1. By accessing or using our Services, you acknowledge that you have read, understood and agree to be bound by these Terms, as well as our Privacy Policy.

1.2. If you are accessing or using our Services on behalf of an organization, you represent and warrant that you have the authority to bind such organization to these Terms.

1.3. DigiWomen reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Web site. Your continued use of our Services after any changes constitutes your acceptance of those changes.

  1. User accounts
    2.1. Certain parts of our Services require registration and the creation of a user account. When registering, you agree to provide accurate, current and complete information.

2.2. You are responsible for maintaining the confidentiality of your account information and all activities that occur under your account.

2.3. You agree to immediately notify DigiWomen of any unauthorized use of your account or any other breach of security.

2.4. DigiWomen reserves the right to terminate or suspend your account at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, DigiWomen, third parties, or for any other reason.

  1. User conduct
    3.1. You agree to use our Services only for lawful purposes and in accordance with these Terms.

3.2. You agree not to :

  • Use the Services in a manner that violates any applicable federal, provincial, local or international law or regulation;
  • Engage in any conduct that restricts or inhibits any other person from using or enjoying the Services;
  • Use the Services to harass, abuse or harm another person, or to distribute defamatory, obscene or discriminatory content;
  • Attempt to gain unauthorized access to any part of the Services or to any system or network connected to the Services;
  • Use any robot, spider or other automatic device to access or manipulate the Services;
  • Introduce viruses, Trojan horses, worms or any other malicious or technologically harmful material.
  1. Content
    4.1. Our Services may allow you to post, submit or share content, including but not limited to text, images, videos and comments (“User Content”).

4.2. By posting User Content, you grant DigiWomen a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display and distribute such content in connection with the Services and DigiWomen’s mission.

4.3. You represent and warrant that :

  • You own or have the necessary rights to the User Content you publish;
  • User Content does not infringe the rights of any third party, including intellectual property rights and privacy rights;
  • The User Content does not contain any defamatory, obscene or otherwise objectionable material.

4.4. DigiWomen reserves the right to remove any User Content at our sole discretion and without notice.

4.5. Consent for the collection and use of User Content must be clear, free and informed, presented separately from any other information, and obtained each time data is collected. For minors under the age of 14, parental consent is required, unless the collection is clearly to the minor’s advantage. You can easily withdraw your consent at any time by contacting us.

  1. Programs and events
    5.1. DigiWomen offers various programs, workshops, events and networking opportunities, including J’ose la Tech, Women Tech Talk and Académie TechMoms. Participation in these activities may be subject to additional terms, conditions and eligibility requirements.

5.2. DigiWomen reserves the right to modify, postpone or cancel any program or event at our discretion.

5.3. You understand that some programs may include assessment components and that completion or certification may depend on meeting specific requirements.

5.4. Programs such as J’ose la Tech or Académie TechMoms respect standards of equity and inclusion, with accommodations for specific needs (e.g. accessibility, diversity). All cancellations will be communicated at least 30 days in advance, whenever possible, to support our community’s commitment to training and mentoring.

  1. Intellectual Property
    6.1. The Services and all of their content, features and functionality, including, without limitation, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations and software, are the property of DigiWomen, its licensors or other suppliers and are protected by Canadian and international copyright, trademark and other intellectual property laws.

6.2. These Terms do not grant you any right, title or interest in or to the Services or our Content.

6.3. The DigiWomen name, logo and all related names, logos, product and service names, designs and slogans are trademarks of DigiWomen. You may not use these marks without the prior written permission of DigiWomen.

  1. Third-party content and links
    7.1. The Services may contain links to third-party websites, resources or services that are not owned or controlled by DigiWomen.

7.2. DigiWomen has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party Web sites or services.

7.3. You acknowledge and agree that DigiWomen shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods or services.

  1. Disclaimer of warranties
    8.1. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8.2. DIGIWOMEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

8.3. DIGIWOMEN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED.

  1. Limitation of liability
    9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGIWOMEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES. However, nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, personal injury or any other liability which cannot be excluded under Quebec law, including the Consumer Protection Act and Bill 25.

9.2. IN NO EVENT SHALL DIGIWOMEN’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESS TO OR USE OF OUR SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

  1. Indemnification
    10.1. You agree to defend, indemnify and hold harmless DigiWomen, its officers, directors, employees, volunteers and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your use of the Services.
  2. Termination
    11.1. DigiWomen may terminate or suspend your access to all or part of the Services, without notice, for any conduct that DigiWomen, in its sole discretion, believes violates these Terms or is harmful to other users, DigiWomen or third parties, or for any other reason.

11.2. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, provisions relating to ownership, disclaimer of warranties, indemnification and limitations of liability.

  1. Privacy
    12.1. Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy complies with the requirements of Bill 25 (An Act to modernize legislative provisions respecting the protection of personal information) and other applicable Quebec privacy legislation.

12.2. By using our Services, you consent to the collection, use and sharing of your information as described in our Privacy Policy.

12.3. DigiWomen’s Privacy Officer is the highest level of authority, or his/her delegate, and can be reached at privacy@digiwomen.ca. Prior to any transfer of personal information outside Quebec, a Privacy Impact Assessment (PIA) is conducted to ensure adequate protection. You have the right to be forgotten: you can request that we stop disseminating or de-indexing your information if this causes serious harm. In the event of a privacy incident involving a risk of serious harm, we will promptly notify the Commission d’accès à l’information and the individuals concerned, and take steps to reduce the risks.

12.4. Consent must be clear, free and informed, presented separately from any other information, and obtained each time data is collected. For minors under the age of 14, parental consent is required, unless the collection is clearly to the minor’s advantage. You can easily withdraw your consent at any time by contacting us.

  1. Applicable law and dispute resolution
    13.1. These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflicts of law principles.

13.2. Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved exclusively before the courts located in Laval, Quebec, Canada, and you consent to the personal jurisdiction of such courts.

13.3. Any cause of action you may have with respect to your use of the Services must be commenced within one (1) year after the claim or cause of action arises, subject to the limitation periods provided by applicable law, including the Consumer Protection Act.

    14.1 DigiWomen is committed to making our Services accessible to all users, including those with disabilities, in accordance with Quebec and Canadian accessibility standards, including the Standard on the Accessibility of Web Sites (SGQRI 008).

14.2. If you encounter accessibility problems or have suggestions for improving accessibility, please contact us via our website.

  1. General provisions
    15.1 These Terms constitute the entire agreement between you and DigiWomen relating to your use of the Services, superseding any prior agreements between you and DigiWomen.

15.2. If any provision of these Terms is held by a court to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall be enforced to the fullest extent permitted by law.

15.3. DigiWomen’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4. You may not assign or transfer these Terms, by operation of law or otherwise, without DigiWomen’s prior written consent. DigiWomen may assign these Terms at any time without notice to you.

15.5. Any changes will be notified by e-mail or on the site at least 30 days in advance, with a summary of the changes, to ensure transparency and support our ambitious community.
