  • Last month the Irish Government announced plans to establish a dedicated Garda Legacy Unit to investigate unresolved Troubles-era crimes committed within the Republic of Ireland and to cooperate with the UK’s new Legacy Commission on cross-border cases. According to the joint framework this new unit will act as a single point of contact for victims’ families, re-examine historic files and facilitate information-sharing with British authorities. Legislation is to follow, ensuring the “fullest possible cooperation” between Irish and UK investigators, though what this looks like in practice remains to be seen. While this may represent long-overdue progress, it is a disgrace that it has taken almost 27 years since the Good Friday Agreement for the Irish State to finally establish a formal mechanism to investigate Troubles-related crimes at home. How genuine this new spirit of cooperation will be remains to be seen.   • Clarification was delivered this morning by the Civil Court of Appeal in Winters v. The Legal Aid Board & Ors [2025] IECA 205 concerning the scope of legal aid for prisoners whereby the Court has held that; “The Legal Aid Board made no error in concluding that the reference in the Scheme to judicial reviews “concerning criminal matters or matters where the liberty of the applicant is at issue” does not cover legal costs incurred in seeking to compel appropriate medical treatment while the applicant is serving a custodial sentence.” Our principal solicitor Ciarán Mulholland has stated; “This novel ruling departs from the spirit of the European Convention on Human Rights on the rights of vulnerable citizens whom have been deprived of their liberty and within the custody of the State. In light of this authority it is deeply concerning in Ireland that prisoners’ in custody are wholly at the mercy and good-will of solicitor’s acting pro bono in bringing any litigation pertaining access to proper medical treatment.   • The passing of award-winning journalist Ed Moloney marks the loss of one of the most courageous and principled voices on the Troubles in Ireland. His fearless reporting and commitment to uncovering uncomfortable truths helped expose State failures, institutional cover-ups and the enduring struggles faced by victims and families seeking justice. At a time when the both the Irish & British Governments continues to obstruct access to justice and evade its international obligations under the Good Friday Agreement, Moloney’s work reminds us why independent journalism is indispensable. Truth-telling is not only a moral act, it is a legal and democratic necessity in societies still grappling with past conflicts. His legacy challenges all of us, lawyers, journalists and citizens alike, to continue demanding transparency, accountability and respect for the rule of law in the face of political convenience.   • The Court of Appeal yesterday heard our client’s appeal from the High Court in which McGrath J ordered his surrender to the North for alleged offences dating back to 1975 involving INLA activities. The appeal argues that the near 50yr delay by the British authorities, who repeatedly declined to seek extradition despite knowing our client’s whereabouts, together with the sudden issuance of a Trade and Cooperation Arrest Warrant in 2024 it to mention the British Government’s selective approach to legacy and reconciliation under the Good Friday Agreement, amounts to oppressive litigation and an abuse of the Irish courts’ process.   • This Saturday morning, we are in attendance at the @TCDLawSchool “Irish Supreme Court Review 2025”. It is a pleasure to be amongst some of Ireland’s great legal minds and practitioners discussing the impact of the Supreme Court’s recent judgments which include the Mulholland Law case of DPP v. Twomey [2024] IESC 11 that clarified the doctrine of joint enterprise and abandonment within Irish jurisprudence.   • The Irish Network of Legal Observers has released its report on the policing of the *Dublin Port Tunnel pro-Palestine protest* (4 October 2025). The report documents unjustified and disproportionate use of force by An Garda Síochána, including repeated and close-range deployment of double-strength pepper spray, use of batons near protesters’ heads, and violence against individuals who were surrendering or retreating. Legal observers, clearly identifiable in high-visibility vests were also affected by pepper spray, one reportedly targeted for filming Garda misconduct. The report concludes that Garda actions breached internal policies and may have violated Ireland’s obligations under the International Covenant on Civil and Political Rights and the European Convention on Human Rights, which protect the right to peaceful, even disruptive, protest.   • An international coalition of civil society organisations, cybersecurity experts and companies has issued a stark warning to the Irish Government over its support for EU and domestic plans that would undermine encryption. The proposed EU “Chat Control” law would mandate the mass scanning of private communications, even encrypted ones, while the Minister for Justice Jim O’Callaghan has outlined similar plans to give An Garda Síochána access to encrypted messaging services. Experts and rights groups, including the Irish Council for Civil Liberties (@ICCLtweet), warn that weakening encryption would expose everyone, individuals, journalists, businesses, and state institutions, to greater risks of hacking, cybercrime and surveillance abuse. Encryption is not the enemy of safety; it is a safeguard for privacy, security and democracy itself.   • Breda O’Brien has raised an essential question in today’s Irish Times: What is the justice system for if we don’t believe in rehabilitation? We are witnessing a dangerous narrative take hold: justice is being reduced to punishment and rehabilitation is being portrayed as weakness. This erosion of principle undermines not only those who seek to rebuild their lives but also the integrity of our justice system itself. We see daily the transformative potential of rehabilitation for individuals, for communities and for public safety. Justice without humanity is not justice at all. Yet, the establishment parties who are responsible for the chaos and dysfunctionality within our criminal justice system now have the audacity to exploit their own shortcomings for political gain attacking public representatives who show courage and integrity by standing up for fairness and reform. It is easier to scapegoat than to fix.   • As we celebrate Dundalk FC’s promotion tonight, we also take a moment to remember one of the club’s all-time greats, Jimmy Hasty, a Belfast native and Dundalk legend, who was murdered on this day, 11th October 1974, in a sectarian attack in north Belfast. Born in Sailortown, Belfast, in 1936, Jimmy lost his left arm in a mill accident at just 14 but that never stopped him. A natural goalscorer, he rose through the ranks from St Joseph’s to Islandmagee and Newry Town before signing for Dundalk FC in 1960. With Dundalk, Jimmy became a hero, scoring over 100 goals in 170 appearances and helping the club to League of Ireland glory in 1963. He also led Dundalk to make Irish football history, when they became the first Irish side ever to win a European Cup match away from home, against FC Zürich. After retiring and returning home to Belfast, Jimmy was tragically murdered by the UVF on his way to work in 1974 ,a senseless sectarian killing that robbed his family, his community, and Irish football of a true inspiration.
