SEBI has issued a consultation paper dated October 28, 2025 that proposes a comprehensive rewrite of the SEBI (Mutual Funds) Regulations, 1996 to simplify language, remove redundancies, clarify ambiguities, and align the framework with three decades of market evolution, technological change, and accumulated circulars/guidance that have made the rulebook voluminous and complex. While a comprehensive review of the MF Regulations has been initiated, proposals made on two specific past consultations, one on permissible business activities for an AMC and the other on Total Expense Ratio, which had been initiated earlier, have been included in the current set of proposals. In our update, we have analysed SEBI’s proposals and their impact on the mutual fund industry. In their latest article, “𝗚𝗦𝗧 𝟮.𝟬 𝗜𝗺𝗽𝗮𝗰𝘁: 𝗠𝗠𝗧 𝗢𝗽𝗲𝗿𝗮𝘁𝗼𝗿𝘀 𝗛𝗶𝘁 𝗯𝘆 𝗛𝗶𝗴𝗵𝗲𝗿 𝗧𝗮𝘅 𝗢𝘂𝘁𝗴𝗼, 𝗧𝗶𝗴𝗵𝘁𝗲𝗿 𝗖𝗮𝘀𝗵𝗳𝗹𝗼𝘄𝘀,” published in ETCFO, our Partner Stella Joseph and Advocate Aradhya Singh delve into how the dual-rate GST regime under GST 2.0 is reshaping the landscape for multimodal transport (MMT) operators. They highlight how Input Tax Credit limitations in the Amendment Notification No. 15/2025- Integrated Tax (Rate) dated 16.09.2025 can potentially lead to higher effective tax outgo and tighter cashflows, creating a new normal for the logistics sector, particularly the MMT operators . The authors emphasize that if industry realities necessitate a choice-based GST framework, the way forward lies in well-considered policy representation. Our Partner Stella Joseph shares her views in Mint latest article, "𝗠𝗶𝗻𝘁 𝗘𝘅𝗽𝗹𝗮𝗶𝗻𝗲𝗿 | 𝗠𝗮𝗱𝗿𝗮𝘀 𝗛𝗖 𝗰𝗮𝗹𝗹𝘀 𝗰𝗿𝘆𝗽𝘁𝗼𝗰𝘂𝗿𝗿𝗲𝗻𝗰𝘆 ‘𝗽𝗿𝗼𝗽𝗲𝗿𝘁𝘆’—𝗵𝗲𝗿𝗲’𝘀 𝘄𝗵𝗮𝘁 𝘁𝗵𝗮𝘁 𝗺𝗲𝗮𝗻𝘀", by Krishna Yadav. She noted that the ruling enables investors to pursue traditional property remedies like injunctions, escrow preservation, and bank guarantees instead of relying solely on exchange-driven loss-sharing mechanisms. She added that this strengthens investors’ ability to challenge unilateral asset reallocations and assert proprietary claims when wallets are frozen or compromised. She noted that the Supreme Court restored the 2017 eviction order, ruling that the High Court had exceeded its jurisdiction and reaffirming the existence of a jural landlord-tenant relationship under Section 43 of the Karnataka Rent Act, 1999. She explained that rent receipts signed by the landlord serve as prima facie proof of tenancy, and producing them satisfies the initial burden under the Act.
